HomeMy WebLinkAbout2541 1 RESOLUTION NO. 2 5 4 1 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN INTERLOCAL AGREEMENT FOR STATION AREA PLANNING FOR THE SOUTH CORRIDOR COMMUTER RAIL PROJECT BETWEEN THE CITY OF AUBURN AND THE REGIONAL TRANSIT AUTHORITY. 4 5 6 7 WHEREAS, the Regional Transit Authorit~' (hereinafter 8 referred to as "RTA") is undertaking project-level planning 9 for a commuter rail system proposed to be developed between 10 Tacoma and Seattle, and known as the South Corridor Commuter 11 Rail Project which will become a component of the RTA's high capacity transportation system; and WHEREAS, as part of the regional transportation planning process, RCW 81.104.080 (2) requires interloc:al agreements 12 13 14 15 16 17 between the RTA and local governments to assume land uses compatible with development of a high capacity transportation system; 18 NOW, THEREFORE, THE CITY COUNCIL OF THE C'ITY OF AUBURN, 19 20 21 22 WASHINGTON, IN A REGULAR MEETING DULY ASSEM.BLED, HEREWITH RESOLVES THAT: Section 1. INTERLOCAL AGREEMENT FOR STATION AREA PLANNING FOR THE SOUTH CORRIDOR COMMUTER RAIL PROJECT THIS AGREEMENT is made this _ day of , 19-, between the Regional Transit Authority (hereinafter referred to as "RTA"), and the City of Auburn, (hereinafter referred to as "City"). WHEREAS, the RTA is undertaking project-level planning for a I:ommuter rail system proposed to be developed between Tacoma and Seattle, and known as the South Corridor Commuter Rail Project which will become a component of the RT A's high capacity transportation system; and WHEREAS, as part of the regional transportation planning process, RCW 81.104.080(2) requires interlocal agreements between the RTA and local governments to assume land uses compatible with development of a high capacity transpOliation system; and WHEREAS, the RT A desires to ensure that the siting and design of commuter rail stations within the City, together with any station ancillary faC1ñties, such as commuter parking, passenger drop-off spaces, and bus, auto, bicycle and pedestrian acceilS facilities, are fully coordinated with the City's plans for land use and circulation in ¡the vicinity of commuter rail stations and other relevant City plans and programs; and WHEREAS, the City desires to ensure that the siting and design of commuter rail stations within the City, together with any station ancillary facilities, are compatible with the 1 --------------------- Resolution No. 2541 Exhibit -A- City's existing and proposed land uses and circulation systems in the vicinity of the commuter rail station(s), and are consistent with the City's Comprehensive Plan, prepal~ed in response to the Washington Growth Management Act; and WHEREAS, RCW 81.104.080(2) requires that the implementation program for the RT A's high capacity transportation system favor local governments with supportive land use plans; and WHEREAS, the City and the RT A hereby mutually agree that station area planning responsive to the desires of the City and the RTA as descnbed above can most effectively be accomplished through a team approach in a shared work program; NOW THEREFORE, in consideration of the mutual promises and covenants herein contained, to be kept, performed and fulfilled by the respective parties hereto, it is mutually agreed as follows: SECTION 1 - ELEMENTS OF THE STATION AREA/l.AND USE PLANNING WORK PROGRAM AND THE RESPONSmILITIES OF EArn PARTY. The accomplishment of the work program shall be carried out by a team composed of staff and consultants designated by the RTA; staff and/or consultants designated by the City; together with assistance by staff from the local transit agency, the County, Washington DOT and other agencies as appropriate. I. Definition of Station Site. Function and Confi~ration. The City has undertaken primary responsibility for examining alternative station locations, determing a preferred station site and preparing preliminary site layouts. The City will conduct this work in cooperation with the RTA, and a consultant whose senices are made possible with funding through a High Capacity Transit pass-through grant. 2 --~---_.._-. The work tasks as identified by the grant are: Task 1: Station location and design Task 2: Identification and description of alternative sites Task 3: Identification of transportation and circulation needs Task 4: Analysis of Site Alternatives Task 5: Public and Transit Agency Involvement Program Through this process, consideration will be given to the following aspects and others as appropriate: · Station functions. · Availability of land for stations and facilities. · Compatibility with surrounding land uses and community goals. · Compatibility with joint development options. · Location to effectively serve an identified "commuter shed" of users. · Accessibility to appropriate streets and highways, pedestrian and bicycle paths, and transit routes. Engineering requirements for construction and opcration of commuter rail trackage and station platforms. · Environmental constraints. · Frontage/infrastructure improvements. · Community acceptance. Following completion of the work elements identified within this agreement, the City Council agrees to forward a duly passed recommendation to the: RTA Board expressing the City's one preferred station site for each rail line. Nothing in this agreement shall prevent the City from including recommendations for future additional station sites for consideration in the context of the RTA Board's consideration of long-term plans for the construction and operation of the commuter rail system. 