3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON AUTHORIZING THE MAYOR AND CITY CLERK OF THE CITY OF
AUBURN TO EXECUTE A COLLECTION SERVICE CONTRACT BETWEEN THE
4 CITY AND RENTON COLLECTIONS, INC. TO PROVIDE A COLLECTION
SERVICE IN COLLECTING UNPAID PENALTIES, INFRACTIONS, CRIMINAL
5 FINES, COSTS, ASSESSMENTS, JUDGMENT AND FORFEITURES RELATING
TO THE AUBURN MUNICIPAL COURT.
7 THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON IN A
8 REGULAR MEETING DULY ASSEMBLED,.HEREWITH RESOLVES AS FOLLOWS:
9 Section 1. The Mayor and City Clerk of the City of
10 Auburn, Washington, are hereby authorized to execute a
11 Collection Service Contract between the City and Renton
12 Collections, Inc. to provide a collection service in
13 collecting unpaid penalties, infractions, criminal fines,
14
costs, assessments, judgments and forfeitures relating to the
15
Auburn Municipal Court. Said Contract is attached hereto,

designated as Exhibit "A" and incorporated by reference in
17
this Resolution.

Section 2. The Mayor is hereby authorized to implement
19
such administrative procedures as .may be necessary to carry
20
out the directives of this legislation.

AGREEMENT FOR COLLECTION SERVICES

The undersigned, AUBURN MUNICIPAL COURT, agrees to utilize collection
servcies provided by RENTON COLLECTIONS, INC. hereinafter referred
to as "R.C.I.", and R.C.I. agrees to provide such services in
accordance with the following terms and conditions:
1. AUBURN MUNICIPAL COURT will refer for collection only
accounts certified to be just and owing and will supply,
at the time of assignment, supporting documentation of
the debt.
2. R.C.I. in accordance with R.C.W. 3.02.045 will add
30 percent of the principal balance to the debt at
the time of assignment. This percentage will represent
statutory collection fee recovery.
3. R.C.I.'s collection activities shall be in compliance
with federal, state, and local laws with adherence
to the "Fair Debt Collection Practices Act" (F.D.C.P.A.).
4. R.C.I. will deposit into its trust account held with
U.S. Bank of Washington money collected for the
AUBURN MUNICIPAL COURT.
5. R.C.I. will prepare and provide AUBURN MUNICIPAL COURT
a monthly remittance within fifteen (15) days after
the end of each month. This summary will display all
payments received during the previous month and will
be composed of consumer's name, amount paid,
amount due AUBURN MUNICIPAL COURT, remaining balance,
and citation number.
6. AUBURN MUNICIPAL COURT agrees to notify R.C.I. of payments
received directly on accounts placed for collection.
7. The collection fee on all payments after accounts
are placed for collection shall be 30 percent. This
percentage shall remain constant regardless of account
balance, legal and forwarding action.
8. R.C.I. will not instigate legal actions on debts
without first receiving written authorization from
AUBURN MUNICIPAL COURT.
9. R.C.I. will provide status reports upon request.
10. AUBURN MUNICIPAL COURT authorizes R.C.I. to add
interest to accounts placed for collection at the
statutory rate. If this interest is collected, it
is split between AUBURN MUNICIPAL COURT and R.C.I.
equally.

11. R.C.I. is licensed and bonded and iS solely responsible
for the employment, acts and omissions, control, and
direction of its employees. R.C.I. shall defend and
hold AUBURN MUNICIPAL COURT harmless against any claims,
demands, or causes of action that might be asserted due
to collection activity by R.C.I., except with respect
to any such damage, cost, loss, or other expense
caused by failure of AUBURN MUNICIPAL COURT to furnish
pertinent information in the matter herein guaranteed by
AUBURN MUNICIPAL COURT. AUBURN MUNICIPAL COURT hereby
covenants and agrees to indemnify and hold harmless
R.C.I. from all damages incurred by R.C.I. as a result
of the failure of AUBURN MUNICIPAL COURT, its employees,
officers, and agents to furnish pertinent information.
12. The terms of this contract can be terminated by either
party upon thirty (30) days prior written notice.
This agreement constitutes the entire understanding between
RENTON COLLECTIONS, INC. and AUBURN MUNICIPAL COURT, regarding
terms and conditions as they pertain to all collection services
provided to AUBURN MUNICIPAL COURT by RENTON COLLECTIONS, INC.
and cannot be changed or modified except by written agreement signed
by both parties.
