Background:
A neighborhood meeting was held for the NW Main Street neighborhood on November 20, 2008. The
major issue identified was a lack of neighborhood on-street parking on D ST NW due to commuters, and
from students attending the high school. In response to a request by the D ST NW neighborhood that the
City consider implementation of a permit parking zone for D ST NW, the City agreed to survey the
neighborhood to gauge interest in creating a permit parking zone on an interim basis. The survey was
mailed in late March 2009 to residents along D Street NW between West Main Street and 3rd ST NW. A
total of 19 surveys were mailed to the residents. Of the 19, there were 11 surveys returned, 9 of which
asked that the City consider implementing a residential permit parking program.
The City formed a task force composed of representatives from Public Works, Planning, Parking
Enforcement, Legal, and Community Services to research and put together the particulars of a residential
permit parking program. The task force is recommending the following:
Implement a test program on a six month trial basis.
A Restricted Parking Zone (RPZ) would be established on the east side of D ST NW
between West Main ST and 3rd ST NW (permit parking only Monday through Friday, 9
a.m. to 5 p.m.).
Owners or occupants of properties located on the east side of D Street NW between
West Main Street and 3rd Street NW are eligible to be issued up to three parking permits
per household with one additional visitor permit.
There will be no charge for the parking permits.
Parking on the west side of D Street NW will remain as is under the current 72 hour
parking restriction.
Prepare an ordinance creating a new section of the Auburn City Code establishing
residential parking zones, creating a pilot PROGRAM, and establishing penalties for
violations.
The Task Force intends to present this proposal to the September 28th Municipal Services and October
5th Public Works Committee meetings. If the Council Committees agree to move forward with the
recommendation, it will be presented to the full City Council for approval and implementation of the six
month trial program.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF AUBURN, WASHINGTON, CREATING
SECTION 10.41 OF THE AUBURN CITY CODE
RELATING TO PARKING, ESTABLISHING
RESIDENTIAL PARKING ZONES, CREATING A
PILOT PROGRAM, AND ESTABLISHING
PENALTIES FOR VIOLATIONS.
WHEREAS
, it is the desire of the City Council to promote the general
health, welfare, and safety of all persons traveling upon public streets and
thoroughfares, and
WHEREAS
, public streets within the City of Auburn are to be managed
exclusively by the City and may be managed in such a way as to provide
reasonable access to the public, and
WHEREAS
, this ordinance is enacted in response to the adverse effects
caused in certain areas and neighborhoods where often located adjacent to
generators of high traffic demand such as high schools, hospitals, transit
stations, and business districts in order to limit the impact of employees, transit
commuters, and students parking their vehicles for lengthy periods of time and
thereby using on-street parking that might otherwise be used by residents and
area visitors; and
WHEREAS
, such parking by non-residents threatens the health, safety
and welfare of the many residents of the City of Auburn including those residing

and promote the integrity of these areas and neighborhoods, it is necessary to

enact parking regulations, restricting unlimited parking by non-residents therein,
while providing the opportunity for residents to park near their homes; and
WHEREAS
, the proposed Residential Parking Zones (RPZ) program is
intended to support the following three objectives: reduce traffic impacts to
neighborhoods from commuters who park around large parking demand
generators; continue to encourage a reduction in overall energy use and vehicle
emissions by discouraging non-residents from parking in RPZ areas; and
implement simple rules that are easily understood and clearly applied; and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN as follows:
Section 1.Creating a New Chapter to the City Code.
That a new
chapter 10.41 entitled Restricted Parking Zones shall be created to read as
follows:

RESTRICTED PARKING ZONES

10.41.010 Restricted Parking Zones - Establishment.
A The City Engineer is authorized to establish and remove Restricted
Parking Zones when, in the City Engineer’s professional judgment, a restricted
parking zone will reduce or eliminate a parking problem and the public interest
will be served.
B. Restricted Parking Zones may reserve on-street parking for the
exclusive use of abutting properties and/or residents in a prescribed vicinity;
vehicles used by their visitors; and service vehicles of persons having business
in the street. They may also reserve on-street parking only during certain posted
hours, allowing unrestricted parking at all other times.