3 2. Comprehensive/Land Use Plan for the Station Area. Inasmuch as the responsibility for adopting a local land use Comprehensive Plan, determining appropriate land uses and adopting wning ordinances rests with the City, a staff person designated by the City shall act as leader of this work element. The team will review the nature and intensity of existing and proposed future land uses in the station area and for approximately one-quarter mile around the proposed station( s), and the existing and proposed street and circulation system to serve those land uses and identify concentrated employment centers, mixed-use dev,~lopment and housing densities that support the Project as part of a high capacity transportation system. The team will particularly address compatibility with GA requirements, with City goals for the station area(s), and with regional goals for corridor development. The team will identify the potential for desirable new development or redevelopment, if any, and the need for any possible modification to the City's Compr~hensive Plan and/or Zoning Ordinance which will assure land uses compattble with development of a high capacity transportation system. The team may recommend street setbacks and future Right-of-Way (ROW) dedication requirements, as appropriate. The team may develop proposed incentives to promote desired changes, or protective measures to prevent undesirable changes, as appropriate; and shall pre'pare drafts of proposed policy and regulatory documents which are supportive of an implementation program for a high capacity transportation system including, but not limited to Comprehensive Plan amendments and Zoning Ordinance amendments, for submission to the Planning Commission and the City Council for public review and adoption. 3. Traffic Circulation. Access and Parking Plan. Inasmuch as traffic circulation, access to stations and commuter parking at stations are closely interrelated matters and the responsibility for them is shared by the City and the RTA and, in some cases, by 4 other agencies, the City shall provide lead staff for the traffic circulation element and shall also designate City staff to act as co-leader with the RT A for access and parking plan elements; the team shall include representatives of other agencies as appropriate. The team will review the existing and projected future traffic patterns and service levels in the area of the stations, resulting not on1y from the presence of the stations and facilities, but from any changes in type and intensity of land use proposed in the Comprehensive/Land Use Plan work element. Special attention will be given to preserving transit rights-of-way and to optimizing and providing for access to the area by pedestrians, bicyclists, auto drivers, auto passengers and bus passengers, whether they are coming to the area to use the station or to access nearby homes, businesses, or employment sites. Special attention will also be given to parking problems and needs in the area and any potential competition for parking by commuters and by area residents, businesses, or employees. The team will develop plans as appropriate for new or modified stæet and access facilities, driveway access and circulation to the station area( s), on-street and off- street parking provisions, pedestrian walkways and bicycle lanes, provisions for bus and auto-passenger drop-off facilities, waiting areas, shelters, provisions for physically and mentally challenged people, traffic signals, grade crossing protective devices and other system requirements. The team will identify potential transpol1ation demand management programs which would support the high capacity transportation services provided by the station. 4. Bus Service Plan. Inasmuch as the primary responsibility for implementing feeder bus service rests with the local transit agency, a staff member designated by the local transit agency shall act as team leader for this work element, closely supported by staff from the City and the RTA 5 -_._---~~-- The team will define appropriate bus service changes to support the wmmuter rail plan, including bus routes, locations of bus stops and bus schedules. This plan may include route changes well away from station areas to ensure adequate service to the community as well as feeder service to the commuter rail stations. 5. SupDortinl! CaDi tal Facilities Program. Inasmuch as the primary responsibilities of the RT A will be for short-term capital improvements in connection with commuter rail and for longer-term capital improvements in connection with transit services, and the responsibility for future land uses around the station area rests with the City, therefore, staff persons designated by the RT A, the City and the Local Transit Agency shall act as co-team leaders for this work element. The team will develop a short-term capital program for implementation with the start-up of commuter rail operations; and a longer-term capital program for implementation over time, as the ComprehensivelLand Use Plans for the station area develop. The short-term capital program will include direct station-related facilities at the site, which must be constructed to begin commuter rail operations, and ."rill be included in the commuter rail capital budget. It may also include any desirable off-site improvements, such as transit speed, reliability, and passenger facility, street and frontage improvements, curb cuts to meet ADA requirements Ilnd pedestrian walkways or traffic signals, and will identify potential funding sources for such improvements. The longer-term capital program may include needs for ar,ea-wide street improvements and other infrastructure requirements to support land use changes anticipated in the area under the ComprehensivelLand Use Plan. It may recommend street setbacks and other right-of-way preservation measures and may discuss considerations of timing and funding responsibility. 