HomeMy WebLinkAbout3207 RESOLUTION NO. 3 2 0 7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE EXECUTION OF STORMWATER DRAINAGE AGREEMENT BETWEEN THE CITY AND FISHER PROPERTIES, FOR A BASIN WIDE STORMWATER DETENTION FACILITY TO SERVICE FISHER INDUSTRIAL CENTER AND OTHER PROPERTIES IN THE BASIN. WHEREAS, the City desires to develop a Basin Wide Stormwater Detention Facility to serve FISHER INDUSTRIAL CENTER (hereinafter referred to as "FIC") and other properties in the basin; and WHEREAS, the City has constructed a pump station downstream of the 30th Street NW storm system which will discharge stormwater to the Green River and alleviate some of the flooding problems in the basin in which the Site is located; and WHEREAS, the City is constructing a Basin Wide Facility to serve the area, and WHEREAS, construction of the Basin Wide Facility Would eliminate the requirements for stormwater detention for FIC and allow portions of the Site that would otherwise have been devoted to stormwater detention to be developed for other uses; and WHEREAS, the Basin Wide Facility will not include stormwater quality treatment, and therefore, if the Basin Wide Facility is implemented, stormwater Resolution No. 3207 April 3, 2000 Page 1 quality treatment will be required in an independent system for the Site by FIC; and WHEREAS, the City has requested that FISHER PROPERTIES (hereinafter referred to as "Developer") participate financially in the Basin Wide Facility; and WHEREAS, the Developer plans to begin construction of the project in the first quarter of 2000 with completion scheduled for third quarter of 2000; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH RESOLVES AS FOLLOWS: Section 1. The City of Auburn is hereby authorized to execute a Stormwater Drainage Agreement with FISHER PROPERTIES for a Basin Wide Stormwater Detention Facility to service FISHER INDUSTRIAL CENTER and other properties in the basin. A copy of said Agreement is attached hereto as Exhibit "1" and incorporated herein by this reference. Section 2. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. Resolution No. 3207 April 3, 2000 Page 2
