HomeMy WebLinkAbout2980] RESOLUTION NO. 2 9 8 0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, 3 WASHINGTON, AUTHORIZING THE CREATION OF AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF AUBURN AND THE CITY OF PACIFIC 4 FOR THE PURPOSE OF SALE BY THE CITY OF AUBURN OF TWO (2) FIRE APPARATUS TO THE CITY OF PACIFIC FIRE DEPARTMENT FOR FIRE 5 PROTECTION PURPOSES. WHEREAS, Chapter 39.33 RCW entitled "Intergovernmental 7 8 Disposition of Property" provides for the sale of public 9 property by any municipality to any other governmental body, 10 including but not limited to other municipalities; and WHEREAS, the City of Auburn Surplus Property Unit is 11 converting to surplus public personal property two (2) fire 12 13 apparatus, described in Exhibit "A" attached hereto and 14 incorporated herein by this reference; and 15 WHEREAS, the City of Pacific Fire Department has 16 indicated a willingness to purchase the two (2) fire apparatus ]7 as described in Exhibit "A" for the amount of Five Thousand 18 Dollars and no cents ($5,000.00) plus sales tax of 8.6% for a 19 total of Five Thousand Four Hundred Thirty Dollars and no 20 cents ($5,430.00) for the fire apparatus; and 21 WHEREAS, the City of Pacific Fire Department has 22 indicated that it will be utilizing the two (2)' surplused fire 23 apparatus described in Exhibit "A" for fire protection 24 purposes. 28 Resolution No. 2980 June 25, 1998 Page 1 1 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, 2 WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH 3 RESOLVES AS FOLLOWS: 4 Section 1. The City of Auburn is authorized pursuant to 5 Chapter 39.33 RCW to sell public property to any other 6 governmental body, including but not limited to other 7 municipalities. 8 Section 2. The Surplus Property Unit of the City of 9 Auburn public personal property in the form of two (2) fire ]O apparatus, described in Exhibit "A" to be converted to the 11 status of surplus property. 12 Section 3. The Mayor and City Clerk are hereby authorized to execute an Intergovernmental Agreement with the 14 15 City of Pacific for the Sale of Surplus Property. A copy of ]6 said Agreement is attached hereto as Exhibit "A". 17 Section 4. The City of Pacific Fire Department has 18 indicated a willingness to purchase the two (2) fire apparatus 19 surplused by the City of Auburn and described in Exhibit "A" 20 for the amount of Five Thousand Dollars and no cents 21 ($5,000.00) plus sales tax of 8.6% for a total of Five 22 Thousand Four Hundred Thirty Dollars and no cents ($5,430.00). 23 24 25 26 Resolution No. 2980 June 25, 1998 Page 2 1 Section 5. Reynolds, 21 City Attorney 22 23 24 25 Resolution No. 2980 June 25, 1998 Page 3 INTERGOVERNMENTAL AGREEMENT BETWEEN CITY OF AUBURN AND CITY OF PACIFIC FOR SALE OF SURPLUS PROPERTY THIS AGREEMENT is made and entered into this day of ~~- , 1998, by and between CITY OF PACIFIC, a municipal corporation, hereinafter referred to as "PACIFIC" and the CITY OF AUBURN, a municipal corporation organized under RCW 35A, Optional Municipal Code, hereinafter referred to as "AUBURN". WHEREAS, AUBURN is a municipal corporation having ownership of public personal property, among other things, in the form of two (2) fire apparatus described in Exhibit "1" attached hereto and incorporated herein by this reference; and WHEREAS, Chapter 39.33 RCW entitled INTERGOVERNMENTAL DISPOSITION OF PROPERTY provides for the sale of public property by any municipality to any other governmental body, including but not limited to other municipalities; and WHEREAS, AUBURN'S Surplus Property Unit is converting to surplus public personal property two (2) fire apparatus, described in Exhibit "1"; and Intergovernmental Agreement Resolution No. 2980 Exhibit "A" City of Pacific June 25, 1998 Page 1 [c/agree/ia-cop] WHEREAS, PACIFIC has indicated a willingness to purchase the two (2) surplus fire apparatus as described in Exhibit "1" for the amount of Five Thousand Dollars and no cents ($5,000.00) for both fire apparatus, plus 8.6% sales tax of $430.00 for a total of Five Thousand Four Hundred Thirty Dollars and no cents ($5,430.00); and WHEREAS, PACIFIC has indicated that it will be utilizing the surplused fire apparatus as part of Pacific Fire Department for fire protection purposes; and WHEREAS, AUBURN agrees to sell to PACIFIC, for the sum of Five Thousand Dollars and no cents ($5,000.00) plus 8.6% sales tax of $430.00 for a total of Five Thousand Four Hundred Thirty Dollars and no cents ($5,430.00) two (2) surplus fire apparatus as described in Exhibit "1"; and NOW THEREFORE, the parties agree as follows: 1. AUBURN shall surplus two (2) fire apparatus presently considered as public personal property of AUBURN; and 2. PACIFIC agrees to pay to AUBURN the sum of Five Thousand Dollars and no cents ($5,000.00) plus 8.6% sales tax of $430.00 for a total of Five Thousand Four Hundred Thirty Dollars and no cents ($5,430.00) for the two (2) fire apparatus surplused by AUBURN; and Intergovernmental Agreement Resolution No. 2980 Exhibit ~A" City of Pacific June 19, 1998 Page 2 [c/agree/ia-cop] 3. AUBURN agrees to deliver to PACIFIC two (2) fire apparatus upon payment of Five Thousand Dollars and no cents ($5,000.00) plus 8.6% sales tax of $430.00 for a total of Five Thousand Four Hundred Thirty Dollars and no cents ($5,430.00) and pursuant to the terms contained within this INTERGOVERNMENTAL AGREEMENT. 4. WARRANTY - GUARANTEE: AUBURN makes no warranty or guarantee as to condition of the two (2) fire apparatus at time of purchase. Purchase by PACIFIC of the two (2) surplus fire apparatus is on an "AS IS" basis. 5. SEVERABILITY: If any provision of this Agreement is determined to be invalid or unenforceable for any reason the remaining provisions shall remain in force and effect. CITY OF AUBURN CHARLES A.
