HomeMy WebLinkAbout4166RESOLUTION NO.4 1 6 6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DECLARING AN EMERGENCY WITH RESPECT TO REPAIRS OF THE AUBURN AVENUE THEATER BUILDING WHEREAS, the City of Auburn recently entered into a long term lease for the Auburn Avenue Theater pursuant to Auburn City Council Resolution No. 4063; and WHEREAS, both the State of Washington and the City of Auburn have recognized the importance of protecting and preserving historically and culturally significant buildings; and WHEREAS, the Auburn Avenue Theater is a historically and culturally significant building in the City of Auburn in that it was constructed in 1926 as the North Coast Transportation Company, operated as an "auto livery" and bus depot until 1943 and converted into the Auburn Avenue Theater in 1943; and WHEREAS, pursuant to said long term lease, the City of Auburn is responsible for maintenance and repair of the building during the term of lease; and WHEREAS, during the term of the lease, the City of Auburn received an engineering report which identified several significant structural problems with the building which interfere with the City's ability to occupy and use the building as contemplated; and Resolution No. 4166 March 5, 2007 Page 1 of 3 WHEREAS, in order for the City to protect an historically and culturally significant building and meet its programming schedules and to utilize the building, it is appropriate for certain improvements and repairs to be made as soon as possible and since those repairs are necessary before the City would be able to occupy the building, and because those repairs are necessary for the public health, safety and welfare of individuals in or in the vicinity of the building, these circumstances constitute an emergency, not only in terms of historical preservation and protection of the City's staff, but also protection of any other occupants or individuals in the vicinity of the building. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, HEREBY RESOLVES as follows: Section 1. That the City needs to enter into a contract immediately to address the serious structural problems with the Auburn Theater in light of its long term lease, and there is not sufficient time to enable the City to go through the typical bidding and contracting process. Section 2. That the Mayor is authorized to negotiate and enter into contracts with qualified contractors and construction service providers to effect the necessary repairs of the Auburn Theater Building. Section 3. That this Resolution shall take effect and be in full force upon passage and signatures hereon.
