Proposal: Purpose of Street Vacation To vacate the Right -of -Way located south of the Olympic Court Apartments (812 1 oth St NE). The Apartments would maintain and utilitize the area for a playground. Implication of Denial Right-of-way would continue to remain as City responsibility for maintenance and liability. Advertising/Posting: The legal advertising and posting requirements for the proposed vacation have been met. Applicable Policies & Regulations: • RCW's applicable to this situation - meets requirements of RCW 35.79. • MUTCD standards - not affected by this proposal. • City Code or Ordinances - meets requirements of ACC 12.48. ■ Comprehensive Plan Policy - not affected. • City Zoning Code - not affected (zoned "R4 — Multiple Family Residential"). Public Benefit: ■ This street vacation decreases the unopened Right-of-way maintenance obligation of the City. • The vacated area will be subject to property taxes. Page I of 2 Discussion: The vacation application was circulated to Puget Sound Energy, Comcast, and U.S. West Communications. • Puget Sound Energy has an existing underground and overhead facilities in the alleyway, an easement would need to be obtained for this utility. The vacation application was circulated to City staff. The following comments were received: ■ Staff recommends the City obtain a 10 -foot Sanitary Sewer Easement. Assessed Value: RCW 35.79 and ACC 12.48 allows the City to be compensated up to one-half the appraised value of the area vacated or, in the event the property or portions thereof were acquired at public expense, compensation may be required in an amount equal to the full appraised value of the area vacated. The right-of-way was granted by a Quitclaim Deed in 1967 in the amount of $1.00. It is the staff's recommendation to not charge the proponent for the right-of-way. Recommendation: Staff recommends that if the street vacation is granted it needs to be subject to the following condition: 1. Retain a public utility easement for the City's sewer utility. 2. Retain a private utility easement for Puget Sound Energy's utilities. 3. Maintaining exposure to the utility manhole for future City maintenance. 4. Provide ingress and egress through 812 10th Street NE for use by the City and Puget Sound Energy for maintenance of the utilities. 5. Proponent is to clean up the debris/liter in this area and continue to maintain and use this area as a playground for the apartment tenants.
