HomeMy WebLinkAbout3240 RESOLUTION NO. 3 2 4 0 A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE MAYOR AND CITY CLERK, TO EXECUTE REQUIRED DOCUMENTS TO CREATE A COVENANT FOR AN AREA ENCOMPASSING A 58 FOOT RADIUS SURROUNDING WELL NO. 6 THAT RESTRICTS THE LAND USAGE IN THAT AREA FOR THE PURPOSE OF PROTECTING THE PUBLIC DRINKING WATER SOURCE. THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, IN A REGULAR MEETING, DULY ASSEMBLED, HEREBY RESOLVES THAT: WHEREAS, the City of Auburn owns property west of Fulmer Field, just north of the K Street NE and 5th Street NE intersection; and WHEREAS, the City of Auburn reconstructed Well No. 6 on said property; and WHEREAS, the Washington State Department of Health (DOH) requires a Covenant be recorded on the property where Well 6 is located to restrict usage of the land for an area surrounding Well No. 6 within a radius of 58 feet of Well 6 for the purpose of protecting the Public Drinking Water Source from contamination. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN HEREWITH RESOLVE: Section 1. The City of Auburn has constructed Well No. 6 on City owned property as described herein and more specifically described in Attachment "A" which is attached to Exhibit "1" and which is incorporated herein by this reference. The Mayor and City Clerk of the City of Auburn, Washington, are hereby authorized to sign the attached Declaration of Covenant to restrict usage of land within a 58-foot radius around the City owned Well No. 6. The restrictions are as described in the Declaration of Covenant, which is set forth as Exhibit 1 attached hereto and incorporated herein by this reference. Section 3. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. DATED AND SIGNED this ..~J~ day of September, 2000.
