KNOW ALL MEN BY THESE PRESENTS that for and in consideration of the
sum of TEN DOLLARS ($10.00), and for the consideration of incorporating the Extension
into the City system, and other good and sufficient consideration, receipt whereof is hereby
acknowledged, the undersigned Grantor Evergreen Tucci, Partners, LLC does by these
presents hereby convey, setover, assign, transfer and warrant to the City of Auburn, a

of 8-inch sanitary sewer and all appurtenances or any other. associated public facility as
shown on the public facility extension plans referred :to as FAC01-0019, the Area 18
development. Situated within the following described real property.

A PART HEREOF
and the said Grantor hereby warrants that it is the sole owner of all the property above
conveyed; that it has full power to convey the same and that it will defend the title of the
said Grantee against any and all persons lawfully making claim thereto, and indemnify the
City of Auburn for any costs, including Attorney fees in defending title.

LEGAL DESCRIPTION
A parcel of land in the southeast quarter of Section 6, Township 20 North, Range 5 East of
the Willamette Meridian, Pierce County, Washington, and more specifically described as
follows:
Beginning at the east quarter corner of said Section 6; thence south 01°43' 16" west along
the east line thereof 1,141.82 feet; thence north 88°17'02" west 241.52 feet to the
beginning of a curve concave southerly and having a radius of 627.50 feet; thence along the
arc of said curve through a central angle of 21'18'38" a distance of 233.39 feet to the
beginning of a compound curve concave southeasterly and having a radius of 35.00 feet;
thence along the arc of said curve through a central angle of 93°58' 17" a distance of 57.40
feet to a point of cusp with a curve concave easterly, having a radius of 2,503.50 feet and to
which point a radial bears south 66°26'03" west; thence northerly and clockwise along the
arc of said curve through a central angle of 17°13'37" a distance of 752.72 feet; thence
north 06°20'20" west 435.49 feet to the beginning of a curve concave westerly and have a
