A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, APPROVING THE PRELIMINARY PLAT OF A NINE LOT
SINGLE FAMILY SUBDIVISION LOCATED ON THE SOUTH SIDE OF 31(~TM
PLACE SE BETWEEN 112TM AVENUE SE AND 114TM AVENUE SE, WITHIN
THE CITY OF AUBURN, WASHINGTON.
WHEREAS, Application No. PLT00-0010, dated September 28, 2000,
has been submitted to the City of Auburn, Washington, by WAYNE DAWSON,
requesting approval of a Preliminary Plat for nine lot single-family lot
subdivision located at SE 316th between 112th Avenue SE and 114th Avenue SE
within the City of Auburn; and
~WHEREAS, said request above referred to was referred to the Hearing
Examiner for study and public hearing thereon; and
WHEREAS, pursuant to staff review, the Hearing Examiner conducted a
public hearing to consider said petition in the Council Chambers of the Auburn
City Hall on February 22, 2001, at the conclusion of which the Hearing
Examiner recommended approval of the Preliminary Plat; and
WHEREAS, the City Council, on March 19, 2001 considered said
request and affirmed the Hearing Examiner's recommendation for rezone
based upon the following Findings of Fact and Conclusions, to-wit:
FINDINGS OF FACT
1. Wayne Dawson has applied for preliminary plat approval of a 9 lot single

family subdivision. The property is located on the south side of 316 Place
SE between 112t~ Avenue and 114~ Avenue. The property contains one

house and accessory buildings that will remain. The remainder of the 2.02-
acre site is vacant pasture.
2. The property is located within a recently annexed area of Lea Hill. The
parcel is zoned LHR2 which is a single-family zone that requires a
minimum lot size of 6,000 square feet. Each lot meets or in most cases
exceeds the requirements of the zoning code standards.
3. The property is bordered on three sides by public streets. 112t~ abuts the
property on the west. 112th is currently not constructed to City standards.
Additional paving and sidewalks will need to be provided. 316th Place
abuts the property to the north. The street meets City standards with the
exception of sidewalks, streetlights, and street trees. 114th abuts the
property to the east. Additional right of way is required to be dedicated as
well as additional paving, sidewalks, street trees and street lights.
4. All public utilities including sanitary sewer, water and storm drainage are
adequately being provided for as determined by the Auburn Public Works
Department.
5. The contents of the case file, #PLT00-0010, and the environmental file,
#SEP00-0048, of this project are hereby incorporated by reference and
made part of the record of this hearing.
CONCLUSIONS OF LAW
The undersigned has concluded that the preliminary plat may be approved, if
properly conditioned, in that it is consistent with the following criteria necessary
to approve a preliminary plat as outlined in Section 17.06.070 of the Land
Division Ordinance.
1. Adequate provisions are made for the public health, safety and general
welfare and for open spaces, drainage ways, streets, alleys, other public
ways, water supplies, sanitary wastes, parks, playgrounds and sites for
schools and school grounds.
All public streets and utilities are adequately being provided. The number of
lots is too small to require dedication of park property and any impacts to
schools are mitigated by the payment of mitigation fees to the Auburn
School District.
2. Conformance of the proposed subdivision to the general purposes of the
Comprehensive Plan.

The Comprehensive Plan illustrates the subdivision to be appropriate for
single family uses. Therefor this single-family subdivision is consistent with
the Comprehensive Plan.
3. Conformance of the proposed subdivision to the general purposes of any
other applicable policies or plans which have been adopted by the City
Council.
The subdivision has been designed to be consistent with all applicable
policies and plans of the City.
4. Conformance of the proposed subdivision to the general purposes of the
Land Division Ordinance as enumerated in Section 17.02.030.
The subdivision is consistent with the general purposes of the Land Division
Ordinance in that it promotes the effective uses of land, provides for
convenient travel, adequately provides for public services, and is consistent
with the Comprehensive Plan.
5. Conformance of the proposed subdivision to the Auburn Zoning Ordinance
and any other applicable planning or engineering standards and
specifications as adopted by the City.
The proposal meets or is capable of meeting all requirements of he zoning
ordinance and engineering standards of the City.
6. The potential environmental impacts of the proposed subdivision are
mitigated such that the preliminary plat will not have an unacceptable
adverse effect upon the quality of the environment.
The environmental review of the project has been completed which resulted
in the issuance of a Mitigated Determination of Non-significance with
mitigating conditions that address construction activity, storm drainage, and
trees.
DECISION
For each of the above reasons, the recommendation of the Hearing Examiner
to the Auburn City Council on this preliminary plat application is approval,
subject to the following conditions:

1. The abutting streets of the plat shall meet the current street construction
standards of the City. This will include dedication of additional right of way
including curve radius at the intersections together with providing additional
paving, sidewalks, street trees, and street lights as determined by the City
Engineer in order to comply with the applicable City requirements.
2. No excavation for utility or home construction shall occur within 10 feet of
the south property line of the plat, except for lot 9, then five 5 feet shall
apply.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH
RESOLVES THAT:
Section 1. The above cited Hearing Examiner's, Conclusions and
Decision are herewith approved and incorporated in this Resolution.
Section 2. The Preliminary Plat for a nine lot single-family lot
subdivision located at SE 316th between 112th and 114th, within the City of
Auburn, legally described in Exhibit "A" attached hereto and incorporated herein
by this reference, is hereby approved subject to the following conditions:
1. The abutting streets of the plat shall meet the current street construction
standards of the City. This will include dedication of additional right of way
including curve radius at the intersections together with providing additional
paving, sidewalks, street trees, and street lights as determined by the City
Engineer in order to comply with the applicable City requirements.

Section 3. The Mayor is hereby authorized to implement such
administrative procedures as may be necessary to carry out the directives of
this legislation.
