A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, APPROVING THE PRELIMINARY PLAT OF LAKELAND HILLS,
DIVISIONS #13 LOCATED EAST OF AND ADJACENT TO THE CITY OF
PACIFIC CITY LIMITS AT APPROXIMATELY 52ND STREET S.E. AND
EXTENDING SOUTH TO THE KING/PIERCE COUNTY LINE.
WHEREAS, Application No. PLT0006-90, dated June 7, 1990,
has been submitted to the City of Auburn, Washington, by
HENDERSON DEVELOPMENT, INC. requesting approval of a
Preliminary Plat of Lakeland Hills Division #13 consisting of
65 lots and containing 28.5± acres be known as "LAKELAND
HILLS" located east of and adjacent to the City of Pacific
city limits at approximately 52nd Street S.E. and extending
south to the King/Pierce County line, hereinafter described in
Section 1 of this Resolution; and
WHEREAS, said request above referred to, was referred to
the Hearing Examiner for study and public hearing thereon; and
WHEREAS, the Hearing Examiner based upon staff review,
held a public hearing to consider said petition in the Council
Chambers of the Auburn City Hall, on April 21, 1992, at 7:00
p.m., at the conclusion of which the Hearing Examiner
recommended approval of the Preliminary Plat, based upon the
following Findings of Fact and Conclusions, to-wit:

FINDINGS OF FACT
1. The applicant, Henderson Development Inc., through its
agent, Kenneth Kinared, applies for preliminary plat
approval for Lakeland Hills Division No. 13. The
proposal is for preliminary plat approval of a 65 lot
subdivision located on a site approximately 28.5 acres in
size.
2. The subject site is located east of and adjacent to the
City of Pacific city limits at approximately 52nd Street
S.E. in the City of Auburn and extending south to the
King/Pierce County line.
3. The subject site, which is currently vacant, is zoned R-
2, Single Family Residential and is so designated in the
City's Comprehensive Plan. Surrounding zoning and land
uses in the vicinity include R-4, vacant to the north;
Pierce County zoning, vacant, to the south; R-2, Single
Family to the east; and R-2, vacant to the west.
4. This application is brought at the same time as a Surface
Mining Permit for the excavation of material to
accommodate the construction of this Division and
Divisions #9, #10, #12 and #14 which is being processed
as a separate preliminary plat.
5. The large scale development within Auburn known as
Lakeland Hills encompasses approximately 458 acres. As
of this date, there have been seven plats approved which
contain 780 lots. There are four divisions, Division
numbers 5-8, which have received preliminary plat
approval but which have not yet received final plat
approval.
6. The City determined in its review of this project that a
previously issued Environmental Impact Statement dated
October 5, 1981 contained insufficient information to
evaluate the traffic impacts of this proposal.
Accordingly, a new Environmental Checklist was prepared
containing a description of the environmental impacts of
the requested preliminary plat. The City's review of the
environmental checklist resulted in the issuance of a
Mitigated Determination of Non-Significance containing 23
mitigating conditions.

7. The City Council adopted the Lakeland Hills Special
Planning Area Plan as an element of the Comprehensive
Plan on April 8, 1988. The Special Planning Area is
designed to provide a mechanism for detailed planning of
large areas under single or coordinated management.
Therefore, in addition to the guidance as set forth in
the City of Auburn Comprehensive Plan, the Lakeland Hills
Plan Element provides long-term predictability both to
the citizens of the City of Auburn and to the developer
in terms of future planning, zoning, subdivision, and
development decisions.
8. After the adoption of the Lakeland Hills Plan the City
has approved utility plans for sewer, water, and storm
drainage for the entire development of Lakeland Hills.
The plats proposed in this preliminary plat are
consistent with the utility plans already approved.
9. Plans are being completed for the construction of a 5
acre community park to be located adjacent to Division
No. 6 as well as a park next to the Stuck River.
Construction of the 5 acre park is anticipated to
commence this summer while the Riverfront Park will be
constructed in 1993.
10. An arterial which will connect the East Valley Highway to
the uplands of Lakeland Hills, Lakeland Hills Way, is
currently under construction. This arterial will provide
access to Lakeland Hills and will eliminate the current
more limited access currently provided to the area by one
street known as Mill Pond Drive.
11. The Stuck River Bridge has been replaced by a new 4-lane
bridge and the Lakeland Hills developers have deposited
$200,000 with the City for the new development's share of
the cost of the bridge.
12. The City of Auburn's Comprehensive Plan seeks to
encourage the retention of vegetation while retaining
areas with slopes in excess of 25~ as open space to
protect against erosion and land slide hazard. The City
also seeks to develop an efficient collector system for
traffic.
13. The Lakeland Hills Special Planning Area Plan seeks to
provide for considerable park land for Lakeland Hills
residents while creating an efficient street pattern and
improving the existing traffic flow.

