HomeMy WebLinkAbout3531RESOLUTION NO. 3 5 3 '1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN INTERLOCAL AGREEMENT WITH KING COUNTY FOR THE REIMBURSEMENTS OF AUBURN FUNDS COMMISSIONED TO ESTABLISH A SANITARY SEWER REPORT, AND TO AGREE TO ESTABLISH AN AUBURN CONSTRUCTION PERMIT WITHIN THE 277TM STREET RIGHT OF WAY FOR THE 277TM STREET TRUNK SEWER. WHEREAS, pursuant to RCW 35A.11.040, Auburn has the legal authority to exercise its powers and perform any of its functions as set forth in RCW 39.34; and WHEREAS, pursuant to RCW 39.34, the Interlocal Cooperation Act, Auburn has the legal authority to cooperate with other localities on the basis of mutual advantage and provision of services. NOW, THEREFORE, THE COUNCIL OF THE CITY OF AUBURN, WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH RESOLVES THAT: Section 1. The Mayor and City Clerk of the City of Auburn are herewith authorized to execute an Interlocal Agreement establishing reimbursement to Auburn for expenditures on the City of Auburn South 277th Street Interceptor Preliminary Design Report, together with granting the County the right to utilize the report data, and an agreement to issue a construction permit and operating Resolution No. 3531 September 13, 2002 Page 1 rights for a sewer line along South 277th Street to the County. A copy of said agreement is attached hereto, denominated as Exhibit "1" and made a part hereof as though set forth in full herein. Section 2. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. DATED this ~'"¢~ day of October, 2002. Assessor's Property Tax Parcel/Account Number N/A [] Assessor Tax # not yet assigned E~',"~ TAX NOT REQUIRED King~nty ,Records Division SOUTH 277TM STREET TRUNK SEWER AGREEMENT BETWEEN THE CITY OF AUBURN AND KING COUNTY THIS AGREEMENT, made as of this /ff ~ day of ~(2,'~-~-~ , 2002, between the City of Auburn, a municipal corporation of the State of Washington (hereinafter referred to as "Auburn") and King County, a political subdivision of the State of Washington (hereinafter referred to as "the County"); WITNESSETH: WHEREAS, Auburn and the County (as successor to the Municipality of Metropolitan Seattle) are parties to a long term agreement for sewage disposal dated March 1 ~t, 1974, as amended; and WHEREAS, Auburn, in accordance with said Agreement, requested that the county construct the Mill Creek Relief Sewer/South 277th Street Interceptor and then participated with the County in the Mill Creek Relief Sewer Planning Study; and WHEREAS, Auburn entered into an engineering contract with CTE Engineers to produce the City of Auburn South 277th Street Interceptor Preliminary Design Report dated April, 1997, which evaluated several potential trunk sewer alignments for a portion of the Mill Creek Relief Sewer project; and WHEREAS, the County utilized the data from said report during the development of a Preliminary Alignment Study for the S277th Street Trunk - Phase 3, dated December 1998; and ~ibi~ 1 Resolution No. 3531 WHEREAS, Auburn has facilitated the construction of a portions of the S277th Street Trunk Sewer in conjunction with an arterial roadway project along South 277th Street called the S277th Street Improvement Project; NOW, THEREFORE, IT IS HEREBY AGREED AS FOLLOWS: Section 1. South 277th Street Interceptor Preliminary Design Report Data. Auburn grants the County the right to utilize the report data and grants permission to contact the design team for verification of information. Section 2. Permits. Auburn agrees to issue the County a construction permit and operating rights as defined in the sewage disposal agreement within the South 277th Street Right-of-Way for the South 277th Street Trunk Sewer. Section 3. Reimbursement. The County shall reimburse Auburn for $102,857.30, which is the amount that Auburn paid to the consultant CTE Engineers to produce the City of Auburn South 277th Street Interceptor Preliminary Design Report.
