Lewis calied the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Lewis and the following Councilmembers were present: Rich Wagner, Sue Singer, Gene Cerino, Nancy Backus, Bill Peloza, Lynn Norman and Virginia Haugen. Staff members present included: Communications Manager Dana Hinman; Multimedia Manager Jeremy Chevalier; Assistant Planning, Building and Community Director Kevin Snyder; City Attorney Daniel B. Heid; Parks, Arts and Recreation Director Daryl Faber; Grant Consultant Michael Wilson; Planning, Building and Community Director Cindy Baker; Information Services Director Lorrie Rempher; Public Works Director Dennis Dowdy; Chief of Police Jim Kelly; Human Services Manager Michael Hursh; Human Resource/Property and Risk Management Director Brenda Heineman; and Deputy City Clerk Cathy Richardson. C. Announcements and Appointments 1. Announcements a) City of Auburn's Brand Identity Communicator Awards Mayor Lewis recognized Jeremy Chevalier who was the recipient of the 2009 Communicator Award of Distinction. Mr. Chevalier received the award for the collaborative efforts of the City's Communications Division and the Auburn Tourism Board, including Page 1 Citv of Auburn Council Meetinq Minutes November 2, 2009 various partnerships throughout the City, for the City of Auburn Branding project. Mr. Chevalier was joined by Communications Manager Dana Hinman. Mr. Chevalier explained that a brand identity is the idea that rests in the minds and hearts of those individuals within a community and in surrounding areas. The branding campaign was designed to increase awareness of the positive aspects of Auburn. Mr. Chevalier shared various marketing items designed for the branding campaign including a community map brochure and 2008 community calendar showing Auburn's unique businesses and attractions. In addition, downtown banners were installed to promote and reinforce Auburn's image and tagline of "More Than You Imagined". Also, the Auburn Tourism Board launched a new website promoting tourism in Auburn and sponsored a successful "Discover Auburn" week-long event. Mr. Chevalier stated that it is an honor to receive the 2009 Communicator Award on behalf of the City of Auburn and in partnership with the Auburn Tourism Board. On behalf of the City Council, Mayor Lewis presented the 2009 Communicator Award to Mr. Chevalier and thanked him for his efforts and those of the Communications Division. b) Proclamation -"National Indian Heritage Month" Mayor Lewis proclaimed the month of November 2009 as National Indian Heritage Month in the city of Auburn. Mayor Lewis presented the proclamation to Daughters of the American Revolution representative Hilda Merryhew and Indian Tribal Warrior Society representative Peggy Caudill. Ms. Merryhew stated that, since 1900, recognition has been sought for the great influence that the American Indians have had on the history, cultural development, and continuing growth of the United States. National Indian Heritage Month was Page 2 Citv of Auburn Council Meetinq Minutes November 2, 2009 established in 1990 and the month of November was chosen as it is traditionally a time when many American Indians gather for fall harvest festivals, world renewal ceremonies, and powwows. Ms. Merryhew encouraged citizens to reflect upon and show appreciation for the many contributions of Native American Indians. On behalf of the Daughters of the American Revolution, Ms. Merryhew thanked Mayor Lewis and Councilmembers for recognizing National Indian Heritage Month in the city of Auburn. c) Proclamation - "Entrepreneurship Week" Mayor Lewis proclaimed the week of November 16 - 22, 2009 as Entrepreneurship Week in the city of Auburn. Mayor Lewis read and presented the proclamation to Auburn Mountainview High School DECA representatives Heather Odell and Nicola Usher. Ms. Usher thanked Mayor Lewis and Councilmembers for proclaiming the week of November 16 - 22, 2009 as Entrepreneurship Week in the city of Auburn and spoke of events being held throughout the week which will target all age groups and promote entrepreneurship. Ms. Odell expounded on the many activities for Entrepreneurship Week including an Entrepreneurship Exposition on Saturday, November 21, 2009 at Auburn Mountainview High School at 9:30 a.m. The free event will include workshops, open discussion with local business owners, resource booths, a keynote speaker and a complimentary lunch catered by Las Margaritas Restaurant. Ms. Usher stated that they will be promoting entrepreneurship within their school with many activities throughout the week including an informational video about entrepreneurship and a keynote speaker. Ms. Odell reported that efforts to reach a younger audience include partnering Junior Achievement Page 3 Citv of Auburn Council Meetinca Minutes November 2. 