RESOLUTION NO. 4 4 4 8
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AUBURN, WASHINGTON, AUTHORIZING
THE MAYOR AND CITY CLERK TO ENTER INTO
AN AGREEMENT FOR SHARING OF FIBER OPTIC
INSTALLATIONS PROJECTS
WHEREAS, the Cities of Bellevue, Kirkland, Renton and Seattle, the
Lake Washington, Renton and Bellevue School Districts, the University of
Washington, Bellevue Community College, and Evergreen Hospital entered into
an Interlocal Agreement for the sharing of Fiber Optic Installation Projects; and
WHEREAS, the City of Auburn desires to participate in planned and
future fiber optic projects under those same General Terms and Conditions.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
KING COUNTY, WASHINGTON, HEREBY RESOLVES as follows:
Section 1. The Mayor of the City of Auburn and the Auburn City Clerk
are hereby authorized to execute an agreement, which will take the form of an
Addendum to the "General Terms and Conditions for Sharing of Fiber Optic
Installation Projects" between the City of Auburn and Cities of Bellevue,
Kirkland, Renton and Seattle, the Lake Washington, Renton and Bellevue
School Districts, the University of Washington, Bellevue Community College,
and Evergreen Hospital, which agreement shall be in substantial conformity
with the Agreement a copy of which is attached hereto, marked as Exhibit "A"
and incorporated herein by this reference.

Section 2. The Mayor is hereby authorized to implement such
administrative procedures as may be necessary to carry out the directives of
this legislation.
Section 3. This resolution shall be in full force and effect upon
passage and signatures hereon.

ADDENDUM TO GENERAL TERMS AND CONDITIONS
For Sharing of Fiber Optic Installation Projects
THIS ADDENDUM is made and entered into on the dates signed below by and among
various Participating Agencies and the City of Auburn as an addendum to the General Terms and
Conditions for Sharing of Fiber Optic Installation Projects between the parties for
executed on the day of , 200 , and
most recently amended on
WHEREAS, the Cities of Bellewe, Kirkland, Renton, and Seattle, the Lake Washington,
Renton and Bellevue School Districts, the University of Washington, Bellewe Community College,
and Evergeen Hospital ("Participating Agencies") have entered into the General Terms and
Conditions for Sharing of Fiber Optic Installation Projects; and,
WHEREAS, the City of Auburn desire to participate in planned and future fiber optic
projects under those same General Terms and Conditions; and,
WHEREAS, the Participating Agencies wish to amend the General Terms and Conditions to
add the City of Auburn as a participating Agency.
NOW THEREFORE in consideration of their mutual covenants, conditions and promises, the
Parties agree as follows:
1. As provided for in Section IX, paragraph N, the Valley Cities signing this Addendum shall
become Participating Agencies.
2. The City of Auburn acknowledge that they have received the General Terms and Conditions,
including Addenda Numbers 1 through , and agree to be bound by the same.
3. All other provisions of the General Terms and Conditions shall remain in full force and
effect.
4. This Addendum may be signed in counterpart.

RESOLUTION No. 2137
A Resolution of the Puyallup City Council endorsing the
efforts of the Valley Cities Consortium, authorizing an application
for a federal grant to fund broadband opportunities offered
through the U. S. Department of Commerce, and authorizing the
City Manager to execute such agreement and implement such
administrative procedures as may be necessary to carry out the
directives of this Resolution.
WHEREAS, the City of Puyallup is a member of the Valley Cities Association
which was formed in August, 2005, for the purpose of collaborating on issues of common
interest; and
WHEREAS, the members of the Valley Cities Association received Department of
Justice/COPS More grant funding to complete a study and develop a strategic plan to meet
community and public agency needs through potential uses of fiber optic and wireless
broadband infrastructure and services; and
WHEREAS the results of the study and plan include a recommendation for the
Cities to focus on regional broadband development efforts to include enhancement of public
safety, law enforcement and local governmental services through development of a regional
fiber optic ring to interconnect all participating cities and agencies, which ring will enhance
interagency communication, emergency response and municipal services; and
WHEREAS, the goals of the members of the Valley Cities Association, together
with the City of Federal Way (collectively hereinafter referred to as "Valley Cities
Consortium"), are to enhance broadband infrastructure and services by: 1) improving access
to and use of broadband for public safety agencies; 2) efficiently delivering local
government services; 3); stimulating broadband, local economic development and job
creation; 4) enhancing service to public health care and education institutions; 5) effectively
managing public property and right-of-way; and 6) ensuring equity, awareness and improved
access to the public; and
WHEREAS, as part of the technology improvements, 9-1-1 communication to the
public safety community will change from the historic radio-based to the more
technologically advanced Internet Protocol (IP)-base, thus requiring wired (fiber)
communication from 9-1-1 communication centers to participating public entities, as well as
wireless communications from the agencies to the mobile computers in agency-owned
vehicles; and
WHEREAS, the members of the Valley Cities Consortium have executed a fiber
optic project agreement which sets forth the scope of a comprehensive fiber optic
infrastructure capital improvement initiative (Exhibit "A") and budget estimates for
constructing these infrastructure improvements (Exhibit "B"); and

