HomeMy WebLinkAbout3566 RESOLUTION NO. 3 5 6 6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE MAYOR TO EXECUTE A CERTIFICATION ACCEPTANCE QUALIFICATION AGREEMENT WITH THE WASHINGTON STATE DEPARTMENT OF TRANSPORTATION TO PROVIDE THE CITY THE AUTHORITY TO CONTINUE HANDLING FEDERAL AID FUNDS ON CAPITAL PROJECTS WHEREAS, Resolution No. 952, dated February 20, 1979, authorized the Mayor to execute a Certification Acceptance Agreement with the Washington State Department of Transportation; and WHEREAS, in June of 1995 the City administratively amended the Certification Acceptance Qualification Agreement to reflect the City's administrative procedures and authorities to be consistent with the State's updated Agreement form; and WHEREAS, the Washington State Department of Transportation has requested that the City update this agreement to reflect current administrative authorities within the City; and WHEREAS, this agreement is required before the City can accept and manage federal-aid funding on projects. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, HEREBY RESOLVES as follows: Resolution No. 3566 January 22,2003 Page 1 Section '1. The Mayor is hereby authorized to execute a Certification Acceptance Agreement with the Washington State Department of Transportation, in the form substantially as the agreement attached hereto, marked as Exhibit "A" and incorporated herein by this reference Section 2. (FHWA) projects under Full CA status. Adherence to the Local Agency Guidelines and all policies and procedures promulgated by the Washington State Department of Transportation (WSDOT) which accomplish the policies and objectives set forth in Title 23, U.S. Code, Highways, and the regulations issued pursuant thereto. 2. The overall approval authorities and conditions will be as follows: The project prospectus will be reviewed and approved by the following official. Mayor Position Title Only The local agency agreement will be reviewed and approved by the following official or officials. Mayor Position Title Only The designs and environmental documents will be reviewed and approved by the following state of Washington registered Professional Civil Engineer. City Engineer Position Title Only The hearing's findings (if required) will be reviewed and approved by the following official or officials. Public Works Director Position Title or Titles Only The contract plans, specifications and estimate of cost will be reviewed and approved by the following state of Washington registered Professional Engineer. Mayor Position Title Only All projects will be constructed in conformance with the Washington State Department of Transportation/American Public Works Association (WSDOT/APWA) current Standard Specifications for Road, Bridge, and Municipal Construction and such specifications that modify these specifications as appropriate. Multimodal enhancement projects shall be constructed in conformance with applicable state and local codes. Local Agency Guidelines I of 2 September 2002 Certification Acceptance Qualification Agreement The contract administration will be supervised by the following state of Washington registered Professional Civil Engineer. Assistant City Engineer Position Title Only j. Construction administration and material sampling and testing will be accomplished in accordance with the WSDOT Construction Manual and the Local Agency Guidelines. The agency agrees that they have the means to provide adequate expertise and will have support staff available to perform the functions being subdelegated. The support staff may include consultant or state services. The agency agrees that the signature on each project prospectus and local agency agreement will be consistent with section 2 above. All projects under Certification Acceptance shall be available for review by the FHWA and the state at any time and all project documents shall be retained and available for inspection during the plan development and construction stages and for a three year period following acceptance of the project by WSDOT. Approval of the local agency certification by the Assistant Secretary for Highways and Local Programs may be rescinded at any time upon local agency request or if, in the opinion of the Assistant Secretary for Highways and Local Programs, it is necessary to do so. The rescission may be applied to all or part of the programs or projects approved in the local agency certification. Mayor or Chairman Peter B.
