3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN
4 AMENDMENT TO SOLID WASTE DISPOSAL AGREEMENT BETWEEN THE CITY
OF AUBURN, THE BOEING COMPANY AND R.S.T. DISPOSAL, INC.

6 THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, IN A
7
REGULAR MEETING DULY ASSEMBLED, HEREWITH RESOLVES THAT:
8
9 SECTION 1. The Mayor and City Clerk of the City of
10 Auburn, Washington, are herewith authorized to execute an
11 Amendment to Solid Waste Disposal Agreement between the CITY,
12
THE BOEING COMPANY and R.S.T. DISPOSAL, INC. The original
13
Solid Waste Disposal Agreement was authorized by City of
14
15 Auburn Resolution No. 2380 dated March 3, 1993. A copy of
16 said Amendment is attached hereto as Exhibit "A" and
17 incorporated herein.
18
SECTION 2. The Mayor is hereby authorized to implement
19
such administrative procedures as may be necessary to carry
20
21 out the directives of this legislation.

1 AMENDMENT TO

SOLID WASTE DISPOSAL AGREEMENT

4 THIS AGREEMENT is made and entered into this 71/A day of
5 ^~J1997, by and between the CITY OF AUBURN, a municipal
6
7 corporation of the State of Washington, hereafter referred to
8 as "CITY", and THE BOEING COMPANY, a Delaware corporation,
g hereinafter referred to as "BOEING", and R.S.T. DISPOSAL,
10 INC., a Washington corporation, hereinafter referred to as
11
"R.S.T."
12
WHEREAS, the CITY, R.S.T. and THE BOEING COMPANY
13
14 heretofore entered into a Solid Waste Disposal Agreement on
15 March 15, 1993, as authorized by City of Auburn Resolution No.
16 2380; and
17
WHEREAS, the parties hereto desire to amend said
18
19 Agreement as hereinafter set forth.
20 NOW, THEREFORE, in consideration of the covenants and
21 conditions of this Agreement, the parties agree as follows:
22 Section 1. The parties desire to establish a new service
23
and rate for dumping BOEING owned 5x5 stackable tubskid

1 containers at the BOEING plant located in Auburn, Washington,
2
into an R.S.T. owned truck for disposal, according to normal
3
procedures at the rates and charges as hereinafter set forth.

5 1.1 The rate for this new service shall be
6 $69.30 per hour for driver and truck and
shall be in effect while the driver is on-
7
plant dumping the 5x5 tubskid containers
8
into an R.S.T. truck.
9 1.2 The hourly rate for dumping the 5x5
10 tubskid containers will end when the
11 R.S.T. truck leaves the Auburn BOEING
12 plant.
13 1.3 The R.S.T. driver will note on the
14 existing haul slips. the time he arrives
15 on-plant and the time he leaves the plant.
1.4 Once the R.S.T. driver has finished
16
dumping the 5x5 tubskid containers and
17
leaves the BOEING plant for disposal, the
18
standard hauling fees and disposal fees
19 shall remain in effect.
20 1.5 R.S.T. will have drivers on-plant (two
21 shifts) Monday through Friday. There
22 shall be two adjustable windows mutually
23 agreed upon by R.S.T. and BOEING
24 tentatively set at 9:00 a.m. to 1:00 p.m.

1 and again from 5:00 p.m. to 9:00 p.m. to
2 dump the 5x5 tubskid containers.
3 1.6 R.S.T. will have drivers on-plant (one
4 shift) Saturday and Sunday. There shall
5 be one adjustable window, mutually agreed
6 upon by R.S.T. and BOEING tentatively set
7 at 12:00 noon to 3:00 p.m. to dump the 5x5
tubskid containers.

1.7 R.S.T. will make the necessary number of
9
trips to ensure that the 5x5 tubskid
10 containers located within each
11 predetermined staging area for pickup
12 throughout the plat are dumped during each
13 specified time window.
14 1.8 BOEING will ensure that the 5x5 tubskid
15 container staging areas provide adequate
16 space and turning radius fro the R.S.T.
driver to maneuver his truck to perform
17
the requested service.

1.9 BOEING will be responsible for the
19
maintenance and repair of BOEING owned 5x5
20 tubskid containers. R.S.T. will be
21 responsible for notifying the designated
22 BOEING employee of needed repairs.
Zg 1.10 This Amendment shall have no impact on the
24 costs associated with other existing
25

1 services currently provided by the
2 existing Solid waste Contract Agreement.
3 1.11 All other terms and conditions of the
4 existing Solid Waste Contract Agreement
5 between the CITY OF AUBURN, THE BOEING
6 COMPANY and R.S.T. DISPOSAL shall remain
the same and in full force and effect.

Section 2. This Amendment is to become effective on
9 I

11 or, if the existing option to review the contact for three (3)
12 additional years is exercised, it shall continue through
13 February 28, 2001.