14. At the time of the Hearing Examiner public hearing, the
testimony from interested members of the public related
primarily to concerns associated with the impacts of the
surface mining permit. No public objection was expressed
to the preliminary plat application.
15. The staff report, with its recommendation of conditional
approval, is incorporated herein by reference as though
set forth in full.
CONCLUSIONS OF LAW
1. The Land Division Ordinance which sets forth a series of
criteria which must be established by the evidence before
a preliminary plat can be .approved within the City of
Auburn.
2. The first of these criteria is that adequate provision
has been made for the public health, safety, and general
welfare of the citizens of the City of Auburn. The
preliminary plat as submitted by the applicant and as
supplemented by the recommended conditions both contained
in the staff report and in the MDNS establishes that the
applicant has made adequate provisions.
3. The proposed subdivision conforms to the general purposes
of the Comprehensive Plan in that the Plan designates the
plat for single family residential uses.
4. The applicant must establish that the proposed
subdivision is in compliance with the general purposes of
other applicable policies or plans adopted by the City
Council. This criteria is established by the evidence as
the preliminary plat application is consistent with the
Lakeland Hills Special Planning Area Element.
5. The preliminary plat complies with the general purposes
of the Land Division Ordinance as set forth in Section
17.02.030.
6. Finally, the plat meets or exceeds the requirements of
the Zoning Ordinance and is consistent with the City's
environmental standards.

1 7. The environmental impacts of the proposed subdivision
2 have been adequately mitigated.

4 For each of the above reasons, the recommendation of the
5 Hearing Examiner to the Auburn City Council on the application
6 for a Preliminary Plat is approved and confirmed.
7 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
8 WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH
9 RESOLVES THAT:
10 Section 1. The above cited Hearing Examiner's Findings
11 and Conclusions are herewith approved and incorporated in this
12 Resolution.
13 Section 2. The Preliminary Plat of applicant, HENDERSON
14 DEVELOPMENT, INC. of a 65 lot single family subdivision
15 located within the development of Lakeland Hills, located east
16 of and adjacent to the City of Pacific city limits at
1~ approximately 52nd Street S.E. and extending south the
18 King/Pierce County line, on property zoned R-2 (Single
19 Family), and legally described on the attached Exhibit "A" and
20 incorporated by reference herein is approved.
21 Section 3. Such approval also includes the following
22 conditions:
23 1. Lakeland Hills Way shall be dedicated and
constructed from the East Valley Highway ("A" Street
24 S.E.) to the existing Lakeland Hills Way constructed
in Division No. 3 prior to final plat approval.

2. At the final plat approval for any division the
applicant shall demonstrate that sufficient park
land has been dedicated to the City to satisfy the
park needs of this and prior subdivisions as
required by the Lakeland Hills Plan.
3. The street names shall be consistent with the
existing street name system of Lakeland Hills.
4. The mitigating conditions of the Mitigated
Declaration of Non-Significance (SEP0047-90R) are
incorporated herein by reference.
Section 4. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directives of this legislation.
