Home My WebLink About3498a AMENDED RESOLUTION NO. 3 4 9 8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, REQUESTING THAT THE ANNEXATION OF AN UNINCORPORATED AREA CONTIGUOUS TO THE CORPORATE LIMITS OF THE CITY BE PLACED BEFORE THE VOTERS OF THE PROPOSED ANNEXATION AREA NORTH OF 1sT STREET NE AND AT THE GREEN RIVER KNOWN AS THE "STEELHEAD NORTH DISTRICT" WHEREAS, the City of Auburn has received requests that certain areas of unincorporated territory contiguous to the corporate limits of the City, which unincorporated territory is identified for reference as North of 1st Street NE and at the Green River known as the "STEELHEAD NORTH DISTRICT" Annexation area; and, WHEREAS, the City is authorized to initiate annexations via election pursuant to RCW 35A.14.015; and, WHEREAS, when the Auburn City Council determines that the best interests and general welfare of the City would be served by the annexation of the unincorporated territory contiguous to such city, it would thusly be appropriate to call for an election to be held to submit to the voters of such territory the proposal for annexation. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, HEREBY RESOLVES as follows: Section 1. That the Auburn City Council has determined that the best interests and general welfare of the City would be served by the annexation of the unincorporated territory contiguous to such city, and that it is appropriate to call for an election to be held to submit to the voters of such territory the proposal for annexation. Section 2. That the description of the boundaries of the area to be annexed, hereinafter identified as the "STEELHEAD NORTH DISTRICT" annexation area, is as Resolution No. 3498 August 14, 2002 Page 1 follows: THAT PORTION OF GOVERNMENT LOTS 3, 4 AND 5 IN THE NORTHWEST QUARTER OF SECTION 17, TOWNSHIP 21 NORTH, RANGE 5 EAST, W. M. DESCRIBED AS FOLLOWS: BEGINNING AT A POINT 30 FEET SOUTH OF THE SW CORNER OF GOVERNMENT LOT 4 IN SAID SECTION 17; THENCE NORTH ALONG THE WEST LINE OF SAID E1/2 OF SAID GOVERNMENT LOT 4, A DISTANCE OF 835.15 FEET TO THE NORTHWEST CORNER OF THAT PORTION OF LAND ANNEXED TO THE CITY OF AUBURN BY CITY OF AUBURN ORDINANCE 1543 AND THE TRUE POINT OF BEGINNING; THENCE ALONG THE NORTHERLY BOUNDARY OF THE LANDS DESCRIBED IN CITY OF AUBURN ANNEXATION ORDINANCE 1543 NORTH 83o48'49'' EAST 172.20 FEET MEASURED AT RIGHT ANGLES TO SAID WEST LINE OF THE E1/2 OF SAID GOVERNMENT LOT 4; THENCE SOUTH PARALLEL WITH THE WEST LINE OF SAID E1/2 OF SAID GOVERNMENT LOT 4 AND ALONG SAID NORTHERLY BOUNDARY TO THE NORTH MARGINAL LINE OF 1sT STREET NE (SE 326TM STREET); THENCE EASTALONG SAID NORTH MARGINAL LINE OF 1sT STREET NE AND ALONG SAID NORTHERLY BOUNDARY OF THE LANDS DESCRIBED IN CITY OF AUBURN ANNEXATION ORDINANCE 1543 A DISTANCE OF 195 FEET MORE OR LESS, TO AN ANGLE POINT IN SAID NORTHERLY BOUNDARY DESCRIBED IN SAID ORDINANCE 1543 AS THE EXTENDED EAST LINE OF 103RD AVENUE SE (U STREET NE) AND NOW KNOWN AS THE WEST LINE OF THE H. T. HUGHES ADDITION PLAT AS RECORDED IN VOLUME 72, PAGE 21 OF PLATS IN KING COUNTY, WASHINGTON; THENCE SOUTH ON THE WEST LINE OF SAID PLAT AND ALONG SAID NORTHERLY BOUNDARY OF THE LANDS DESCRIBED IN CITY OF AUBURN ANNEXATION ORDINANCE 1543 A DISTANCE OF 40 FEET TO AN ANGLE POINT IN THE NORTHERLY BOUNDARY OF THE LANDS DESCRIBED IN CITY OF AUBURN ANNEXATION ORDINANCE 1543; THENCE NORTH 89°30'15'' EAST ALONG THE NORTHERLY BOUNDARY OF THE LANDS DESCRIBED IN CITY OF AUBURN ANNEXATION ORDINANCE 1543 TO THE WEST BANK OF THE