HomeMy WebLinkAbout30451 RESOLUTION NO. 3 0 4 5 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, 3 WASHINGTON, AUTHORIZING THE MAYOR AND CITY CLERK OF THE CITY OF AUBURN, TO EXECUTE AN AGREEMENT WITH KING COUNTY SEXUAL 4 ASSAULT RESOURCE CENTER TO PROVIDE COUNSELING SERVICES TO RAPE AND OTHER SEXUAL ASSAULT VICTIMS WITHIN THE AUBURN AREA DURING 5 1999. 6 THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, IN A 7 REGULAR MEETING DULY ASSEMBLED, HEREWITH RESOLVES THAT: 8 Section 1. The Mayor and City Clerk of the City of 9 10 Auburn, Washington, are authorized to execute an Agreement 11 with King County Sexual Assault Resource Center to provide 12 counseling services to rape and other sexual assault victims 13 within the City of Auburn during 1999. A copy of said 14 Agreement is attached hereto, is designated Exhibit "A" and ]5 incorporated by reference in this Resolution. 16 Section 2. Box 300, Renton, WA 98057, hereinafter referred to as 8 ~KCSARC", and is intended to cover the provision of services 9 by KCSARC to the CITY for the calendar year 1999. 10 WHEREAS, KCSARC provides counseling services to rape and 11 other sexual assault victims and their families as well as 12 consultation, liaison, and informational services to police 13 and other law enforcement agencies, and social service and 14 mental health providers, and informational services and 15 programs to community groups and individuals; and ]6 WHEREAS, KCSARC has provided the above services to the 17 CITY and its inhabitants in the past and is willing and able ]8 to continue to do so; and 19 WHEREAS, the CITY recognizes the nature and quality of 20 counseling, consultative and informational services provided 2! by KCSARC and the CITY's need for said services and is 22 therefore willing and interested in obtaining the same to 23 enhance its law enforcement functions and to benefit the 24 health, safety and welfare of its citizens; 25 26 Agreement - King County Sexual Assault Resource Center 1999 Exhibit "A" Resolution No. 3045 Dece~er 21, 1998 [a\kcsarc99] Page 1 NOW THEREFORE, in consideration of the mutual promises 1 and covenants herein contained to be kept, performed and 2 fulfilled by the respective parties hereto, and other valuable consideration, it is mutually agreed as follows: 4 5 6 1. SERVICES 1-A. Definition of Terms. As used in this agreement, the below designated terms shall be defined as follows: 8 9 a. Assistance and counseling includes providing immediate information to the rape or sexual assault ]0 11 victim and the victim's family regarding police 12 and/or medical procedures, the rape trauma syndrome 13 and possible reactions of important others; 14 providing a counselor or accompanying the victim ]5 through police and prosecutor interviews and 16 hospital examination; providing information about 17 the treatment of rape trauma syndrome and assisting 18 the victim and the victim's family in developing 19 family support and constructive responses to 20 employment, housing or school crisis precipitated by 21 the sexual assault. In the case of child victims in 22 South King County, professional counseling services 23 may be offered. 24 b. On-going supervision and training 3 are also provided to each trained volunteer through 4 staff consultation on each case. 5 c. Victim refers to a victim of rape, attempted rape, 6 indecent liberties, incest or other sexual assault. 7 1-B. KCSARC will maintain a twenty-four hour per day 8 crisis intervention telephone line which will be staffed by 9 trained volunteers and/or staff for the purpose of providing lO assistance and counseling to victims and their families within 11 the CITY and to provide immediate assistance to victims 12 referred by the CITY Police Department. Said telephone line 13 will accept collect calls from anyplace within the CITY ]4 boundaries and a 1-800 number is available. 15 1-C. KCSARC will advertise the toll-free crisis line ]6 telephone numbers and other services it offers to CITY 17 inhabitants through public service announcements in the local 18 news media as resources permit during the term of this ]9 contract. 