HomeMy WebLinkAbout4156047 QUIT CLAIM DEED 100120.0 r v QUITCLAIM DEED WHEREAS, the City of Auburn, grantee hereinafter named, pursuant to ordinance No. 356 of said city,in an action in the Superior Court of King County, Washington, being cause No. 1405469 did condemn, appropriate and take certain property of the grantors hereinafter named, for the purpose of laying off, widening, etc., of North Main Street in said city, and WHEREAS, in the drafting of said ordinance and the petition, verdict and judgment in said cause, the description of certain lands belonging to the grantors herein, necessary for said improvement, and sought to be condemned by said City of Auburn in said proceeding, was erroneously oraitt.ed, though compensation was made therefor in the judgment entered in favor of said grantors in said proceeding, and WHEREAS, it is desired that laid City of Auburn be granted full title to said property, NOW THEREFORE The grantors, Arthur G. Ballard and Jane C. Ballard, husband and wife, in consideration of the premises and the payment to them of the amount of the judgment entered in said cause in their favor, hereby convey and quit claim to the City of Auburn, a municipal corporation and city of the third class, grantee herein, a11. their interest in the following described real estate, to-wit: C.o=encing at the squthwest corner of Government Lot 2 in Section 18, Township 21, north of Range 5 east W. M., running thence north 190 34.r 10.11, east, a distance of 151.81 feet to a point,,thence north 860 49' 100 east, a distance of 19.25 feet to a point, which last point is on a line coincident with the north line of Lot 6 in Block 14 of L. W. B:allard's 3rd Addition to Slaughter, King County, Washington, as the same appears on the recorded Plat thereof now of record in Volume 8 of Plats at page 47, of the official records in the County Auditor's office of King County, Washington, and which last point is 7.86 feet distant westerly from the northwest corner 1 of said Lot 6 running thence north 190 34' 10" east, a distance of 335.99 feet to the true. point of beginning, running thence north 860 4.9' 10"' east, a distance of. 18.70 feet, thence north 190 34.' 1,0"° east along a line coincident with the northwesterly line arnf Block "10` of A. C. Ballard's Condict Addition to Auburn, Washington, a distance of 9.17 feet more or less to the tkvvr k6wAh;*1T " of said A. C. Ballard's Condiet Addition to Auburn, Washington, thence south 860 49' 1011, west a distance of 1.8..70 feet to a point on the present southeasterly marginal line of Auburn Avenue (formerly called North Main Street), thence south 190 34' 10", west along said southeasterly marginal line, a distance of 9.17 feet more or less to the true point of beginning. It is understood and agreed that the execution and delivery of this deed shall in no way affect the rights of grantors to ob.jeat to any assessment that may be levied by said City of Auburn to pay for the cost of said.improvement.
