HomeMy WebLinkAbout3067 RESOLUTION NO. 3067 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE MAYOR TO EXECUTE A PURCHASE AND SALE AGREEMENT BETWEEN THE CITY OF AUBURN AND RON FORTE, PRESIDENT, OF FORTE, INC, IN THE AMOUNT OF $13,750.00 WHEREAS, this property is strategically located within the area proposed for the Auburn Way South entry to Les Gove Park and the new Auburn King County Library; WHEREAS the City of Auburn has identified that there is the need for additional property to provide a safe and aesthetically pleasing entry to the park and library facility; WHEREAS the City of Auburn has negotiated a fair purchase price in the Purchase and Sale Agreement, a copy of which is attached hereto as Exhibit A, and is incorporated by this reference; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH RESOLVES THAT: Section 1. The Mayor of the City of Auburn is herewith authorized to execute a Purchase and Sale Agreement between the City of Auburn and Forte, Inc. in the amount of $13,750.00. A copy of said Purchase and Sale Agreement is attached hereto as Exhibit A and incorporated herein by this reference. Resolution No. 3067 March 1, 1999 Page 1 of 2 Section 2. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. DATED AND SIGNED this 1 st day of March, 1999. Reynolds, City Attorney Resolution No. 3067 March 1, 1999 Page 2 of 2 PURCHASE AND SALE AGREEMENT In the matter of the King County Library Improvement project, Parcel No. 192105-9122. THIS AGREEMENT is made and entered into by and between the City of Auburn, a municipal corporation of the State of Washington, hereinafier referred to as the "City", and the undersigned owner, hereinafter referred to as the "Owner(s)": WITNESSETH WHEREAS, the City affirms and the Owner(s) agree(s) that the Owner's(s') real property described herein is required by the City for construction of a driveway for improved public access to the proposed King County Library. AND WHEREAS, the City has made a firm and continuing offer to pay the amount of thirteen thousand seven hundred fifty dollars and no cents ($13,750.00), for the purchase of the following described real property in Auburn, King County, Washington: That portion of Government Lot 5, Section 19, Township 21 North, Range 5 East, W.M., King County, Washington State, being a portion of that property described in Auditor's File Number 7905221109, more particularly described as follows: Commencing at the Southeast comer of said Government Lot 5; thence North 1 °07'34" East along the East line of Said Government Lot 5, based upon a Washington coordinate system of 1927, North zone meridian, a distance of 314.47 feet to the Northeasterly margin of Auburn Way South (Primary State Highway No. 5) sidewalk parcel, recorded in Auditor's File Number 7112090402 and the TRUE POINT OF BEGINNING; thence continuing along said East line of Government Lot 5, North 1 °07'34" East a distance of 58.97 feet; thence South 48°59'09'' West a distance of 40.58 feet to said Northeasterly margin; thence South 42°20'21" East along said Northeasterly margin a distance of 43.74 feet more or less to the true point of beginning. NOW THEREFORE, it is understood and agreed that: 1. The Owner(s) will convey the real property by good and sufficient Statutory Warranty Deed, free from all liens and encumbrances of every nature. 2. The City will issue a warrant in the amount of $13,750.00 as stated above, which will be deposited with Pacific Northwest Title Insurance Company. 3. The City will pay normal costs of closing, such as escrow services, title insurance, title reports and recording fees. Any outstanding liens, assessments, taxation encumbrances that may have to be removed to provide clear title to the City are to be satisfied in escrow by the Owner(s) out of the proceeds of the sale. Exhibit "A", Resolution No. 3067 4. The owner agrees to provide the necessary authorized signatures on the Lot Line Adjustment prepared by the City's contract professional land surveyor ( Inca Engineering Inc. ) on or before closing. The Lot Line Adjustment is a platting process to legally modify the boundaries of existing lots. Said lot line adjustment shall reflect the owners' real property conveyed to the City described herein. 5. Delivery of this Agreement is hereby tendered. HOWEVER, the terms and obligations hereof shall not become binding upon the City unless and until a resolution authorizing the acquisition is approved by the City Council. 6.
