A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
3 WASHINGTON, AMENDING THAT CERTAIN FIXED-BASED LEASE AT AUBURN
MUNICIPAL AIRPORT FOR AUBURN FLIGHT SERVICE, INC., PREVIOUSLY
4 APPROVED PURSUANT TO RESOLUTION NO. 2298, TO PROVIDE FOR
ADDITIONAL AIRCRAFT TIE DOWN SPACE.

WHEREAS, on March 22, 1972, the City of Auburn entered
into a twenty year (20) fixed-base lease with Seattle Flight
7
8 Service, Inc. wherein the City agreed to lease certain real
9 property and facilities located at Auburn Municipal Airport to
Seattle Flight Service, Inc.; and
WHEREAS, pursuant to Resolution No. 1305 approved by the
12 City Council on March 15, 1982, Seattle Flight Service, Inc.
15 assigned its rights and obligations under said lease to the
Auburn Flight Service, Inc.; and

15 WHEREAS, pursuant to Resolution No. 2205 approved by the
City Council on June 10, 1991, Resolution 1305 was amended to
include the premises previously leased to Car Temps; and

]8 WHEREAS, pursuant to Resolution No. 2298 approved by the
19 City Council on April 6, 1992, the fixed-base lease was
20 extended for twenty (20) years; and
21 WHEREAS, Auburn Flight Service, Inc. has now requested
the fixed-base lease agreement be further amended to provide
25 for additional tie down spaces under certain new conditions
24 and to continue all other conditions of the original fixed-
25 base lease, and the City has agreed to such an amendment.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,

WASHINGTON, HEREBY RESOLVES AS FOLLOWS:
Section 1. The fixed-base lease approved by the city

Council of the city of Auburn, Washington pursuant to
5
Resolution No. 1305, as amended by Resolution No. 2220 and
Resolution No. 2298, wherein the City leases certain space in
7
the Auburn Flight Building at the Auburn Municipal Airport and
8
a certain number of aircraft tie down spaces to Auburn Flight
9
Service, Inc. is hereby amended to add nine (9) additional tie
10
down spaces under the terms and conditions delineated in
11
Addendum No. 1, which is attached hereto as Exhibit "A" and
12
13 incorporated herein.
Section 2. All other conditions of the original fixed-
14
base lease agreement between the City as Lessor and Auburn
Flight Service, Inc. as Lessee shall remain in full force and
effect.

Ssotlon 3. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directives of this legislation.

FLIOHT SERVICEr INC. TO PROVIDE NINE ADDITIONAL TIE DOWN

The City of Auburn and Auburn Flight Service, Inc. herein
5
agree to amend the fixed-base lease approved pursuant to
Resolution No. 2298 to provide for additional aircraft tie
6 down space under the following terms and conditions:

1. LE~SE PREMISES TO BE ADDED TO LEASEHOLD. Nine (9)
aircraft tie down spaces located directly west of Auburn
8 Flight Service's current facility, as shown on Attachment
No. i which is attached hereto and incorporated herein,
9
are herein leased to Auburn Flight Service, Inc.

2. TERM. Effective November 1, 1992 and to run
11 concurrently with the existing facility lease.
12 3. RENT. Initial monthly rental rate to be Three Hundred
and Fifty-Eight Dollars and Ninety-Two Cents ($358.92)
]3 plus current Washington State Leasehold Tax. The initial
rental breakdown is as follows: Rent is $358.92; WLHT @
14 .1284% is $46.00; The total is $405.00.
15 4. RENTAL aDJUSTMENTS. Rental adjustments to be made at
the same time and by the same method as provided for in
16 the existing .lease for ~he existing facility. Rental
rate on the nine (9) tie,owns shall, however, not exceed
17 the monthly rate charged for other Airport aircraft
tiedowns multiplied by nine.

5. CANCELLATION BY LEEERE. Thirty (30) days written notice.

6. C/%NCELLATION BY LESSOR. Upon default of lessee.

7. This lease is subject to all applicable current terms and
21 conditions of the existing fixed-base lease.
