WHEREAS, ' B' Street NW from 30th Street to 3 7th Street, PR 548, Contract 99-09, is a City Improvement project; and WHEREAS, the construction of this project will impact wetlands; and WHEREAS, as a permit condition by the U.S. Army Corps of Engineers, the City of Auburn is required to provide mitigation for impacted wetlands; and WHEREAS, the site chosen for this mitigation is the subject property as described in this resolution; and WHEREAS, the City of Auburn Sanitary Sewer Utility Enterprise Fund is the owner of the property described in Exhibit "A", attached hereto and by this reference made a part hereof, and as depicted by the aerial map as shown in Exhibit "B" attached hereto and by this reference made a part hereof; Resolution No. 3084 05/06/99 t( "1 !", . I 19998712888633 Page 1 PACt eea or cos i i.. 07/12/1999 10:14 CITY OF AUBURN HISC 13.00 KING COUNTY, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH RESOLVES THAT: Section 1. There is herewith granted for wetland construction, maintenance, and monitoring purposes from the Auburn Sanitary Sewer Utility to the City of Auburn an easement as legally described in Exhibit ~A". This easement shall be in effect for a period concurrent with the City's 'B' Street wetland construction, maintenance, and monitoring obligations. Upon expiration of these obligations, this Easement shall automatically, without further action by either party, expire. Section 2. Upon the passage and approval of this Resolution, the City of Auburn City Clerk is hereby authorized to record this Resolution with King County. Section 3. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directires of this legislation.
