A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AUTHORIZING THE MAYOR OR HIS DESIGNEE TO
EXECUTE A WAIVER OF HEARING WITH THE WASHINGTON STATE
DEPARTMENT OF TRANSPORTATION RELATED TO SR 167
LIMITED ACCESS REVISIONS
WHEREAS, the Washington State Department of Transportation
0NSDOT) has tentatively approved a Plan for the revision to the existing limited
access facility on SR 167 in the South 277th Street vicinity for the King County
South 277th street improvements; and
and
WHEREAS, this section of SR 167 is located within the City of Auburn;
WHEREAS, the Plan will be approved by securing waivers of hearing as
required by the provisions of RCW 47.52.134 and will transfer City of Auburn
Rights of Way back to the WSDOT; and
WHEREAS, a new turnback agreement will be necessary to maintain the
current jurisdictional limits of South 277th Street; and
WHEREAS, WSDOT has explained the details of the proposed project,
the access plan for the Limited access facility, and the City's right to a hearing to
the City of Auburn Public Works Director.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, HEREBY RESOLVES as follows:

Section 1. That the City Council finds that the City of Auburn has no
objections to the adoption of the revised combined right-of-way and limited
access Plan without a hearing as provided for in RCW 47.52.134.
Section 2. That the Mayor or designee is authorized to execute a
Waiver of Hearing with the Washington State Department of Transportation
relinquishing our rights to appeal in the form substantially as the waiver
attached hereto, marked Exhibit "A" and incorporated herein by this reference
and that the Mayor is further authorized to negotiate and execute a Right-of-
Way Turnback Agreement to assure that the ownership and maintenance of
South 277th Street is in conformity with the Limited Access Plan.
Section 3. Effective Date. That this Resolution shall take effect and be
in full force upon passage and signatures hereon.

EXHIBIT A
WAIVER OF HEARING
The Washington State Department of Transportation (WSDOT) has tentatively approved a plan
for the revision to the existing limited access facility on SR 167 in the South 277th street vicinity.
This section of SR 167 is located within the City of Auburn, as shown on sheet 4 of 10 sheets of
the limited access plan entitled; SR 167, Kent: SO. 285th St. to SO. 288th St. (RIGHT OF WAY).
The plan will be approved by securing waivers of hearing as required by the provisions of RCW
47.52.134.
The WSDOT has explained to Dennis Dowdy (Director of Public Works), the details of the
proposed project, the access plan for the limited access facility, and the City's right to a hearing
pursuant to RCW 47.52.133.
It is a benefit to the public to have the limited access plan become final without the time
necessitated for a hearing. The City of Auburn has no objections to the adoption of the revised
combined right of way and limited access plan without a hearing as provided for in RCW
47.52.134.
Having had the project and plan explained, the City of Aubum waives any fights to have a formal
hearing pursuant to RCW 47.52.134.
