HomeMy WebLinkAbout3350 RESOLUTION NO. 3350 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, PROVIDING NOTICE OF THE CITY'S INTENT TO TERMINATE THE AGREEMENT APPROVED BY RESOLUTION 3159 ON FEBRUARY 22, 2000 BETWEEN THE CITY OF AUBURN AND KING COUNTY FIRE PROTECTION DISTRICT ¢N4 FOR FIRE AND LIFE SAFETY SERVICES TO THE ANNEXED AREA OF LEA HILL WITHIN THE CORPORATE LIMITS OF THE CITY PURSUANT TO SECTION 7 THEREOF AND EFFECTIVE 11:59 p.m. NOVEMBER 30, 2001. WHEREAS, the City of Auburn's Comprehensive Plan calls for the annexation of identified Potential Annexation Areas, into the City, in accordance with the State Growth Management Act and King County Planning Policies, and WHEREAS, the City has identified Lea Hill as being one of the Potential Annexation Areas, and WHEREAS, the City began the process of annexing Lea Hill with the Southwest Lea Hill annexation, completed March 1,2000, and WHEREAS, the City decided to enter into a temporary agreement with Fire District 44 to provide fire and life safety service in the annexed areas until such time as the City determined it to be .in the interest of its residents to assume such responsibilities, and WHEREAS, the City and Fire District 44 entered into an Agreement for Fire and Life Safety Services as approved by the City Council in Resolution No. 3159 on February 22. 2000, and Resolution No. 3350 April 27, 2001 Page 1 WHEREAS, Section 7 of said agreement provides for the termination of the agreement upon six (6) months written notice of termination by either party. (A copy of said agreement is attached hereto for your information as Exhibit "A" and is incorporated herein by reference); and WHEREAS, the Auburn City Council has determined that the City of Auburn is in a position to provide high quality, cost-effective fire protection and life safety services by the Auburn Fire Department, NOW, THEREFORE, it is the direction of the Auburn City Council that the requires six (6) month written notice of termination be sent to Fire District 44 indicating termination of the "Agreement for Fire and Life Safety Services", approved by the Council on February 22, 2000 is terminated effective 11:59 p.m. November 30, 2001 at which time the Auburn Fire Department will serve the area. Further, it is directed that City staff negotiate with the District to satisfy the transfer of assets under RCW 35.02. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH RESOLVES: Section 1. The Mayor and 'City Clerk of the City of_Auburn are herewith authorized as set forth in Section 7 of the "Agreement for Fire and Life Safety Services", approved by Resolution 3159 on February 22, 2001 to provide the Resolution No. 3350 April 27, 2001 Page 2 required six (6) month written notice of termination to Fire District 44; and, that upon the effective date of November 30, 2001 at 11:59 p.m., the Auburn Fire Department will serve the area, and that City staff are authorized to negotiate with the District to satisfy the transfer of assets under RCW 35.02. Section2. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation.
