A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, FIXING A TIME FOR A PUBLIC HEARING ON THE PETITION
FOR VACATION OF A PORTION OF 69TM STREET SE LOCATED WEST OF
EVERGREEN WAY SE, WITHIN THE CITY OF AUBURN, WASHINGTON.
WHEREAS, Petition No. V-01-03 requesting the vacation of a portion of
69th Street SE located West of Evergreen Way SE, has been signed and filed
with the City by the owners of more than two-thirds of the property abutting
upon that portion of right-of-way sought to be vacated; and
WHEREAS, RCW 35.79.010 requires the City Council to schedule a
public hearing on a petition requesting the vacation of street right-of-way when
the petition has been filed with the City and signed by the owners of more than
two-thirds of the property abutting the proposed vacation;
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY
COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AS FOLLOWS:
Section '1. Pursuant to RCW 35.79.010, the City Council acknowledges
receipt of a request to vacate a portion of 69th Street SE located west of
Evergreen Way SE, which is attached hereto, designated Exhibit "A", and
incorporated by reference herein.
Section 2. The legal description of the right-of-way sought to be vacated
is described on attached Exhibit "B", and incorporated by reference herein.
Section 3. Pursuant to RCW 37.70.010, the City Council hereby
schedules a public hearing on said petition to be held on the 16th day of June,

2003, at 7:30 p.m. in the Council Chambers of the Auburn City Hall before the
City Council. All persons interested in said petition may attend that hearing.
Section 4. Pursuant to RCW 35.79.020, upon passage of this
Resolution, the City Clerk shall give twenty (20) days notice of the pendency of
the petition by posting written notice in the manner required by the statute and
as required by City Ordinance.
Section 5. The Mayor is hereby authorized to implement such
administrative procedures as may be necessary to carry out the directives of
this legislation.

That portion conveyed to the City of Auburn for road right-of-way by Deed under
Recording Number 200205060960 all in Section 6, Township 20 North, Range 5
East, W.M., in the City of Auburn, Pierce County, Washington, described as follows:
Commencing at the southeast corner of Lot 2 City of Auburn Short Plat as recorded
under Recording Number 200211145001, records of said county; thence
N20°03'29'~N along the easterly line of said Lot 2 a distance of 494.36 feet to a point
of intersection with a 877.50 foot radius circular curve to the right from which point
the center of said curve bears N20°03'29"W, said point being on the southerly margin
of that portion conveyed to the City of Auburn for road right-of-way by deed recorded
under Recording Number 200205060960, records of said county; thence westerly,
along said curve and southerly margin, through a central angle of 07°08'14'', an arc
distance of 109.31 feet to the POINT OF BEGINNING of the herein described parcel;
thence continuing westerly along said curve and said southerly margin, through a
central angle of 08024'42", an arc distance of 128.83 feet to a point on the westerly
margin of that portion conveyed to the City of Auburn' by said deed; thence
N04°30'33'~/along said westerly margin, 55.00 feet to a point of intersection with a
822.50 foot radius circular curve to the left from which point the center of said curve
bears N04°30'33"W, thence easterly, along said curve and the northerly margin of
said road deed, through a central angle of 07°39'07", an arc distance of 109.85 feet
to a point of compound curvature with a 35.00 foot radius circular curve to the left;
thence easterly, along said curve and the southerly margin of said road deed,