2009 volunteers with Auburn Mountainview High School DECA students to teach Rainier Middle School students about entrepreneurship using Junior Achievement's curriculum "It's my business". Ms. Usher invited the community to attend the Entrepreneurship Exposition. d) Recognition of Years of Service Mayor Lewis recognized Human Resources/Risk and Property Management Director Brenda Heineman for fifteen years of service to the City of Auburn and presented her with a 15-year pin. Director Heineman spoke regarding her pride in serving the City of Auburn and the gratification she has experienced during her fifteen years of service. 2. Appointments There was no appointment for Council consideration. D. Agenda Modifications II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings 1. Housing and Urban Development Section 108 Loan Guarantee Program * (Norman/Wilson/Hursh) 03.4.1.7 ' City Council conduct a public hearing regarding the proposed Housing and Urban Development (HUD) Section 108 Loan Guarantee Program Application for use in construction of City of Auburn's Community Center Grant Consultant Michael Wilson stated that this is the second required public hearing on the application for a HUD Section 108 loan and the potential use of Community Development Block Grant funds to repay the loan over a twenty year period. The intent is to authorize application for a loan of approximately $2,000,000 to be repaid at an annual payment of approximately $150,000 per year, at a fixed interest rate. In the event the loan is authorized by HUD, the City retains the option to accept or reject the loan. Page 4 Citv of Auburn Council Meetinq Minutes November 2, 2009 The funds may only be used for the Community Center facility. At 7:51, Mayor Lewis opened the public hearing. There being no one in the audience requested to speak, Mayor Lewis closed the public hearing. B. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Those wishing to speak are reminded to sign in on the form provided. No one in the audience requested to speak. C. Correspondence There was no correspondence for Council review. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Cerino reported that the Municipal Services Committee met on October 26, 2009 at 4:00 p.m. The Committee approved the consent agenda and discussed Ordinance No. 6273 regarding parking of commercial vehicles on residential streets. The Committee also discussed restricting smoking in City parks and the Committee matrix, including red light photo enforcement, speed enforcement guidelines in school zones, crime deterrent photo enforcement processes, and alternatives for animal control in anticipation of the dissolution of King County animal control and rescue services. Chair Cerino also reported on successes related to the use of a license plate reader by the Auburn Police Department, methods of notification of the dangerous dog ordinance to citizens new to Auburn community, Howard Hanson Dam flooding issues, and the lack of State and County funding for the juvenile offender release program. The next regular meeting of the Municipal Services Committee is scheduled for November 9, 2009 at 4:00 p.m. B. Planning & Community Development Chair Norman reported that the Planning and Community Development Committee met on October 26, 2009 at 5:00 p.m. The Committee held a joint meeting with the Auburn Tourism Board to receive an update on branding, the Tourism Board monthly calendar, tourism website, local community outreach program, Page 5 Citv of Auburn Council Meetinq Minutes November 2, 2009 success of "Discover Auburn" week, hotel occupancy, and future goals. The Committee also held a joint meeting with the Auburn Arts Commission to receive an update on celebrations of the Commission's 25th year landmark including establishment of an arts and education committee, a new partnership with Green River Community College Interurban Art Docent Program, Artrageous - Artists In Action Fair, and Walk the Talk Public Art Program. All events were co-sponsored by King County 4Culture including grant funds for Auburn Avenue Theater. The Arts Commission also reviewed future goals. The Committee also recommended approval of Resolution No. 4541, the 2010 - 2014 Consolidated Plan, and discussed 2009 Comprehensive Plan amendments. The next regular meeting of the Planning and Community Development Committee is scheduled for November 9, 2009 at 5:00 p.m. C. Public Works Chair Wagner reported that the Public Works Committee met this afternoon at 3:00. The Committee discussed and recommends approval of a contract administration item regarding Project Number CP0904 and discussed Resolution No. 4537 and the HUD Section 108 loan. The Committee received a report on policies and procedures for art in public places and discussed Resolution No. 4540 related to the Comprehensive Emergency Operations