HomeMy WebLinkAbout3266 RESOLUTION NO.3 2 6 6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE CREATION OF AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF AUBURN AND LEWIS COUNTY FIRE DISTRICT NO. 13 FOR THE PURPOSE OF SALE BY THE CITY OF AUBURN OF ONE (1) FIRE APPARATUS TO LEWIS COUNTY FIRE DISTRICT NO. 13 FOR FIRE PROTECTION PURPOSES. WHEREAS, Chapter 39.33 RCW entitled "Intergovernmental Disposition of Property" provides for the sale of public property by any municipality to any other governmental body, including but not limited to other municipalities; and WHEREAS, the City of Auburn is converting to surplus public personal property one (1) fire apparatus, described in Exhibit "1" attached hereto and incorporated herein by this reference; and WHEREAS, Lewis County Fire District No. 13 has indicated a willingness to purchase the one (1) fire apparatus as described in Exhibit "1" for the amount of One Thousand Seven Hundred fifty-one Dollars and no cents ($1,751.00) plus sales tax of 8.6% for a total of One Thousand Nine Hundred One Dollars and fifty-nine cents ($1,901.59) for the fire apparatus; and WHEREAS, Lewis County Fire District No. 13 has indicated that it will be utilizing the one (1) surplused fire apparatus described in Exhibit "1" for fire protection purposes. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH RESOLVES AS FOLLOWS: Resolution No. 3266 September 25,2000 Page 1 Section 1. The City of Auburn is authorized pursuant to Chapter 39.33 RCW to sell public property to any other governmental body, including but not limited to other municipalities. Section 2. The Surplus Property Unit of the City of Auburn public personal property in the form of one (1) fire apparatus, described in Exhibit "1" to be converted to the status of surplus property. Section 3. The Mayor and City Clerk are hereby authorized to execute an Intergovernmental Agreement with Lewis County Fire District No. 13 for the Sale of Surplus Property. A copy of said Agreement is attached hereto as Exhibit "A". Section 4. Lewis County Fire District No. 13 has indicated a willingness to purchase the one (1) fire apparatus surplused by the City of Auburn and described in Exhibit "1" for the amount of One Thousand Seven Hundred fifty- one Dollars and no cents ($1,751.00) plus sales tax of 8.6% for a total of One Thousand Nine Hundred One Dollars and fifty-nine cents ($1,901.59). Section 5. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. vJ. Reynolds, City Attorney Resolution No. 3266 September 25, 2000 Page 3 INTERGOVERNMENTAL AGREEMENT BETWEEN CITY OF AUBURN AND LEWIS COUNTY FIRE DISTRICT NO. 13 FOR SALE OF SURPLUS PROPERTY ( ~ THIS AGREEMENT is made and entered into this J- day of October, 2000, by and between LEWIS COUNTY FIRE DISTRICT NO. 13, a municipal corporation, hereinafter referred to as "DISTRICT" and the CITY OF AUBURN, a municipal corporation organized under RCW 35A, Optional Municipal Code, hereinafter referred to as "AUBURN". WHEREAS, AUBURN is a municipal corporation having ownership of public personal property, among other things, in the form of one (1) fire apparatus described in Exhibit "1" attached hereto and incorporated herein by this reference; and WHEREAS, Chapter 39.33 RCWentitled INTERGOVERNMENTAL DISPOSITION OF PROPERTY provides for the sale of public property by any municipality to any other governmental body, including but not limited to other municipalities; and WHEREAS, AUBURN'S Surplus Property Unit is converting to surplus public personal property one (1) fire apparatus, described in Exhibit "1"; and WHEREAS, DISTRICT has indicated a willingness to purchase the one (1) surplus fire apparatus as described in Exhibit "1" for the amount of One Thousand Seven Hundred fifty-one Dollars and no cents ($1,751.00) for the fire apparatus, plus 8.6% sales tax of $150.59 for a total of One Thousand Nine Hundred One Dollars and fifty-nine cents ($1,901.59); and Intergovernmental Agreement Resolution No. 3266 Exhibit "A" Page 1 WHEREAS, DISTRICT has indicated that it will be utilizing the surplused fire apparatus for fire protection purposes; and WHEREAS, AUBURN agrees to sell to DISTRICT, for the sum of One Thousand Seven Hundred fifty-one Dollars and no cents ($1,751.00), plus 8.6% sales tax of $150.59 for a total of One Thousand Nine Hundred One Dollars and fifty-nine cents ($1,901.59) for one (1) surplus fire apparatus as described in Exhibit "1". NOW THEREFORE, the parties agree as follows: 1. AUBURN shall surplus one (1) apparatus presently considered as public personal property of AUBURN; and 2. DISTRICT agrees to pay to AUBURN the sum of One Thousand Seven Hundred fifty-one Dollars and no cents ($1,751.00), plus 8.6% sales tax of $150.59 for a total of One Thousand Nine Hundred One Dollars and fifty-nine cents ($1,901.59) for one (1) surplus fire apparatus surplused by AUBURN; and 3. AUBURN agrees to deliver to DISTRICT one (1) fire apparatus upon payment of One Thousand Seven Hundred fifty-one Dollars and no cents ($1,751.00), pius 8.6% sales tax of $150.59 for a total of One Thousand Nine Hundred One Dollars and fifty-nine cents ($1,901.59) and pursuant to the terms contained within this INTERGOVERNMENTAL AGREEMENT. Intergovernmental Agreement Resolution No. 3266 Exhibit "A" Page 2 4. WARRANTY - GUARANTEE: AUBU RN makes no warranty or guarantee as to condition of the one (1) fire apparatus at time of purchase. Purchase by DISTRICT of the one (1) surplus fire apparatus is on an "AS IS" basis. 5. SEVERABILITY: If any provision of this Agreement is determined to be invalid or unenforceable for any reason the remaining provisions shall remain in force and effect.