6 6. Puhlic involvement. Public involvement activities in support of the station area/land use planning work program shall be carried out by the working teams outlined in this section under the direction of the RTA. The RTA and the City shall work in partnership to undertake activities that involve citizens in the work program. The RTA will provide elected officials and citizen organizations of the City with information about the progress of the work program on an ongoing basis. The RTA and the City will involve the general public through public meeting and informational materials targeted to the specific issues of that community. The City will identify key citizen groups and individuals and carry out additional public involv_=ment activities with assistance, as necessary, from the RTA and other working team members. 7. Regional. State and Federal Agency Coordination. The RT A shall be responsible for communicating the progress and results of the work program to, and making requests for assistance from, the regional, state and federal agencies and departments involved with regional transportation including, but not limited to, the Washington State Department of Transportation, the Federal Department of Transportation and the Paget Sound Regional Conference. SECTION 2 - TIMING AND COORDINATION OF THE STATION AREAILAND USE PlANNING WORK PROGRAM. 1. Work Program. Designation by the City and by the RTA of individuals to participate in the working teams and of work element team leaders to accomplish the work program outlined in Section 1 shall take place as soon as practically possible after approval of this agreement. The team so designated shall schedule times and places for regular working sessions and shall commit in writing to a program permitting substantial accomplishment of all the work elements by September of 1994. 2. Coordination Process. In the event the working teams cannot devellop a consensus on recommendations and determinations required to complete the work program, the 7 team leader shall be responsible for attempting to resolve differences with the assistance of the Executive Director of the RTA or his or her designed. Any differences not resolved by such efforts shall be noted in final repoI1ts on the work program submitted to the RTA and the City. SECTION 3 - CORRIDOR-LEVEL COORDINA nON OF THE STATION AREMAND USE PLANNING WORK PROGRAM AMONG CONTIGUOUS JURISDICTIONS IN THE CORRIDOR. To ensure consistency of approach and compatibility of findings among local government jurisdictions participating in station area planning in the corridor, the RTA shall provide for coordination of work efforts by the team designated under this Agreement with work efforts by teams designated under similar agreements in other jurisdictions in the corridor through the development of uniform policies and guidelines. 1. Policy Coordination and Guidelines. This coordination shall be provided under the general policy direction of the RTA Board and guidelines provided by the RTA's Executive Director which shall cover at least the following elements: A. Final determination of the commuter rail alignment--Union Pacific R.O.W. or Burlington Northern R.O.W. B. Establishment of system wide commuter rail design standards for the corridor. C. Relative functions of stations within the corridor. D. Corridor-wide circulation and access issues. E. Communication of findings among the various station area plalnning teams in the corridor, and sharing of planning ideas, approaches and problem solutions. F. Environmental concerns that affect more than a single station or jurisdiction. G. Operations and staging plans for start-up of commuter rail re:venue service. H. Public involvement and public information technical support to the individual station area planning teams, and direction of corridor-wide public involvement for commuter rail plans. 8 _.._.~ 2. Resolution of Differences. In the event approaches and findings proposed by participating local government jurisdictions are inconsistent and cannot be resolved by application of the above policies and guidelines, the RTA shall convene one or more meetings of appropriate team members and jurisdictional represe'ntatives in an effort to resolve such differences. Any differences not resolved by such efforts shall be considered by the RT A Board during its review of the results of the planning work program. SECTION 4 ~ FINANCING The above Station Area/Land Use Planning Work Program is funded with Federal and/or State grant contracts for the Regional Transit Project. The City agrees to comply with all provisions of such grant contract( s), which contract( s) is (are) incorporatl:d herein by reference, and to comply with any applicable state or federal laws and regulations. In the event of any inconsistencies or conflicts between the provisions of this Agreement and such grant contracts, the provisions of the grant contract(s) shall be controlling. SECTION 5 - TERMINATION This Agreement may be terminated by either party for their convenience upon sixty (60) days written notice. SECTION 6 - TERM AND AMENDMENT The term of this Agreement shall be vear(s) commencing with the date first above written. This Agreement may be amended and extended by further written agreement of the parties. 9 SECf10N 7 - LEGAL RESPONSIBILITY By entering into this Agreement, neither party is assuming any liability, obligation or responsibility except as specifically provided herein. Nothing in this Agreement is intended or shall be construed as impairing the legal powers and responsibilities of a party as may be provided or prescn'bed by law. 10 ..._-----, IN WITNESS WHEREOF, the parties hereto have executed this AGREEMENT as of the date first written above.