Pfan, a disputed back billing on a utility account, the 2010 budget, flood preparedness, Six Year Transportation Improvement Plan, and Resolution No. 4535. The next regular meeting of the Public Works Committee is scheduled for November 16, 2009 at 3:00 p.m. D. Finance Chair Backus reported that the Finance Committee met this evening at 6:30. The Committee approved claims and payroll vouchers and Resolution No. 4537 related to surplus of property. The Committee also discussed Resolution No. 4539, Resolution No. 4541, the 2010 budget, and New Market Tax Credits. Chair Backus noted that a special City Council meeting to discuss the 2009-2010 Biennial Budget, property tax revenues and other revenue sources is scheduled for Thursday, November 5, 2009 at 5:30 p.m. in Council Chambers. The next regular meeting of the Finance Committee is scheduled for November 16, 2009 at 6:30 p.m. Page 6 Citv of Auburn Council Meetinq Minutes November 2. 2009 E. Community Center Chair Wagner reported that the Community Center Committee has not met and no future meeting is schedule at this time. F. Downtown Redevelopment Chair Norman reported that the Downtown Redevelopment Committee met on October 27, 2009 at 4:00 p.m. The Committee discussed signal control boxes in the downtown urban core and options to move or screen them. The next regular meeting of the Downtown Redevelopment Committee is scheduled for November 10, 2009 at 4:00. IV. REPORTS At this time the Mayor and City Council may report on significant items associated with their appointed positions on state, regiona/ and local organizations. A. From the Council Deputy Mayor Singer noted that the award received by Mr. Chevalier is a significant international award and expressed her pride in his accomplishments. Deputy Mayor Singer reported that she attended the Regional Leadership Conference on Clean Technologies to promote project ASCENT (Auburn Scientific Center for Emerging New Technologies) and to discuss collaboration of funding and expertise for the four incubators they are working with. She also attended the White River Valley Museum Halloween Costume Ball. In addition, she attended the Cities and Schools Forum to discuss flooding issues and to report on the Clean Technologies Incubator. Representing Puget Sound Regional Council, she also attended the Washington State Advisory Board meeting to discuss issues related to Interstate 405 and State Route 167 corridor project. Deputy Mayor Singer invited the public to attend an open house related to this project on November 3, 2009 at Kent Commons from 4:00-7:00 p.m. She and Councilmember Wagner met with other incubator representatives to tour Auburn's historical post office facility on Auburn Avenue to ascertain whether it might be a good site for project ASCENT's incubator site. Deputy Mayor Singer reminded citizens that elections will be conducted on Tuesday and encouraged everyone to vote. Councilmember Wagner noted that, during the meeting with the incubator representatives, they commented that the Auburn Page 7 Citv of Auburn Council Meetinq Minutes November 2, 2009 Avenue Theater would be useful for entrepreneur presentations. Councilmember Wagner reported that he attended a meeting at Washington State University (WSU) at which he was able to continue efforts to recruit WSU professors to interact with the Auburn Environmental Park (AEP) district. The WSU has an on- site incubator that deals with green information technologies. He also made contact with a professor who is well connected to Washington State Department of Ecology as a water resource expert and also with the director of the Institute for Sustainable Design, which is the Leadership in Energy and Environmental Design (LEED) connection for WSU in the AEP district. He also worked with students on engineering designs for green friendly streets in the AEP district. Councilmember Backus stated that she attended the Cities and Schools Forum and reported on the collaboration of various entities with regard to flooding potential in the Auburn area. Councilmember Norman reported that she attended the Griefworks breakfast fundraiser and pointed out that Griefinrorks is a wonderful resource that provides counseling for many issues related to grief counseling. Councilmember Peloza reported that he attended the Cities and Schools Forum and spoke regarding various methods used to advertise the forum. He also attended the King County Pollution Abatement Advisory Committee meeting and spoke regarding a water quality survey completed by King County this year. Councilmember Peloza shared some of the results of the survey which showed strong support to protect and enhance water quality, provided positive ratings for waste water treatment plants, that agriculture and forestry are leading choices for use of biosolids, and water