HomeMy WebLinkAbout4208RESOLUTION NO.4 2 0 8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DECLARING ITS INTENTION TO ORDER THE IMPROVEMENT OF SIDEWALKS, CURB/GUTTERS, DRIVEWAYS, WHEELCHAIR ACCESS RAMPS, AND LANDSCAPE STRIPS ALONG THE WEST SIDE OF "M" STREET SE BETWEEN 29TH STREET SE AND 37TH STREET SE AND TO CREATE LOCAL IMPROVEMENT DISTRICT NO. 350 TO ASSESS A PART OF THE COST AND EXPENSE OF CARRYING OUT THOSE IMPROVEMENTS AGAINST THE PROPERTIES SPECIALLY BENEFITED THEREBY, AND NOTIFYING ALL PERSONS WHO DESIRE TO OBJECT TO THE IMPROVEMENTS TO APPEAR AND PRESENT THEIR OBJECTIONS AT A HEARING BEFORE THE CITY COUNCIL TO BE HELD ON AUGUST 6, 2007 WHEREAS, there are currently no sidewalks along the west side of "M" Street SE between 29th Street SE and 37th Street SE; and WHEREAS, the City Council finds that constructing a sidewalk along the west side of that portion of "M" Street SE would improve public safety; and WHEREAS, the City Council finds that it is fair and equitable that the owners of those properties specially benefited by construction of the sidewalk participate in the funding of the construction, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, HEREBY RESOLVES as follows: Section 1. It is the intention of the City Council of the City of AUBURN, Washington, to order the improvement of the west side of "M" Street SE between 29th Street SE and 37th Street SE as set forth in Exhibit "A," attached hereto and Resolution No. 4208 June 20, 2007 Page 1 of 4 by this reference made a part hereof, by the development of certain sidewalk improvements ("Improvements"). All of the foregoing improvements shall be in accordance with the plans and specifications therefor prepared by the City and may be modified by the City as long as that modification does not affect the purpose of the Improvements. Section 2. The total estimated cost and expense of the Improvements is declared to be $200,777.00, and approximately $112,078.00 of that cost and expense shall be borne by and assessed against the property specially benefited by the Improvements to be included in a local improvement district to be established embracing as nearly as practicable all the property specially benefited by the Improvements. Actual assessments may vary from estimated assessments as long as they do not exceed a figure equal to the increased true and fair value the Improvements add to the property. Section 3. The City Council shall conduct a public hearing in the Council Chambers at Auburn Hall in Auburn, Washington, at 7:30 p.m., or as soon thereafter as possible, on August 6, 2007, to hear public comments relating to the Improvements, all objections thereto, and the method of payment for the Improvements. All persons who wish to object to the Improvements are notified to appear and present those objections at the hearing. Any person who may desire to file a written protest with the City Council may do so within 30 days after the date of passage of the ordinance ordering the improvements in the event the local improvement district is formed. The written protest should be signed by the ---------------------------- Resolution No. 4208 June 20, 2007 Page 2 of 4 property owner and should include the legal description of the property for which the protest is filed and that protest should be delivered to the City Clerk. Section 4. The City Clerk is authorized and directed to give notice of the adoption of this resolution and of the date, time and place fixed for the public hearing to each owner or reputed owner of any lot, tract, parcel of land or other property within the proposed local improvement district by mailing such notice at least fifteen days before the date fixed for public hearing to the owner or reputed owner of the property as shown on the rolls of the King County Assessor at the address shown thereon, as required by law. Section 5. This resolution shall be published in its entirety in at least two consecutive issues of the official newspaper of the City, the date of the first publication to be at least 15 days prior to the date fixed for the public hearing. Section 6. The Finance Director is directed to submit to the City Council on or prior to August 1, 2007, all data and information required by law to be submitted. Section 7.
