A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF AUBURN, WASHINGTON, AUTHORIZING THE
MAYOR TO EXECUTE AMENDMENT NO. 1 TO THE
UTILITIES COOPERATION AGREEMENT BY AND
BETWEEN THE CITY OF AUBURN AND KING COUNTY
FOR INFILTRATION/INFLOW PROGRAM STUDY
WHEREAS, Resolution No. 3125, dated December 20, 1999, authorized
the Mayor to execute a Utilities Cooperation Agreement between the City of
Auburn and King County Department of Natural Resources to allow King
County access to Auburn sanitary sewer mains and appurtenances for the
purpose of collecting information on the condition of existing sewer mains and
assessing locations of possible inflow and infiltration into Auburn's wastewater
conveyance facilities; and
WHEREAS, the purpose of Amendment No. 1 is to designate King
County to manage and administer the construction of an Inflow/Infiltration (I/I)
pilot project in the City of Auburn as a part of the County's Regional I/I Control
Program; and to designate the County's funding and pre- and post-construction
monitoring of the pilot project; and to maintain that pilot project work will take
place and be completed by November 1, 2003, after which King County will
conduct post-construction flow monitoring; and
WHEREAS, the parties desire to amend the prior agreement by this
Amendment No. 1.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, HEREBY RESOLVES as follows:
Section 1. The Mayor is hereby authorized to execute Amendment No.
1 to the Utilities Cooperation Agreement by and between City of Auburn and
King County For Infiltration/Inflow Program Study, in the form substantially as
the agreement attached hereto, marked as Exhibit "1" and incorporated herein
by this reference.
Section 2. That this Resolution shall take effect and be in full force
upon passage and signatures hereon.

AMENDMENT NO.1
TO THE
UTILITIES COOPERATION AGREEMENT BY AND BETWEEN
CITY OF AUBURN
AND
KING COUNTY
FOR INFILTRATION/INFLOW PROGRAM STUDY
THIS AMENDMENT NO. 1 is made and entered into this day of , 2003, between
the City of Auburn, a municipality in the State of Washington, (hereinafter, "the City"), and King County,
a home rule charter courity in the State of Washington, acting through its Department of Natural
Resources and Parks (hereinafter, "the County" or "DNRP").
RECITALS
WHEREAS, The City of Auburn, Auburn Resolution No. 3125, and King County entered into an
Agreement dated December 20, 1999 regarding participation in the County Infiltration/Inflow (Un
Program Study;
WHEREAS, the Parties desire to amend the prior Agreement by this Amendment No. 1.
NOW, THEREFORE, THE CTTY OF AUBURN AND KING COUNTY DO AGREE as follows:
The prior Agreement is modified, altered and changed in the following respects only:
MODIFICATIONS AND ADDITIONS
Addition to Section 1: Purpose and Duration of the original Agreement
Section 1: Purpose and Duration
1.4 The purposes of this Amendment No. 1 are:
(a) to designate King County to manage and administer the construction of an UI pilot
project in the City of Auburn as a part of the County's Regional Infiltration/Inflow (Un
Control Program, and
(b) to designate the County's responsibility for pre and post-construction monitoring of the
pilot project; and
(c) to maintain that pilot project work will take place and be completed by November 1,
2003; after which King County will conduct post-construction flow monitoring.
1.5 Sharing Information. The Parties agree, to the extent allowable by the City of Auburn and
King County policy, to share all pertinent information related to the UI reduction pilot project,
including but not limited to: design, cost estimates, specifications, bid documents, Geographic

