HomeMy WebLinkAbout3399RESOLUTION NO. 3399 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING RESOLUTION NO. 3286 AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AMENDMENT NO. 1 TO THE PUBLIC DEFENSE SERVICES CONTRACT BETWEEN THE CITY AND TUTTLE MCCRUMB PLLC; TO PROVIDE FOR A REVISION IN THE COMPENSATION PROVISIONS OF THE CONTRACT. WHEREAS, on November 20, 2000, the City Council adopted Resolution No. 3286 authorizing a new contract between the City of Auburn and the public defender, Tuttle-McCrumb PLLC, to provide for public defense services from January 1,2000 to December 31,2002; and WHEREAS, due to the increased number of hearings and additional appearance requirements caseload, an increase in the "flat fee" based contract is recommended effective January 1,2002. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH RESOLVES: Section 1. The City Council hereby authorizes the Mayor and City Clerk to execute Amendment No. 1 to the Public Defense Services Contract between the City and Tuttle-McCrumb PLLC, which amends Article IV, Compensation, of the contract authorized by Resolution No. 3286. A copy of Amendment No. 1 is attached hereto, denominated as Exhibit "A" and made a part hereof as though set forth in full herein. Section2. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislations. Reynolds City Attorney Resolution 3399 November 26, 2001 Page 2 AMENDMENT NO. 1 TO PUBLIC DEFENSE SERVICES CONTRACT CITY OF AUBURN, WASHINGTON JANUARY 1,2000 - DECEMBER 31,2002 The purpose of this amendment is to modify the compensation provision of the Public Defense Services Contract as provided below effective January 1,2002: IV COMPENSATION Compensation for public defense services for the year 2000 shall be One Hundred Forty-four Thousand Dollars ($144,000.00) for the entire year, paid in monthly installments of Twelve Thousand Dollars ($12,000.00). Reconciliation will be made from January 1, 2000 to the effective date of this agreement to adjust the differences between this agreement and amounts previously paid under the original contract. For the years 2001,~,'~"'~,... ~ .. .. ... ,° rm ° a flat rate of One Hundred Forty-four Thousand Dollars ($144,000.00) as provided above will be paid. Compensation for public defense services for the year 2002 shall be One Hundred Fifty-Nine Thousand Six Hundred Dollars ($159,600.00) for the entire year, paid in monthly installments of Thirteen Thousand Three Hundred Dollars ($13,300.00). Pursuant to regular City policy regarding payment for services rendered, the CITY shall make payment to the PUBLIC DEFENDER on the first day following the first City Council meeting following the timely submittal by the PUBLIC DEFENDER of a report pursuant to Section I (C) (2) herein for the preceding month.
