RESOLUTION NO. 2 9 3 2 A R~SOLUTION OP THE CITY COUNCIL OP THE CITY OF AUBURN, WASHINGTON, AMENDING THAT CERTAIN FIXED-BASE LEASE AT AUBURN MUNICIPAL AIRPORT FOR AUBURN FLIGHT, INC., TO REFLECT NEW 4 RENTAL PATE. 5 WHEREAS, on March 22, 1972, the City of Auburn ? (hereinafter referred to as "CITY"), entered into a twenty 8 year (20) fixed-base lease with SEATTLE FLIGHT SERVICE, INC. 9 (hereinafter referred to as "SEATTLE FLIGHT") wherein the CITY 10 agreed to lease certain real property and facilities to 1! SEATTLE FLIGHT at the Auburn Municipal Airport; and 12 WHEREAS this fixed-base lease expired on March 21, 1992; 15 however, the lease provides for a twenty (20) year option to 14 renew upon negotiation of a new rental rate; and 15 WHEREAS, pursuant to Resolution No. 1305 approved by the City Council on March 15, 1982, SEATTLE FLIGHT assigned its ]7 rights and obligations under said lease to the AUBURN FLIGHT 18 SERVICE, INC. (hereinafter referred to as "AUBURN FLIGHT"); 19 and 20 WHEREAS, pursuant to Resolution No. 2205 approved by the 2] City Council on June 10, 1991, the CITY amended Resolution No. 22 1305 to include the premises previously leased to CAR TEMPS; 23 and 24 25 26 Resolution No. 2932 March 31, 1998 Page 1 WHEREAS, pursuant to Resolution No. 2298 approved by the City Council on April 6, 1992, the CITY and AUBURN FLIGHT successfully negotiated a new rental rate agreement to include 4 an escalation clause to adjust the rental rates at the end of 5 each five (5) year period during the twenty (20) year lease; and 7 WHEREAS, the CITY and AUBURN FLIGHT have successfully 8 negotiated a new rental rate agreement and both parties have 9 agreed to continue all conditions of the original fixed-base lease except for the condition expressly stated below. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, 12 WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH 15 RESOLVES AS FOLLOWS: ]4 Section 1. The fixed-base lease approved by the CITY pursuant to Resolution No. 1305, Resolution No, 2205 and Resolution NO. 2298, wherein the CITY leases certain space in 17 the Auburn Flight Building at the Auburn Municipal Airport to AUBURN FLIGHT, INC., is hereby amended to include the 19 following condition: 20 1. NEW RENTAL RATE: The new annual 21 rental rate shall be computed based on Ten 22 Dollars ($10.00) per square foot for a building area of 2,784 square feet. Therefore the 24 annual rental shall be Twenty-Seven Thousand 25 26 Resolution No. 2932 March 31, 1998 Page 2 ] Eight Hundred and Forty Dollars ($27,840.00), 2 plus current Washington State Leasehold Tax. The rent shall be paid in twelve (12) equal 4 monthly payments of Two Thousand Three Hundred 5 and Twenty Dollars ($2,320.00), plus current applicable Washington State Leasehold Tax. 7 Section 2.