Information System (GIS), Sanitary Sewer Evaluation System (SSES), flow data, modeling,
surveying information, citizen concerns and issues.
1.6 Uniform Record Keeping and Constructed Drawings. The Parties agree to the goal that
databases, information, records and constructed drawings will be in an electronic form mutually
agreed upon and usable by the other party. Within 90 days from project completion the County shall
provide to the City approved construction mylars. As-built changes shall be noted and signed by the
construction inspector. The City shall incorporate these mylars into their permanent records.
1.7 Standards, Procedures & Guidelines. The PaRies agree that in order to maintain consistency,
fairness, and quality pilot projects that are effective in removing UI and that benefit the Regional UI
Control Program, the parties will use, at a minimum, the draft UI Control Program standards,
procedures and guidelines during the design and construction of this pilot project.
1.8 Changes in Scope of Work, Cost and/or Conditions. The Parties agree that change orders
for scope of work, costs and/or for changes in conditions will be processed under Section 10 of the
original agreement and require written approval of both parties.
1.9 Ownership of Improvements. There will be no changes in facilities ownership due to any
pilot project improvements made, even if the improvements are made to private property.

2.8 Scope of Work. King County will act as lead agency, and manage and administer the pilot
project. The pilot project scope of work is attached hereto as Exhibit A and is incorporated herein by
this reference. If additional information is necessary to allow the project to function effectively as a
pilot, specific requests will be made in writing to the City.
2.9 Environmental Review Process. The County agrees to prepare an Environmental Review
Document highlighting the UI Program with general information about this pilot project. The City
agrees to review the document prior to distribution.
2.10 Pre and Post-Flow Monitoring. The County agrees to conduct pre and post-flow monitoring
within the pilot project area between November 1, 2003 and January 15, 2004. The County agrees to
share with the City the results of this flow-monitoring period.
2.11 Entering Contracts with Contractor. King County agrees to enter into contracts as necessary
to complete the pilot project per approved Scope of Work, (Exhibit A). The County's consulting team
will perform engineering and design oversight for bidding and engineering on the contractor hiring
process.
2.12 Insurance. King County shall require its contractor(s) to procure, maintain and provide
evidence of coverage, including endorsements naming the City of Auburn, its officers, officials,
employees and agents as additional insured.
2.13 Securing Private Property Access.
King County shall be responsible for securing private property right-of-entry agreements with
property owners when access to private property is required to complete pilot project work.

Section 3. City Responsibilities
3.5 Securing Applicable Permits. The City shall be the lead agency for securing all applicable
local permits for the pilot project including but not limited to utility and street use pernuts, with input
provided by the County as needed.
3.6 Community Coordination and Communications. The City and the County agree to jointly
deternune their roles for community coordination and communications for the pilot project, and to
jointly develop a public information/education plan for this pilot project. The County agrees to assist
in producing materials for public distribution.
Addition to Section 4: Indemnification of the original Agreement

The City agrees to limit the County's liability for work or product to end with the warranty period.

7.2 All Notices to the City required to be given under the terms of this Agreement and this
Amendment unless otherwise specified herein, or as may be amended, shall be given in writing,

Exhibit A
Pilot Project Scope of Work and Schedule
The Auburn UI Sewer Rehabilitation Pilot Project will include rehabilitation work on mains,
manholes, laterals, and side sewers: The work will consist of the following items. Additional
detail can be found in the Contract Technical Specifications.
l. Installation of manhole pans in 8 manholes.
2. Pipe burst approximately 1,900 feet of existing 6-inch sewer with 8-inch
sewer with HDPE pipe.
3. Replace approximately 2,000 feet of existing 4-inch and 6-inch lateral and
side sewer from the sewer main to the building connections. Construction
will be completed by dig and replace or pipe bursting. Clean outs will be
provided at the building connection if a clean out does not already exist.
4. Repair of one 8-foot section of sewer main using cured in place pipe (CIPP)
liner.
5. Replacement of approximately 9 manholes.
6. Pre and post-construction CCTV recording and inspections of laterals, side
sewers and mains.
7. Pre and post- construction flow monitoring of the pilot basin and a control
basin.
8. Complete restoration of the construction work area including all restoration
of the private property to pre-construction condition.
The County intends to conduct flow monitoring to quantify the effectiveness of the rehabilitation
work performed within the pilot project area. The flow monitoring may take place in multiple
locations within the mini-basin both before and after UI Control work has occurred. This work
will occur between November 2002 and March 2004.