20 1-D. KCSARC will provide informational services to groups 21 and individuals within the CITY in order to educate them about 22 the special problems which confront sexual assault victims. 23 The objectives of education programs shall be to increase the 24 number of people able to respond in a sympathetic and 25 knowledgeable manner to a sexual assault victim, to increase 26 Agreement - King County Sexual Assault Resource Center 1999 Exhibit "A" Resolution No. 3045 Dece~er 21, 1998 [a\kcsarc99] Page 3 1 the number of people able to provide accurate information 2 about police, medical and other social services to a sexual 3 assault victim and to increase the number of people who 4 understand the circumstances under which rape and other sexual 5 assaults may occur. 6 1-E. KCSARC will work with the victim, hospital medical 7 personnel and police to assist in obtaining the best possible 8 legal/medical evidence gathering. 9 1-F. KCSARC will consult and cooperate with the CITY ]0 Police Department and act, where necessary, as a liaison 11 between rape and sexual assault victims and the police in 12 order that victims understand the role of the police in the 13 apprehension and prosecution of persons who commit rape and/or 14 sexual assault. 15 1-G. Third party reports will be forwarded, with the 16 victim's consent, to the CITY Police Department for 17 informational and statistical purposes. A list of reports 18 given to the CITY Police Department shall be submitted by 19 KCSARC to the CITY on a quarterly basis during the term of 20 this Agreement. 21 1-H. Said services, and all duties incidental or 22 necessary thereto, shall be conducted and performed diligently 23 and competently and in accord with professional standards of 24 conduct and performance. 25 26 Agreement - King County Sexual Assault Resource Center 1999 Exhibit "A" Resolution No. 3045 Dece~er 21, 1998 [a\kcsarc99] Page 4 1 1-I. KCSARC is and shall be at all times during the term 2 of this agreement an independent contractor. 4 2. COMPENSATION 5 2-A. KCSARC shall be paid no more than THIRTY THOUSAND 6 ONE HUNDRED-SIXTY DOLLARS ($30,160.00) by the CITY for 7 completed services rendered under this Agreement. Such 8 payment shall be approved by the Mayor or his designee. 9 2-B. Such payment shall be compensatioh for services 10 performed by KCSARC including all reports, supporting data, 11 supervision, labor, supplies, materials, equipment or the use ]2 thereof and for all other necessary incidentals. 13 2-C. KCSARC will submit a statement to the CITY ]4 quarterly, describing services it has rendered under the terms 15 of this Agreement and the CITY will pay the amount approved by 16 the Mayor or his designee, subject to the limitation in 17 paragraph 2-A above, by the twenty-eighth day of the month ]8 following the end of the quarter. However, the final 19 statement of services rendered will be submitted on or before 20 December 15, 1999. 21 2-D. KCSARC agrees that those services for which it seeks 22 compensation under the terms of this Agreement shall be or 23 have been performed solely for residents of the CITY. 24 25 26 Agreement - King County Sexual Assault Resource Center 1999 Exhibit "A" Resolution No. 3045 Dece~er 21, 1998 [a\kcsarc99] Page 5 ] 3. STATUS REPORT 2 KCSARC shall develop and provide to the City within 60 3 days after the completion of the 1999 calendar year a status 4 report containing a program evaluation component commonly 5 referred to as the "Logic Model" which will show the intended 6 linkages between the activities conducted and the changes the ? activities will produce. 8 A. The components of the evaluation will: 9 1) Identify both process and outcome portions of the 10 Services funded by the City of Auburn; ]] 2) Show the relationship of program resources and 12 activities to the expected results or outcomes ]3 3) Help identify those questions the evaluation is to ]4 answer ]5 4) Provide a graphic summary of how program parts 16 relate to the whole 17 5) Make explicit the underlying theory of the program ]8 and 19 6) Identify measurable categories in the program 20 evaluation. 