HomeMy WebLinkAbout3212 RESOLUTION NO. 3 2 12 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, FIXING A TIME FOR A PUBLIC HEARING ON THE PETITION FOR VACATION OF PORTIONS OF 'B' STREET SW BETWEEN IsT AND 2ND STREETS SW, AND AN ALLEY CONNECTING 'A' STREET SW AND 'B' STREET SW BETWEEN 2ND AND 3RD STREETS SW. WHEREAS, Petition No. V-04-99 requesting the vacation of portions of 'B' Street SW between 1st and 2"d Streets SW, and an alley connecting 'A' Street SW and 'B' Street SW between 2"d and 3rd Streets SW, has been signed and filed with the City by the owners of more than two-thirds of the property abutting upon that portion of right-of-way sought to be vacated; and WHEREAS, RCW 35.79.010 requires the City Council to schedule a public hearing on a petition requesting the vacation of street right-of-way when the petition has been filed with the City and signed by the owners of more than two-thirds of the property abutting the proposed vacation; NOW, THEREFORE. IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AS FOLLOWS: Section i. Pursuant to RCW 35.79.010, the City Council acknowledges receipt of a petition to vacate portions of 'B' Street SW between 1st and 2nd Streets SW, and an alley connecting 'A' Street SW and 'B' Street SW between 2"d and 3rd Streets SW, which is attached hereto, designated Exhibit "1 ", and incorporated by reference herein. Resolution No. 3212 04/12/00 Page I Section 2. The legal description of the street right-of-way sought to be vacated is described on attached Exhibit "A", and incorporated by reference herein. Section 3. Pursuant to RCW 37.70.010, the City Council hereby schedules a public hearing on said petition to be held on the 5th day of June, 2000, at 7:30 p.m. in the Council Chambers of the Auburn City Hall before the City Council. All persons interested in said petition may attend that hearing. Section 4. Pursuant to RCW 35.79.020, upon passage of this Resolution, the City Clerk shall give twenty (20) days notice of the pendency of the petition by posting written notice in the manner required by the statute and as required by City Ordinance. Section 5. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation.
