A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AUTHORIZING THE IMPLEMENTATION AND USE OF A
COMMUNITY SERVICE PROGRAM ALTERNATIVE (a.k.a. OPPORTUNITY
UNDER TRANSITION or "OUT") AS AN ALTERNATIVE TO JAIL
CONFINEMENT AND PAYMENT OF FINES.
WHEREAS, the City of Auburn can provide some placements for
misdemeanor offenders to perform community service as may be ordered and
authorized by the Auburn Municipal Court as an altemative to jail confinement
and payment of fines; and
WHEREAS, the City of Auburn recognizes the need to aid the criminal
justice system by providing such placements and at the same time provide a
service to the community;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
KING COUNTY, WASHINGTON, IN A REGULAR MEETING DULY
ASSEMBLED, HEREWITH RESOLVES THAT:
Section 1. Pursuant to an order of the Auburn Municipal Court
authorizing a misdemeanor offender to perform community service, the City of
Auburn is hereby authorized to implement "Opportunity Under Transition" (a.k.a.
"OUT") Program for community service under the following safeguards and
guidelines.

A. Procedure:
After the issuance of an order by the Aubum Municipal Court authorizing
a misdemeanor offender to perform community service; an offender may apply
to the "OUT" program administered by the City of Auburn Personnel
Department. The City of Auburn Personnel Department will assess each
misdemeanor offender candidate's skills and limitations, as well as any physical
or other limitations that may necessitate accommodations for a candidate. As a
part of such assessment, the "OUT" misdemeanor offender candidates shall be
required to sign and acknowledge any kind of limitation and hold the City
harmless for any actions or claims which might result from his/her performance
in the City's "OUT" program.
B. Parameters Regarding Utilization of "OUT" Misdemeanor Offender
Candidates:
1. Absolute prohibition on the use of dangerous or heavy equipment
(e.g., mowers, backhoes, etc.);
2. Adequate instruction, and where necessary, training so that the
"OUT" candidate will be able to perform any assigned task properly and safely;
3. Adequate supervision for the task(s) involved;
4. ,Any protective equipment necessary to complete any task
assigned shall be provided;

5. Adequate records and documents to show compliance with the
above procedures; an
6. The Personnel Department--as part of its assessment
responsibility--will have the right to reject any "OUT" misdemeanor offender
candidate based upon a review of all the above parameters.
C. Insurance.
The City shall provide medical coverage through the State Labor and
Industries coverage for Volunteer workers. Any additional costs for providing
this coverage shall be borne by the "OUT" misdemeanor offender candidate.
Section 2. The Mayor is hereby authorized to implement such
administrative procedures as may be necessary to carry out the directives of
this legislation.
