A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AUTHORIZING THE MAYOR OF THE CITY OF AUBURN TO
TERMINATE THAT CERTAIN SANITARY SEWER IMPROVEMENT DELAY
AGREEMENT BETWEEN THE CITY OF AUBURN AND THE OWNER OF LOT
1, CITY OF AUBURN SHORT PLAT NO. SP-4-80 DESCRIBED IN SEWER
DELAY AGREEMENT RECORDED UNDER KING COUNTY AUDITOR'S FILE
NO. 8012230777.
WHEREAS, the owner requested permission to delay the placement of
sanitary sewer while in the process of developing their property as described
above; and
WHEREAS, the City of Auburn authorized the owner to defer the
construction of the required sanitary sewer improvements until the existing
sanitary sewer on the West Valley Highway was extended to the north line of
their property or until a Local Improvement District (L.I.D) was initiated by the
City or other property owners adjacent to or benefiting the property; and
WHEREAS, City officials have verified that the required sanitary sewer
improvements are now in place and meet City standards; and
WHEREAS, as a result of the completed sanitary sewer improvement
requirements, the aforesaid Sanitary Sewer Improvement Delay Agreement is
no longer required; and
WHEREAS, the City of Auburn confirms all the conditions have been met
for the Sanitary Sewer Improvement Delay Agreement as recorded under King
County Auditor's File No. 8012230777 and is hereby terminated. Exhibit "A"

attached hereto and incorporated herein sets forth location of the property
described in said Sanitary Sewer Improvement Delay Agreement.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH
RESOLVES AS FOLLOWS:
Section 1. The Mayor of the City of Auburn is hereby authorized to
execute the termination of the aforesaid Sanitary Sewer Improvement Delay
Agreement.
Section 2. The Mayor is hereby authorized to implement such
administrative procedures as may be necessary to carry out the directives of
this legislation.