GREEN RIVER; THENCE NORTHWESTERLYALONG SAID WEST BANK OF THE GREEN RIVER TO THE MOST EASTERLY CORNER OF LOT 1 OF KING COUNTY SHORT PLAT KCSP383002 RECORDED UNDER RECORDING NUMBER 8404090865 AND THE SOUTHERLY BOUNDARY Of THAT PORTION OF LAN D ANNEXED TO THE CITY OF AUBURN BY CITY OF AUBURN ORDINANCE 4317; THENCE WEST ALONG THE SOUTH LINE OF SAID LOT 1 AND SAID SOUTHERLY BOUNDARY OF THE LANDS DESCRIBED IN CITY OF AUBURN ANNEXATION ORDINANCE 4317 A DISTANCE OF 246.12 FEET MORE OR LESS TO THE WESTERNMOST EAST LINE OF SAID LOT 1; THENCE SOUTH ALONG SAID EASTERLY BOUNDARY OF THE LANDS DESCRIBED IN CITY OF AUBURN ANNEXATION ORDINANCE 4317 AND SAID WESTERNMOST EAST LINE EXTENDED SOUTHERLYA DISTANCE OF 169.0 FEET TO A POINT ON THE SOUTH MARGINAL LINE OF 4TM STREET NE (SE 324TM STREET); THENCE WESTERLY ALONG SAID SOUTH MARGINAL LINE AND SAID SOUTHERLY BOUNDARY OF THE LANDS DESCRIBED IN CITY OF AUBURN ANNEXATION ORDINANCE 4317 A DISTANCE OF 42 FEET MORE OR LESS TO A LINE PARALLEL WITH AND 134 FEET EAST OF THE EAST BOUNDARY OF MARTHA HEISSERMAN'S ADDITION AS RECORDED IN VOLUME 57, PAGES 13 AND 14, RECORDS OF KING COUNTY, WASHINGTON; THENCE SOUTHERLY ALONG SAID PARALLEL LINE AND ALONG SAID EASTERLY BOUNDARY OF THE LANDS DESCRIBED IN CITY OF AUBURN ANNEXATION ORDINANCE 4317 A DISTANCE OF 166.5 FEET TO AN ANGLE POINT IN SAID SOUTHERLY BOUNDARY OF THE LANDS DESCRIBED IN CITY OF AUBURN ANNEXATION ORDINANCE 4317; THENCE WESTERLY PARALLEL WITH THE NORTH BOUNDARY OF GOVERNMENT LOT 4 OF SAID SECTION 17 AND ALONG THE SOUTHERLY BOUNDARY OF THE LANDS DESCRIBED IN CITY OF AUBURN Resolution No. 3498 August 14, 2002 Page 2 ANNEXATION ORDINANCE 4317 A DISTANCE OF 134.00 FEET TO SAID EAST BOUNDARY OF HEISSERMAN'S ADDITION AND THE EAST BOUNDARY OF THE LANDS DESCRIBED IN CITY OF AUBURN ANNEXATION ORDINANCE 1122; THENCE SOUTH ALONG SAID EAST BOUNDARY OF HEISSERMAN'S ADDITION AND THE EAST BOUNDARY OF THE LANDS DESCRIBED IN CITY OF AUBURN ANNEXATION ORDINANCE 1122 A DISTANCE OF 330 FEET MORE OR LESS TO THE TRUE POINT OF BEGINNING. SITUATE IN KING COUNTY, WASHINGTON. Section 3. That the number of voters residing therein as nearly as may be determined is Thirty-six (36). Section 4. That the City shall pay the cost of the annexation election. Section 5. That upon annexation, the territory so annexed shall be subject to proposed zoning regulation for the area to be annexed as R-2, Single Family Residential District. Section 6. That, in light of the small size of the annexation area (approximately 14 acres), pursuant to RCW 35A.14.220, it is requested that the King County Boundary Review Board waive or decline review. Section 7. That a certified copy of the resolution shall be filed with the legislative authority for King County, and with the King County Boundary Review Board. Section 8. That the Mayor is authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation, including providing notices pursuant to RCW 35A.14.070, and filing a Notice of Intent to Annex to the King County Boundary Review Board, and communicate the City's request that the King County Boundary Review Board waive or decline review. The Mayor, or designee, is further authorized to take such other steps as is reasonably necessary to have the annexation placed on the ballot before the appropriate voters for the November 5, 2002 election. That this Resolution replaces and supercedes the Resolution of the same number adopted on July 1, 2002, and shall take effect and be in full force upon passage and signatures hereon.
