RESOLUTION NO. 2 9 ? % A R~SOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, EXCLUDING A 1.21 ACRE PARCEL OF PROPERTY FROM THE CITY OF AUBURN LOCATED ON THE SOUTHEAST GREEN VALLEY ROAD. 4 5 WHEREAS, pursuant to RCW 35.13.340 the City of Auburn has received a petition from BURR W. MOSBY requesting that a 1.21 7 acre parcel of property be excluded from the City of Auburn 8 and included into unincorporated King County; and 9 WHEREAS, petitioner owns property on the Southeast Green 10 Valley Road, most of which is in agriculture use; and 11 WHEREAS, petitioner owns approximately 68.83 acres of 12 which 6.25 acres is within the City of Auburn zoned RR (Rural 13 Residential), and the remainder is in unincorporated King County zoned Agriculture; and 15 WHEREAS, most of the property that is within the City is on the south side of the Green Valley Road and containing a home, wherein the subject 1.21 acres is on the north side of Green Valley Road and is used for agriculture. The remaining acreage is also on the north side of the road and also used 2O for agriculture; and WHEREAS, petitioner has previously approached the City 22 about building a packing shed/barn and office on the 1.21 acre parcel; and 25 Resoluti0nNo. 2974 May 27, 1995 Page 1 WHEREAS, this 1.21 acre parcel of property is zoned RR, 2 which is essentially a single family zone, the City could not permit the request; and 4 WHEREAS, after further discussions with petitioner and 5 King County, it was determined that King County would allow "de-annexing" the property and to allow such a use in its 7 Agriculture zoning district; and 8 WHEREAS, de-annexing property is allowed pursuant to RCW 9 35.13.340 wherein the property owner must own property that is ]0 partially within and partially without the boundaries of the 11 City and the property owner has made such a request for the de-annexation; NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AS FOLLOWS: Section 1. The City of Auburn hereby pursuant to RCW 35.13.340 approves this exclusion of property from the City of 17 Auburn and inclusion of the property into the unincorporated King County and requests that the King County Council approve 19 the same. 20 Section 2. SITUATE IN THE SOUTHEAST QUARTER OF SECTION 21, TOWNSHIP 21, RANGE 5 E. WM. KING COUNTY, 2 WASHINGTON AND MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING ON A POINT ON THE AUBURN CITY LIMITS 4 AS ESTABLISHED BY CITY OF AUBURN ORDINANCE NO. 1278, SAID POINT BEING THE INTERSECTION OF THE 5 SOUTH RIGHT OF WAY LINE OF THE SE GREEN VALLEY ROAD WITH THE EAST BOUNDARY OF SOUTHWEST QUARTER OF THE SOUTHEAST QUARTER OF SAID SECTION 21; THENCE NORTH ALONG SAID CITY LIMITS 7 TO THE NORTH BOUNDARY OF SAID SOUTF~WEST QUARTER OF THE SOUTHEAST QUARTER OF SECTION 21; THENCE 8 WEST ALONG SAID NORTH BOUNDARY TO THE SOUTH RIGHT OF WAY LINE OF SAID SE GREEN VALLEY ROAD; 9 THENCE SOUTHEASTERLY ALONG SAID RIGHT OF WAY LINE TO THE POINT OF BEGINNING. l0 Seetion 3.