quality, and that global warming and air pollution represent 50% of issues of importance to residents. He also attended a Water Resource Inventory Area (WRIA 9) Management Committee meeting to discuss strategies pertaining to the King Conservation District assessment for 2010. The Committee recommended the same level of assessment as the 2009 distribution. Councilmember Peloza reported that he will attend the National League of Cities Annual Congress of Cities in November. He is a member of the Energy, Environment and Natural Resource Steering Committee and has been asked to serve as a panelist for local food initiatives to discuss his quest in getting a farmers market off the ground. Page 8 Citv of Auburn Council Meetinq Minutes November 2, 2009 Mayor Lewis and Councilmember Peloza also reported on the King and Pierce Counties Farm Bureau meeting. B. From the Mayor Mayor Lewis spoke regarding the upcoming election and the importance of establishing relationships with a new King County Executive and other newly elected officials. Mayor Lewis also spoke regarding Council's participation and representation on various Pierce and King County committees and other regional committees. Most of the issues that the various committee members have discussed pertain to finances, flu and flood. With the nature of the issues involved in the upcoming months, Council, staff and the entire community will need every possible channel available to ensure that citizens are kept safe. Mayor Lewis spoke regarding the current economic situation and the difference it has made for the community to have Auburn representatives involved in the various committees. V. CONSENT AGENDA All matters listed on the Consent Agenda are considered by the City Council to be routine and will be enacted by one motion in the form listed. A. Minutes 1. Minutes of the October 19, 2009 regular City Council meeting. B. Vouchers F4.9.2, F4.9.5 1. Claims Claims check numbers 389697 through 390054 in the amount of $2,601,966.56 and dated November 2, 2009. 2. Payroll Payroll check numbers 527550 to 527641 in the amount of $303,060.97 and electronic deposit transmissions in the amount of $1,161,775.72 for a grand total of $1,464,836.69 for the pay period covering October 15, 2009 to October 28, 2009. Public Works Project Number CP0904 04.12.1 CP0904 City Council award Contract 09-08, Project Number CP0904, 2009 Citywide Sidewalk Repair Project, to Global Contractors, LLC on their low bid of $135,409.95. Deputy Mayor Singer moved and Councilmember Wagner seconded to approve the consent agenda. MOTION CARRIED. 6-1. Councilmember Haugen voted no. VI. UNFINISHED BUSINESS There was no unfinished business. VII. NEW BUSINESS There was no new business. VII1. ORDINANCES AND RESOLUTIONS A. Ordinances There was no ordinance for Council consideration. At 8:25, Mayor Lewis recessed the meeting to executive session for approximately fifteen minutes for the purpose of discussing pending or potential litigation pursuant to RCW 42.30.110(1)(i). Staff members required for the executive session included City Attorney Daniel B. Heid, Finance Director Shelley Coleman, Public Works Director Dennis Dowdy, and Human Resources/Property and Risk Management Director Heineman. At 8:42, Mayor Lewis extended the executive session for an additional 10 minutes. At 8:52, Mayor Lewis reconvened the meeting. B. Resolutions 1. Resolution No. 4535 03.10.8 A Resolution of the City Council of the City of Auburn, Washington, extending the moratorium created and Page 10 Citv of Auburn Council Meetinq Minutes November 2, 2009 established by Resolution No. 4416, as amended by Resolutions 4442 and 4476, related to the filing, receipt, and approval of applications for development within areas of the City located within, in whole or in part, floodplains as determined by the Federal Emergency Management Administration Councilmember Norman moved and Councilmember Backus seconded to table Resolution No. 4535. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Resolution No. 4537 F4.6.1 A Resolution of the City Council of the City of Auburn, Washington, declaring certain items of property as surplus and authorizing their disposal Councilmember Backus moved and Councilmember Peloza seconded to adopt Resolution No. 4537. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Resolution No. 4541 03.4.1.7 A Resolution of the City Council of the City of Auburn, Washington, adopting the Consolidated Plan for years 2010 to 2014 and the 2010 Annual Action Plan Councilmember Norman moved and Councilmember Backus seconded to adopt Resolution No. 4541. ADJOURNMENT At 8:55 p.m., Mayor Lewis recessed the meeting for a five minute intermission and then adjourned immediately to closed session for the purpose of discussing labor relations and collective bargaining per RCW 42.30.140(4).
