HomeMy WebLinkAbout3756 RESOLUTION NO. 3 7 5 6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE CONVERSION TO, AND SALE OF AUBURN POLICE CANINE BLITZ AS SURPLUS PROPERTY OF THE CITY OF AUBURN WHEREAS, Police Canine Officer Andrew M. Suver will be leaving the City of Auburn on August 3, 2004; and WHEREAS, the age of five and one-half is a reasonable period of time for a canine to act in the capacity of a Police Service Dog; and WHEREAS, the City of Auburn Police Service Dog Blitz has reached the age of five and one-half and is no longer serviceable as a Police Service Dog; and WHEREAS, City of Auburn Police Canine Officer Andrew M. Suver, who has been the Officer assigned as Canine Handling Officer exclusively for Police Service Dog Blitz from August 1, 2000 to present has expressed the desire to acquire sole and exclusive ownership of Blitz; and WHEREAS, there is an understanding between Canine Handling Officers and the City of Auburn that at conclusion of a Police Service Dog's usefulness, the City will sell the Police Service Dog to its Canine Handling Officer and his or her family for the sum of one dollar and no/100 ($1.00). NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, HEREBY RESOLVES AS FOLLOWS; ------------------------------ Resolution No. 3756 July 27, 2004 Page 1 of 2 Section 1. The City of Auburn has determined that Canine Blitz has reached the end of a reasonable service period and therefore determined that the property status of said canine should be surplussed and should be sold consistent with the understanding and practice between the City and Canine Handlers, to Auburn City Police Officer Andrew M. Suver for the amount of one dollar and no/100 ($1.00) upon execution of the sale and waiver agreement as described in Exhibit A attached hereto and incorporated herein by this reference. Section 2. The Mayor is authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. Section 3. SUVER FOR SALE OF SURPLUS PROPERTY R~ THIS AGREEMENT is made and entered into this ~ - day of AVb0 s-( 2004, by and between the City of Auburn, and Andrew M. Suver, as follows: Andrew M. Suver shall pay to the City of Auburn one dollar and no/100 ($1.00) for and in consideration of the agreement of the parties for ownership to the German Shepard Police Service Dog named Blitz. The City of Auburn shall, upon receipt of said one dollar and no/100 ($1.00) convey to and transfer full ownership of the Police Service Dog to Andrew M. Suver. Andrew M. Suver understands that he is receiving full ownership of this Police Service Dog, that the City of Auburn is relinquishing all claims to this Police Service Dog, and that from the time of execution of this agreement forward Andrew M. Suver assumes total responsibility for the care, maintenance and actions of this Police Service Dog. Andrew M. Suver further acknowledges that he has been the handler for this Police Service Dog from the beginning of this Police Service Dog's training in August of 2000 and for the duration of this canine's career as a Police Service Dog with the City of Auburn. As exclusive handler of this Police Service Dog, he has special knowledge regarding the level of Police Service Dog training and behavioral attributes of this canine. Andrew M. Suver, for and in consideration of being sold the above-named Police Service Dog by the City of Auburn, with the City of Auburn relinquishing all claims to this Police Service Dog for himself, heirs, successors and assigns, does agree to defend, indemnify and hold the City of Auburn harmless from and against any and all claims, injuries, damages, losses or suits of any nature whatsoever, including but not limited to attorney's fees arising out of or in any connection with his use of this Police Service Dog for the duration of this canine's life. By signing this agreement, Andrew M. Suver, acknowledges that Police Service Dog Blintz is hereby retired and is not to be released back into police service. a¿~Æ ~ Îho~~ Andrew M.
