HomeMy WebLinkAbout2881 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 RESOLUTION NO. 2 8 8 i A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE MAYOR TO EXECUTE A PURCHASE AND SALE AGREEMENT BETWEEN THE CITY OF AUBURN SEWER DIVISION OF THE PUBLIC WORKS DEPARTMENT AND OPUS NORTHWEST L.L.C. IN THE AMOUNT OF EIGHT HUNDRED FIFTY THOUSAND DOLLARS ($850,000). WHEREAS, the City Sewer Division of the Public Works Department obtained the property known as the 'Goedecke North" property through foreclosure of local improvement assessment liens described in the Local Improvement Assessment Deed dated May 23, 1994, recorded under King County recording number 9405260718 and attached hereto as Exhibit 'A" and is herein incorporated by this reference; and WHEREAS, the City Sewer Division of the Public Works Department is responsible for recovering its ratepayer's money spent by the City Sewer Division of the Public Works Department on the sanitary sewer local improvements constructed on the "Goedecke North" property; and WHEREAS, the City Sewer Division of the Public Works Department has negotiated a fair purchase price in the Resolution No. 2881 October 21, 1997 Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 Purchase and Sale Agreement, a copy of which is attached hereto as Exhibit KB" and is incorporated by this reference; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH RESOLVES THAT: ~[~ The Mayor of the City of Auburn is herewith authorized to execute a Purchase and Sale Agreement between the City of Auburn Sewer Division of the Public Works Department and OPUS Northwest L.L.C. in the amount of EIGHT HUNDRED FIFTY THOUSAND DOLLARS ($850,000). A copy of said Purchase and Sale Agreement is attached hereto as Exhibit KB" and incorporated herein by this reference. ~ The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. Daskam, ~ctin~ City Clerk 17 18 ~PROVED ~S TO ~OR~: Michael J Reynol , 22 City Attorney 24 25 26 Resolution No. 2881 October 21, 1997 Page 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 ORIGINAL LOCAL IMPROVEMENT ASSESSMENT DEED This indenture, made this 23rd day of May, 1994, between Arlene Mempa, as Deputy Finance Director of the City of Auburn, King County, Washington, party of the first part, and the City of Auburn, party of the second part: WITNESSETH, that, whereas, at a public sale of real property held on the 21st day of July 1989, pursuant to a real property foreclosure and sale judgment entered in the superior court in the county of King on the 30th day of May, 1989, in proceedings to foreclose local improvement assessment liens upon real property and an order of sale duly issued by said court, real property was struck off and sold to the City of Auburn in compliance with the laws of the state of Washington, that said real property is described on attached Exhibit "A", which consists of eight pages and which is by this reference incorporated herein as if fully set forth, and that said City of Auburn has complied with the laws of the state of Washington necessary to entitle it to a deed for the real property. NOW, THEREFORE, know ye, that, I, Arlene Mempa, Deputy Finance Director of said City of Auburn, King County, Washington, in consideration of the premises and by 9irtue of the statutes of the state of Washington, in such cases Special Assessment Deed May 20, 1994 (agree/geo-deed} Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 provided, do hereby grant and convey unto the City of Auburn, its heirs and assigns, forever, the said real property hereinbefore described which was struck off and sold to the City of Auburn July 21, 1989 as evidenced by that certain return of sale on real estate under judgment and order of sale executed on the 24th day of August, 1989.
