The draft amendments reflect input and information provided to staff by the Committee and the Planning Commission during their special joint meetings held on August 4, 2009 and August 11, 2009. At the September 14, 2009 meeting of the Planning and Community Development Committee, staff will provide the Committee with an overview of the draft amendments as recommended by the Commission. A propertv owner or an authorized representative of the property owner or a person, 44 business or orqanization desiring to use a property for a use consistent with this chapter 45 may apply for a temporary use permit An applicant for a temporary use aermit shall provide 46 written evidence of property owner authorization to use the property for the intended 47 temporary use. 48 I Chapter 18.46 (TemQoraty Uses) Text Amendments 1 Planning Commission Recommendation - September 9. 2009 1 D. The planning director or desiqnee mav approve permits for temporarv uses and structures, 2 with conditions to mitiqate negative impacts. 3 4 E. The qlanning director or desiqnee may authorize a temporary use permit for a use not S specificallv listed in the currently adopted use reaulations provided that it is comqatible with 6 the purpose and intent of apqlicable chapters and sections of Title 18 (Zoninq), and the 7 specific zoninq district in which it will be located. 8 9 F. The planning director or desiqnee mav require other reviews or permits includin4 but not 10 limited to environmental review as a prereauisite to issuance of a temporary use permit or as 11 a condition of aparoval for a temporary use aermit. 12 ,13 18.46.030 Application and review for temporarv use qerh~jits ; 14 15 A. Processina of Type II Temporary Use Permits. 3 4 1. ype II temporary use permit decisions shall be processed in accordance with the 5 applicable provisions of Title 14 ACC provided that a decision approvina, approvinq with 6 conditions or denying the apqlication shall be issued within fiftv (50) calendar davs of the 7 date of application completeness determination. The use will not result in significant drainage or other adverse imqacts; 47 b. The aravel parkinq area is not required for the purposes of ineetinq the current 48 minimum off-street 12arkin4 requirements. 49 2. The planning director or desiqnee may,arant additional extensions to the initial 12-month 50 validity period if he/she finds that such extension is warranted and that the temporarv 51 use is still in compliance with all aqplicable aparoval criteria. I Cha.pter 18.46 (Temporary Uses) Text Amendments 6 Planning Commission Recommendation - September 9. 2009 1 2 D. Specific Type I Temporary Use Permit - Site Specific Unforeseen/Emeraency Situations. 3 1. In accordance with Section 18.46.030 the plannin4 director or designee mav approve, 4 approve with conditions or denv a request for approval of an unforeseen/emerqencv 5 situation(s) for a residential commercial, industrial or institutional buildinq if the planninq 6 director or designee finds it is consistent with the folfowing criteria in addition to the 7 approval criteria specified in Section 18.46.080: 8 a. The need for the use is the direct result of a casualty loss such as fire, windstorm, 9 flood or other severe damage bv the elements or by human cause of a pre-existin4 10 structure or facility previously occupied by the apalicant on the aremises for which 11 the permit is souqht; 12 b. There exists adequate and safe vehicular inqress arid egress when combined with 13 the other uses of the propertv: 14 c. There exists adequate off-street or shared parking~ for the #porary use; 15 d. Specific Type II Temporarv Use Permit - Homeless Encampment. In accordance with 45 Section 18.46.030 the planning director or designee may issue a Type II temqorarv and 46 revocable use permit for a homeless encampment subject to the followinq criteria and 47 requirements: 48 1. Procedural Approval. 49 a The sponsorina aqency shall notify the city of the proposed homeless encampment a 50 minimum of 30 days in advance of the proposed date of establishment for the I Chapter 18.46 (Tempora~ Uses) Text Amendments 7 Planning Commission Recommendation - September 9, 2009 1 homeless encampment and at least 14 days before submittal of the temporarv use 2 permit. The advance notification shall contain the followinq information: 3 i. The date the homeless encampment will encamp; 4 ii. The length of the encampment; 5 iii. The maximum number of residents proposed; and 6 iv. The host location. 7 b. The sponsorinq aQency shall conduct at least one public informational meetinq 8 within or as close to, the neiahborhood where the proposed homeless encampment 9 will be located, a minimum of two weeks prior to the submittal of the temporary use 10 permit application. The time and location of the meeti", shall be agreed upon 11 between the city and sponsorinq apency. All property guM6rs within 1,000 feet of the 12 ro osed homeless encam ment shall be notified atj14 da s in advance of the 13 meetinq by the sponsorinq agency. The names of the on-duty executive 50 committee members will be posted daily in the security tent.
