Applicant shall maintain current insurance throughout the life of the permit 2) and provide the City with proof that they are insured. 3) Applicant is to provide a signed and notarized Hold Harmless agreement. 4) Applicant is to conform to the approved use of Right-of-Way. See attached map. 5) The City reserves the right to adjust the terms and conditions or revoke this Right-of- Way Use Permit pending the following considerations: a. Public complaints involving perceived issues impacting public use of the ROW affected by the permit. b. Public comment or other community interest concerns. c. Any emerging issue or change in use of the ROW that may impact the public interest, as follows: The remaining capacity of the rights-of-way to accommodate other uses if the applicant’s proposed use is granted. The effect, if any, on public health, safety, and welfare if the authorization is granted. Such other factors as may demonstrate that the grant to use the rights-of- way will serve the community interest. 6) Applicant shall not park any construction vehicles on City Streets, other than in the area designated for closure, at any time throughout the duration of project. 7) Applicant shall maintain safety of project by installing a six foot chain link fence around entire project enclosing approved use of Right-of-Way with no parking signs posted on fence. Fencing shall have adequate signage and reflective markings so as to be visible at all times as directed by the City Engineer. 8) All associated fire hydrants and fire department connections shall be available at all times for fire use. Fencing and job site dumpsters shall be installed in such a way as to make these available. 9) Trailers, supplies, vehicles and equipment located within the fenced area in the right- nd of-way on 2 Street NW and on A Street NW shall be positioned in such a way as to nd not interfere with sight distance at the intersection of A St NW and 2 Street NW.
