HomeMy WebLinkAbout7502210353 GOVERNORS DEED 022175313,-42- G O V E R N O R'S D E E D IN THE MATTER OF SR 167 (PSH No. 5), Auburn-Pierce County Line Connection Road Paving (October 4, 1924) &C7 KNOW ALL MEN BY THESE PRESENTS, that THE STATE OF WASHINGTON, © for and in consideration of MUTUAL BENEFITS hereby conveys and quitclaims C'\J unto THE CITY OF AUBURN, a municipal corporation of the State of l!7 f`'r Washington, all its right, title and interest, in and to the following described real property situated in King County, State of Washington: That portion of the former right of way of SR 167 (PSH No. 5) Auburn-Pierce County Line Connection Road Paving (October 4, 1924), as said right of way existed prior to June 12, 1969, through Sections 13, 24, 25 and 36, Township 21 North, Range 4 East, W.M., and Sections 18, 19, 30 and 31, Township 21 North, Range 5 East, W.M., from the south corporate limits of the City of Auburn, a municipal corporation of the State of Washington, northerly via "A" Street S.E. to Main Street; thence easterly via said Main Street to Auburn Way North, as transferred to said City of Auburn by letter of certifica- tion dated May 3, 1974. The specific details concerning all of which are to be found within that certain map of definite location now of record and on file in the Office of the Director of Highways at Olympia, Washington, bearing date of approval October 4, 1924. The grantee, its personal representatives, successors in interest and assigns, as a part of the consideration hereof, does hereby covenant and agree, as a covenant running with the land, that in the event facilities are constructed, maintained, or otherwise operated on the said property described in this deed, for the accommodation of the traveling public or business users of any Federal-aid highway (such as eating, sleeping, rest, recreation, and vehicle servicing), it,will not discriminate on the grounds of race, color, or national origin against such traveling public or highway users in their access to and use of the facilities and services so constructed, maintained, or otherwise operated, and that the grantee shall maintain and operate such facilities and services in compliance with all other requirements imposed pursuant to Title 49, Code of Federal Regulations, Department Page 1 of 2 Pages of Transportation, Subtitle A, Office of the Secretary of Transporta- tion, Part 21 (49 C.F.R.
