A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, RATIFYING AND REAFFIRMING ITS ENDORSEMENT OF
THE ANNEXATION OF AN UNINCORPORATED AREA CONTIGUOUS TO
THE CORPORATE LIMITS OF THE CITY TO BE PLACED BEFORE THE
VOTERS OF THE PROPOSED ANNEXATION AREA - PINNACLE
PROPERTIES, IN ACCORDANCE WITH RESOLUTION 3514, AS RE-
CORRECTED
WHEREAS, the City of Auburn has received requests that certain areas of an
unincorporated territory contiguous to the corporate limits of the City, which unincorporated
territory is identified for reference as the Pinnacle Properties Annexation area; and,
WHEREAS, the City Council has authorized the annexation to proceed by
Resolution 3514, as re-corrected; and,
WHEREAS, since the passage of said Resolution No. 3514, the annexation
proposal has been submitted to and approved by the Pierce County Boundary Review
Board, as evidenced by the letter from the Pierce County Boundary Review Board dated
February 5, 2003, a copy of which is attached hereto, marked as Exhibit "A" and
incorporated herein by reference.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, HEREBY RESOLVES as follows:
Section 1. That the Auburn City Council ratifies and reaffirms its endorsement of the
annexation of that certain unincorporated territory contiguous to the corporate limits of the
City identified as the Pinnacle Properties Annexation area, and further restates and
confirms its findings, holdings and directives, as set forth in said Resolution No. 3514.
Section 2. That the description of the boundaries of the area to be annexed, hereinafter
identified as the Pinnacle Properties Annexation area, is as follows:

THAT PORTION OF THE NORTHWEST QUARTER OF THE SOUTHWEST
QUARTER OF SECTION 5 TOWNSHIP 20 NORTH, RANGE 5 EAST, W. M., PIERCE
COUNTY, WASHINGTON, DESCRIBED AS FOLLOWS:
BEGINNING AT THE NORTHWEST CORNER OF THE NORTHWEST QUARTER
OF THE SOUTHWEST QUARTER OF SAID SECTION 5; THENCE EASTERLY ALONG
THE NORTH LINE OF SAID SUBDIVISION A DISTANCE OF 850 FEET, MORE OR
LESS, TO THE NORTHEAST CORNER OF THE LANDS DESCRIBED IN DEED
RECORDED UNDER AUDITOR'S FEE NUMBER 9408110668, RECORDS OF PIERCE
COUNTY, WASHINGTON, SAID CORNER BEING 470 FEET WEST OF THE
NORTHEAST CORNER OF THE NORTHWEST QUARTER OF THE SOUTHWEST
QUARTER OF SAID SECTION 5; THENCE SOUTHEASTERLY ALONG THE EASTERLY
LINE OF SAID LANDS A DISTANCE OF 1390 FEET, MORE OR LESS, TO THE
SOUTHEAST CORNER OF SAID NORTHWEST QUARTER OF THE SOUTHWEST
QUARTER OF SAID SECTION 5; THENCE WESTERLY ALONG THE SOUTH LINE OF
SAiD SUBDIVISION A DISTANCE OF 1320 FEET, MORE OR LESS, TO THE WEST
LINE OF SAID SECTION 5; THENCE NORTHERLY ALONG SAID WEST LINE A
DISTANCE OF 1356 FEET, MORE OR LESS, TO THE POINT OF BEGINNING.
SITUATE IN PIERCE COUNTY, WASHINGTON; and,
Section 3. That the Mayor is authorized to implement such administrative procedures as
may be necessary to carry out the directives of this legislation, including steps to pursue
the annexation and the election therefor, in accordance with the Pierce County Boundary
Review Board letter and Resolution 3514, as re-corrected, with a preference that the
election be scheduled on May 20, 2003, or as soon thereafter as reasonably possible.
Section 4. That a certified copy of the resolution shall be filed with the legislative authority
for Pierce County.
Section 5. That this Resolution shall take effect and be in full force upon passage and
signatures hereon.

Thc forty-five (45) day period has elapsed since the Notice of Intention was officially filed with
the Pierce County Boundary Review Board on December 19, 2002 and the Board's jurisdiction
has not been invoked.
Accordin~ly, as provided by RCW 36.93.100(4), the mabject proposal is deemed approved by
the Boundary Review Board. ' '
