HomeMy WebLinkAbout3618RESOLUTION NO. 3618 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, INITIATING THE ANNEXATION OF AN UNINCORPORATED ISLAND WITHIN THE CORPORATE LIMITS OF THE CITY, WHICH AREA IS REFERRED TO AS THE "HEER ANNEXATION" WHEREAS, the City of Auburn has received a request that certain areas of an unincorporated "island" territory contiguous to the corporate limits of the City, which unincorporated territory is identified for reference as the Heer Annexation area; and, WHEREAS, the City is authorized to initiate annexations via Resolution pursuant to RCW 35A. 14.295; and, WHEREAS, the area in question is less than 100 acres in size and greater than eighty percent of its boundaries are contiguous to current City Limits; and WHEREAS, the territory in question is currently uninhabited; and WHEREAS, when the Auburn City Council determines that the best interests and general welfare of the City would be served by the annexation of the unincorporated territory contiguous to the city, it would thusly be appropriate to call for a public hearing to be held to submit to the owners and neighbors of such territory the proposal for annexation. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, HEREBY RESOLVES as follows: Section 1. That the Auburn City Council has determined that the best interests and general welfare of the City would be served by the annexation of the unincorporated territory contiguous to such city, and that it is appropriate to call for a public hearing to be held to submit to the owners and neighbors of such territory the proposal for annexation. That the description of the boundaries of the area to be annexed, hereinafter identified as the Heer Annexation area, is as follows: "HEER" ANNEXATION LEGAL DESCRIPTION WEST OF AUBURN WAY N. IN WHITE RIVER VALLEY HOME TRACTS 2ND ADDITION THAT PORTION OF WHITE RIVER VALLEY HOME TRACTS SECOND ADDITION, UNRECORDED, LOCATED IN THE WEST HALF OF SECTION 31, TOWNSHIP 22 NORTH, RANGE 5 EAST, W.M., KING COUNTY, WASHINGTON, DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHEAST CORNER OF TRACT 4 OF THE WHITE RIVER VALLEY HOME TRACTS SECOND ADDITION, AN UNRECORDED SUBDIVISION (THE LEGAL DESCRIPTION OF SAID TRACT 4 IS RECORDED IN VOLUME 2006 OF DEEDS, PAGE 485 AND RECORDED UNDER KING COUNTY RECORDING NUMBER 319996), SAID SOUTHEAST CORNER BEING AN ANGLE POINT IN THE EASTERLY BOUNDARY OF THE LANDS DESCRIBED IN CITY OF AUBURN ANNEXATION ORDINANCE 4843 AND ON THE WEST MARGINAL LINE OF 85TM AVENUE SOUTH; THENCE NORTHERLY ALONG THE EASTERLY BOUNDARY OF THE LANDS DESCRIBED IN CITY OF AUBURN ANNEXATION ORDINANCE 4843 AND ALONG SAID WEST MARGINAL LINE OF 85TM AVENUE SOUTH TO ITS INTERSECTION WITH THE WEST MARGINAL LINE OF STATE HIGHWAY NO. 5 (AUBURN WAY NORTH) AND THE WESTERLY BOUNDARY OF THAT PORTION OF LAND ANNEXED TO THE CITY OF AUBURN BY CITY OF AUBURN ORDINANCE NUMBER 2511; THENCE SOUTHEASTERLY ALONG SAID WESTERLY MARGINAL LINE OF STATE HIGHWAY NO. 5 (AUBURN WAY NORTH) A DISTANCE OF 500 FEET MORE OR LESS TO THE NORTHEAST CORNER OF THAT PORTION OF LAND ANNEXED TO THE CITY OF AUBURN BY CITY OF AUBURN ORDINANCE NUMBER 3621; THENCE SOUTHWESTERLY 50 FEET MORE OR LESS ALONG THE NORTHERLY LINE OF THE LANDS ANNEXED TO THE CITY OF AUBURN BY CITY OF AUBURN ORDINANCE NUMBER 3621 TO AN ANGLE POINT THEREIN; THENCE WESTERLY 215 FEET MORE OR LESS ALONG THE NORTHERLY LINE OF SAID LANDS ANNEXED TO THE CITY OF AUBURN BY CITY OF AUBURN ORDINANCE NUMBER 3621 TO THE EAST MARGINAL LINE OF 85TM AVENUE SOUTH AND THE NORTHWEST CORNER OF THE LANDS ANNEXED TO THE CITY OF AUBURN BY CITY OF AUBURN ORDINANCE NUMBER 3621; THENCE NORTHERLY ALONG SAID EAST MARGINAL LINE OF 85TM AVENUE SOUTH 130 FEET, MORE OR LESS, TO THE EASTERLY PROLONGATION OF THE SOUTH LINE OF SAID TRACT 4; THENCE WESTERLY ALONG SAID EASTERLY PROLONGATION OF THE SOUTH LINE OF SAID TRACT 4 TO THE POINT OF BEGINNING. SITUATE IN KING COUNTY, WASHINGTON. and, Section 3. That the territory, which is triangular in shape, is roughly bounded by Auburn Way North on the north and east sides, by 85th Avenue South on the west, and by property currently within the City limits of the City of Auburn on the south; and Resolution No. 3618 June 12, 2003 Page 2 Section 4. That the number of voters residing therein as nearly as may be determined is zero (0); and, Section 5. A public hearing is hereby set for July 7, 2003, to afford residents and property owners of the above-described area an opportunity to be heard. Section 6. This Resolution and notice of the public hearing is to be given by publication of the resolution at least once a week for two weeks prior to the date of the hearing, in one or more newspapers of general circulation within the city and within the area to be annexed. Section 7. Following the public hearing a certified copy of the resolution shall be filed with the legislative authority for King County, and with the King County Boundary Review Board, along with the appropriate Notice of Intent to Annex the territory in question; and Section 8. Upon annexation, the territory so annexed shall be subject to proposed zoning regulation for the area to be annexed as follows: C-3, Heavy Commercial District; and, Section 9. That the Mayor is authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation, including providing notices pursuant to RCW 35A.14.070.
