This permit is rd for and five existing monitoring wells in the right of way on 3 Street NW and A Street NW. Please see the attached map. The monitoring wells were originally installed in 1991 as part of a groundwater monitoring program associated with a bulk fuel facility located at 112 3rd Street NW. ConocoPhillips will not be installing any new wells. This permit is for existing wells already in the right-of- way that were installed under a previous permit that has expired and needs to be renewed. Applicant shall maintain current insurance throughout the life of the permit 2) and provide the City with proof that they are insured. 3) Applicant is to provide a signed and notarized Hold Harmless agreement. 4) Applicant shall notify the City 24-hours in advance of performing monitoring operations by calling the Construction Manager at 253-804-5082. 5) Applicant shall perform monitoring between the hours of 9 am and 3 pm. 6) Applicant shall provide the City with copies of the monitoring data by sending copies to the following: City of Auburn, Water Quality Program Coordinator, 25 West Main Street, Auburn, WA 98001. 7) Applicant shall upon expiration of this permit either: a) Apply for a new permit following the then current permit process if wells are to be used for continued monitoring or b) Provide documentation that the monitoring wells have been properly abandoned if no longer needed. 8) The City reserves the right to adjust the terms and conditions or revoke this Right-of- Way Use Permit pending the following considerations: a) Public complaints involving perceived issues impacting public use of the ROW affected by the permit. b) Public comment or other community interest concerns. c) Any emerging issue or change in use of the ROW that may impact the public interest, as follows: The remaining capacity of the rights-of-way to accommodate other uses if the applicant’s proposed use is granted. The effect, if any, on public health, safety, and welfare if the authorization is granted. Such other factors as may demonstrate that the grant to use the rights-of- way will serve the community interest. W1005-3A Page 1 of 1