2] B. KCSARC shall develop the following status report 22 components within the time frames established below: 23 1) 2na Quarter 1999 Year 24 a) The outcome based results KCSARC expects to 25 achieve; 26 Agreement - King County Sexual Assault Resource Center 1999 Exhibit "A" Resolution No. 3045 Dece~er 21, 1998 [a\kcsarc99] Page 6 b) An indicator to inform KCSARC that the ] 2 anticipated change has or has not occurred; 3 c) The method for gathering information needed to 4 indicate the outcomes that have occurred; 2) 3ra Quarter 1999 Year 5 a) Initial Collection and assessment of the 7 information acquired to include: 8 alterations in the anticipated outcomes or 9 alteration in the methodology of information 10 gathering. ]] 3) 4th Quarter 1999 12 a) Information collected; 13 b) Conclusions developed as a result of the |4 information. 15 IV. GENERAL ADMINISTRATION AND MANAGEMENT ]6 A. The Mayor or his designee shall have 17 administrative responsibility for the CITY's performance under 18 this Agreement and shall review and may approve for payment 19 all statements and bills submitted by KCSARC to the CITY for 20 its performance under this Agreement. 2] B. The Executive Director of KCSARC shall be 22 responsible for overall administration of the provision of 23 services by KCSARC under the terms of this Agreement and for 24 coordination with the CITY. 25 26 Agreement - King County Sexual Assault Resource Center 1999 Exhibit "A" Resolution No. 3045 Dece~er 21, 1998 [a\kcsarc99] Page 7 1 V. TERMINATION OF AGREEMENT 2 A. Either party hereto may terminate or suspend 3 this Agreement at any time with or without cause, by giving 4 thirty days notice to the other party in writing. Termination 5 or suspension shall be effective ten days after receipt of 8 notice thereof by certified mail. In the event that the CITY 7 terminates or suspends this agreement, KCSARC shall be 8 entitled to receive just and equitable compensation for any 9 satisfactory services rendered prior to the effective date of 10 termination or suspension. ]1 ]2 VI. GENERAL PROVISIONS 13 A. KCSARC shall indemnify and hold the CITY, its ]4 officers and employees, elected or appointed, harmless from 15 and against any and all liability, loss, damages, claims, 16 suits, actions at law or otherwise, judgments and costs 17 (including, but not limited to, reasonable attorney's fees) ]8 that may arise from, grow out of or otherwise contribute to 19 any injury or death to any person or damage to any property, 20 caused by, resulting from or otherwise attributable to any 21 willful or negligent acts or omissions on the part of KCSARC, 22 its agents, employees or representatives, occurring in the 23 course of, arising from or otherwise attributable to the 24 performance of services and duties under this Agreement. 25 26 Agreement - King County Sexual Assault Resource Center 1999 Exhibit "A" Resolution No. 3045 Dece~er 21, 1998 [a\kcsarc99] Page 8 1 B. This Agreement may not be assigned or otherwise 2 transferred by the parties thereto. 3 C. No change, alteration, modification or addition 4 to this Agreement will be effective unless it is in writing 5 and properly signed by both parties thereto. 7 VII. INSURANCE 8 A. KCSARC shall maintain, during the term of this 9 Agreement, comprehensive general liability insurance to ]0 provide coverage for claims for injury or damage to persons or 11 property arising out of services provided by KCSARC, its ]2 agents and employees, under the term of this Agreement. The ]3 minimum liability limits for the comprehensive general 14 liability insurance shall be no less than ONE MILLION and 15 00/100 DOLLARS ($1,000,000) combined single limit per ]6 occurrence for bodily injury, personal injury and property 17 damage. KCSARC shall also provide and maintain during the 18 term of this Agreement, professional liability coverage 19 including errors and omissions in minimum liability limits of 20 ONE MILLION and 00/100 DOLLARS ($1,000,000) combined single 2] limit per occurrence for bodily injury, personal injury and 22 property damage. 23 B. KCSARC agrees to furnish the CITY with a 24 Certificate of Insurance evidencing the coverage required by 25 this Agreement.
