A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AUTHORIZING THE MAYOR OF THE CITY OF AUBURN TO
TERMINATE THAT CERTAIN STREET IMPROVEMENT DELAY AGREEMENT
BETWEEN THE CITY OF AUBURN AND THE OWNERS OF LOTS A, B AND C OF
AUBURN SHORT PLAT 0007-93 DESCRIBED IN STREET DELAY AGREEMENT
RECORDED UNDER KING COUNT AUDITOR'S FILE NO. 9412210478.
WHEREAS, the owner requested permission to delay the placement of street
improvements while in the process of developing their property as described above; and
WHEREAS, the City of Auburn authorized the owner to defer the construction of
the required street improvements until a Local Improvement District (L.I.D)was initiated
by the City or other property owners adjacent to or benefiting the property; and
WHEREAS, City officials have vedfied that the required street improvements are
now in place and meet City street standards; and
WHEREAS, as a result of the completed street improvement requirements, the
aforesaid Street Improvement Delay Agreement is no longer required; and
WHEREAS, the City of Auburn confirms all the conditions have been met for
Street Improvement Delay Agreement as recorded under King County Auditor's File
No. 9412210478 and is hereby terminated. Exhibit "A" attached hereto and
incorporated herein sets forth location of the property described in said Street
Improvement Delay Agreement.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH
RESOLVED AS FOLLOWS:

Section I. The Mayor of the City of Auburn is hereby authorized to execute the
termination of the aforesaid Street Improvement Delay Agreement.
Section 2, The Mayor is hereby authorized to implement such administrative
procedures as may be necessary to carry out the directives of this legislation.

THE CITY OF AUBURN, a municipal corporation of the State of Washington, hereby
terminates the Street Improvement Delay Agreement given to the City of Auburn pursuant to
King County Recording Number 9412210478.
The owner(s) R.C. Miller and Janet L. Miller, their heirs, successors, and assigns are hereby
terminated from the Street Improvement Delay Agreement that allowed the owner to defer the
construction of required street improvements alon "V" Street SE in Auburn, Washington
currently addressed as 334 "V" Street SE, 2001 4~gStreet SE, andS011 4hh Street SE.
An executed copy of this Termination of Street Improvement Delay Agreement shall be recorded
among the land records of the King County Auditor.
