CALL TO ORDER Chair Kelly called the meeting to order at 10:00 AM in Room 1 located at Auburn City Hall, 25 West Main Street, Auburn, WA. Chair Jim Kelly and the following Board members were present: Chair Pro Tem Bud Larson, Member Stacey Brothers, Member Gene Cerino and Member Russ Vander. Also present were Meredith Shropshire, Associate City Attorney Karen Gulliver, and Board Secretary Danielle Daskam. I1. APPROVAL OF MINUTES A. Minutes of the August 5, 2002 LEOFF Board Meeting Motion by Member Cerino, second by Chair Pro Tem Larson to approve the August 5, 2002 minutes. MOTION CARRIED UNANIMOUSLY. 5-0. II1. UNFINISHED BUSINESS A. Pending Disability Leave/Retirement Applications There was no pending disability leave/retirement application. B. Claims 1. Ernie Miller On August 5, 2002 the Board tabled Mr. Miller's claim pending his signature on his claim/worksheet form. Mr. Miller's signed claim form was received on August 9, 2002. a. Request for reimbursement of lens and frames expenses dated July 1, 2002 as follows: Bifocal Lenses: $ 89.00 Frames: $ 54.04 LEOFF Board Policy 9.02(A)(2) provides for reimbursement as follows: LEOFF Board Minutes September 3, 2002 Page 1 City of Auburn Law Enforcement Officers and Firefighters Disability Board Tuesday, September 3, 2002 - 10:00 AM - Conference Room I Bifocal Lenses $ 60.00 Frames $ 90.00 Motion by Chair Pro Tem Larson, second by member Brothers to approve Mr. Miller's request for reimbursement for lenses and frames in the total amount of $114.04. MOTION CARRIED UNANIMOUSLY. 5-0. 2. Ray Nixon On August 5, 2002, the LEOFF Board tabled Mr. Nixon's claim for payment pending receipt of Regence and Medicare explanation of benefits statements. No new information was received. a. Request for reimbursement for medical services received on March 13, 2002 in the amount of $69.00. (No Medicare or Regence Explanation of Benefits submitted.) Motion by Chair Pro Tem Larson, second by Member Vandver to table Mr. Nixon's claim until the next meeting. MOTION CARRIED UNANIMOUSLY. 5-0. 3. Raymond Ogden On August 5, 2002, the LEOFF Board tabled Mr. Ogden's claim for payment pending receipt of Regence and Medicare explanation of benefits statements. No new information was received. a. Request for reimbursement of medical expenses received on June 13, 2002 in the amount of $182.00. (No Medicare or Regence Explanation of Benefits submitted.) Motion by Member Vandver, second by Chair Pro Tern Larson to table Mr. Ogden's claim until the next meeting. MOTION CARRIED UNANIMOUSLY. 5-0. Marion Dukes Request for reimbursement of hearing aid costs in the amount of $2,451.20. On August 5, 2002, the LEOFF Board tabled Mr. Dukes' claim pending the receipt of equivalent cost information from the Costco Hearing Aid Center. The Board reviewed a letter dated August 23, 2002 from Shirley Haarhues of the Costco Hearing Aid Center advising that the hearing aid cost quoted by Dr. Kozie was less than Coscto's for comparable hearing aids. Motion by Member Brothers, second by Chair Pro Tem Larson to approve reimbursement in the amount of $2,451.20. Chair Kelly noted that Mr. Dukes' secondary insurance coverage through his spouse paid a portion of the total cost of $3,700. MOTION CARRIED UNANIMOUSLY. 5-0. IV. NEW BUSINESS A. Disability Leave/Retirement Applications There was no new application for review. B. Appeals 1. Ed Henderson In a letter dated August 23, 2002, Mr. Henderson filed a request for reconsideration of the August 5, 2002 LEOFF Board action denying Mr. Henderson's request for pre-approval of oral surgery expenses. Included in the Board's agenda packet were the following: LEOFF Board Policy 9.07; Mr. Henderson's August 23, 2002 request for reconsideration letter, with attached doctors' statements, received by the LEOFF Board Secretary on August 27, 2002; the August 5, 2002 letter to Mr. Henderson conveying the Board's August 5, 2002 action; Mr. Henderson's July 25, 2002 letter; July 16, 2002 Board letter to Mr. Henderson requesting additional information regarding LEOFF Board Minutes September 3, 2002 Page 3 City of Auburn Law Enforcement Officers and Firefighters Disability Board Tuesday, September 3, 2002 - '10:00 AM - Conference Room I Mr. Henderson's condition; and Mr. Henderson's letter dated June 5, 2002 requesting the Board's pre-approval of dental expenses. Board members reviewed Mr. Henderson's request for reconsideration. Motion by Chair Pro Tem Larson, second by Member Cerino to accept Mr. Henderson's request for reconsideration and set a hearing date on Mr. Henderson's appeal for the next regular meeting, October 7, 2002 at 10:00 AM. MOTION CARRIED UNANIMOUSLY. 5-0. C. Medical Claims 1. Monroe Shropshire (For clarification of these minutes, Mr. Shropshire's claim was considered immediately following Item II.A of these minutes.) A claim for payment from Monroe Shropshire was added as an agenda modification. The claim for payment was in the amount of $7,378.00. Mrs. Shropshire was in attendance to answer questions regarding her husband's claim. Chair Kelly noted that the claims consisted of $7,208.00 for skilled nursing facility costs not eligible for payment by Group Health Insurance coverage for the period of August 15 through August 31, 2002; a total of 17 days at $424.00 per day. A letter from Group Health confirming that Group Health Insurance does not cover the services received accompanied the claim. The claim also consisted of $170 for massage therapy not covered by the health insurance. Also enclosed with Mr. Shropshire's claim was a letter dated August 15, 2002 from Allianz Life Insurance Company regarding the City-paid long-term care insurance. The Allianz letter explained that the long-term care insurance has a 90 day elimination period before benefits are payable under the policy. Benefits currently payable under the policy are $158.03 per day. Board members reviewed the claim materials submitted by Mr. Shropshire. Chair Kelly noted Section 9.04 of the Policies and Procedures regarding skilled nursing care. Following conclusion of Board discussion regarding Mr. Shropshire's medical claim, Chair Kelly reconvened the regular meeting. Motion by Member Brothers, second by Chair Pro Tem Larson to approve reimbursement in the amount of $158.03 per day for 17 days and the amount of $170.00 for reimbursement of massage therapy, pending the receipt of additional information on the supplemental care that has been administered. MOTION CARRIED UNANIMOUSLY. 5-0. D. Discussion No additional discussion was held. E. Correspondence No additional correspondence was received. V.