WHEREAS, new grant funding opportunities are available through the federal
American Recovery and Reinvestment Act of 2009 to fund broadband technology
opportunities; and
WHEREAS, the Valley Cities Consortium desire to pursue federal grant funding
through the American Recovery Act for the first phase of the broadband infrastructure
project as identified in Exhibit "A" in the amount of $ 5.94 million; and
WHEREAS, the Valley Cities Consortium desire to have the City of Auburn take
the lead in applying for federal grant funding on behalf of the members of the Valley Cities
Consortium; and
WHEREAS, the City of Puyallup intends to fund its proportionate share of the local
match by utilizing available City resources, including in-kind match wherever possible; and
WHEREAS, the City Council use its best efforts to amend the City's Biennial
Budget dependent upon the grant award and the City's ability to fund required matches;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PUYALLUP, WASHINGTON, AS FOLLOWS: '
Section 1. Purpose. The Council endorses the collaborative effort of the Valley
Cities Consortium to enhance regional broadband infrastructure and authorizes the Mayor of
the City of Auburn to sign on behalf of the City of Puyallup, as a member of the Valley ;
Cities Consortium, the grant application to be submitted to the National Telecommunications
and Information Administration, U.S. Department of Commerce for grant funding offered i
through the Broadband Technology Opportunities Program. i

Section 2. Implementation. The City Manager is hereby authorized to execute j
the fiber optic infrastructure capital improvement initiative attached hereto as Exhibit A, and
to implement such administrative procedures as may be necessary to carry out the directives
of this Resolution.
Section 3. Effective Date. This Resolution shall take effect and be-tn full force
upon adoption.

GENERAL TERMS and CONDITIONS
For Sharing of Fiber Optic installation Projects i
WHEREAS, the City of Bellevue, the City of Kirkland, the City of Renton, the City
of Auburn, the Lake Washington School District, the Renton School District, the Bellevue
School District, the University of Washington, Bellevue Community College, Evergreen
Hospital, and Seattle Public Utilities, (the Participating Agencies) have entered into the
General Terms and Conditions for Sharing of Fiber Optic Installation Projects, and;
WHEREAS, the City of Puyallup, desires to participate in the planned and future
Fiber Optic Projects but cannot because it is not a Participating Agency subject to the
General Terms and Conditions for Sharing of Fiber Optic Installation Projects, and;
WHEREAS, the current Participating Agencies desire to amend the General Terms
and Conditions for Sharing of Fiber Optic Installation Projects to add the City of Puyallup as
a Participating Agency for participation in the planned and future Fiber Optic Projects;
NOW THEREFORE, the parties hereby agree as follows:
1) All terms in this Addendum shall have the same meaning as the defined terms
in the General Terms and Conditions for Sharing of Fiber Optic Installation Projects.
2) City of Puyallup hereby acknowledges that it has read, understands and
accepts the General Terms and Conditions for Sharing of Fiber Optic Installation Projects,
hereby incorporated by reference as if fully set forth, and agrees to be bound by them.
3) As provided in Section IX, paragraph N, the current Participating Agencies
hereby amend the General Terms and Conditions for Sharing of Fiber Optic Installation
Projects to add City of Puyallup as a Participating Agency, and City of Puyallup, by
executing this agreement, consents to 'aecoming a Participatii7g Ager~cy.
IN WITNESS WHEREOF, the parties hereto have executed this Addendum to the
General Terms and Conditions For Sharing of Fiber Optic Installation Projects on the
respective dates indicated below.