C. The City shall issue permits or other means of identification,
maintain lists of vehicles used by residents, or adopt any other reasonable
means of distinguishing vehicles that may validly be parked in any restricted
parking zone from other vehicles. Restricted Parking Zones shall be
appropriately signed and/or marked; provided, that vandalism or destruction of
parking control signs shall not affect the validity of a restriction upon parking on
any street segment designated by the City Engineer if other signs or traffic
control devices give notice that parking in the street segment is restricted.
10.41.020 Restricted Parking Zone Established.
A. A restricted parking zone is established on the east side of D Street
Northwest between West Main Street and 3rd Street Northwest. Parking Monday
through Friday from 9:00 a.m. to 5:00 p.m. will only be allowed by permit.
B. Each property located on the east side of D Street between Main
Street and 3rd Street Northwest shall be allowed a maximum of three parking
permits plus one visitor permit. Parking permits will be issued to property owners
or occupants.
C. The permit shall be shall be hung from the rear view mirror of the
vehicle, with the permit number and expiration date clearly visible through the
windshield. If there is no rear view mirror, the placard shall be placed on the
dashboard of the vehicle on the driver’s side of the vehicle, so that the permit
number and expiration date are clearly visible through the windshield.
D. Motorcycles parked in the Restricted Parking Zone are exempt from
the permitting process.
10.41.030 Restricted Parking Zones - Violation.
No person shall stop, stand, or park a vehicle in violation of the posted or
marked restrictions or when a permit or other authorization issued by the City is
required as a condition for parking unless the permit or authorization issued by
the City or a card or decal issued pursuant to RCW 46.16.380 is displayed in a
prominent place on the vehicle. A violation of this section is subject to a $50
penalty if paid within 15 days. If paid after 15 days, the penalty shall be $60.
10.41.040 Restricted Parking Zones – Abuse of Privileges.
The person to whom a permit is issued under ACC 10.41.020 is presumed
to be responsible for the appropriate use of that permit as follows:
A. No person shall, for any valuable consideration, offer or agree to
authorize or permit any person to park a vehicle in any residential parking zone.
No person shall for any valuable consideration transfer or authorize the use of
any permit or other identification issued by the City authorizing a vehicle to park
in any residential parking zone.
B. Any person to whom a permit or other authorization is granted to
park in a residential parking zone shall be strictly liable for compliance with its
terms and conditions and complying with all applicable ordinances. In any of the

following instances, such permit or other authorization issued shall be revoked if
any person to whom such permit is issued or authorization granted:
1. Offers or agrees to authorize or permit any person to park a
vehicle in any restricted parking zone for any monetary consideration; or
2. Transfers for money the use of any permit or other
identification issued by the City authorizing a vehicle to park in any restricted
parking zone; or
3. Allows any person under their control to perform the acts
contained in subparagraph 1 or 2 above; or
4. Allows a permit or other authorization issued to them to be
so used.
No new permit will be issued or other authorization granted for a period of
one year to a person violating ACC 10.41.040.
Section 2.
The Public Works Department will report back to the City
Council six months after implementation of the Restricted Parking Zone
ordinance on D Street regarding the feasibility of continuing the Restricted
Parking Zone in that area.
Section 3.Implementation.
The Mayor is hereby authorized to
implement such administrative procedures as may be necessary to carry out the
directions of this legislation.
Section 4.Severability.
The provisions of this ordinance are
declared to be separate and severable. The invalidity of any clause, sentence,
paragraph, subdivision, section or portion of this ordinance, or the invalidity of the
application thereof to any person or circumstance shall not affect the validity of
the remainder of this ordinance, or the validity of its application to other persons
or circumstances.
Section 5.Effective date.
This Ordinance shall take effect and be
in force five days from and after its passage, approval and publication as
provided by law.
