CALL TO ORDER Chair Lynn Norman called the meeting to order at 6:02 p.m. in the Council Charnbers located on the first floor of Auburn City Hall, 25 West Main Street, Auburn, WA. Committee members present were: Chair Lynn Norman, Vice Chair Nancy Backus and Member Rich Wagner. Also in attendance were Planning Commissioner members: Chair Judi Roland, Vice Chair Kevin Chapman, Bob Baggett, Joan Mason, Dave Peace, and Peter DiTuri. Commissioners Ron Copple and Michael Hamilton were excused. Staff members present included: Mayor Pete Lewis, Planning Director Cindy Baker, Assistant Director Kevin Snyder, Senior Planner Chris Andersen, Assistant City Attorney Steve King and Planning Secretary Renee Tobias. Audience members included: Nicole Petrino-Salter, Karen L. Campbell, Joyce Terry and Rudy Terry. II. JOINT STUDY SESSION WITH PLANNING COMMISSION A. Code Update Project This meeting is a continuation of the August 4, 2009 study session to discuss Tier 1 of the draft text amendment language for the Phase 2 of the Code Update. Chaqter 18.65 - Administrative and Conditional Uses Director Cindy Baker acknowledged that staff are seeking the group's input on changes to the Administrative and Conditional Use permit process based on what will work best for the City regarding business and economic development. Staff distributed a Policy Question for Administrative and Conditional Use Process. The City's Comprehensive Plan Guidance indicates that Conditional Use Permits should be divided into two classes under the zoning code. Routine permits intended to merely check compliance with standards should be an administrative process with appropriate appeals provisions. Permits involving more substantive policy questions or interpretations should be processed through the Hearing Examiner system with appeal to the City Council. A third option for the group to consider would be those land uses that should be allowed outright without need for administrative or conditional use permit approvals. Mr. Andersen stated that the Conditional and Administrative use Tables were prepared specifically to discuss those uses that currently require a Conditional Use Permit in the zoning designations. In response to Councilmember Wagner's request, staff distributed a copy of the Auburn City Code 18.07.020 Residential Zones Uses, Permitted Use Table. Staff confirmed that an Administrative Use Permit would follow the same analysis process that would be done for a Conditional Use Permit and Planning and Community Development Committee Minutes August 11, 2009 Hearing Examiner. The four required public notices would be: 1) sign posted at site, 2) City public notice board and website, 3) radius mailing within 300 feet, and 4) newspaper publication. It was agreed that the radius mailing would be extended to 500 feet for applications in commercial, industrial and RC zoned areas. Senior Planner Chris Andersen reiterated the Policy Question presented to the group. Conditional Use Permit process is a land use regulatory tool designed to address proposals that offer the potential for a higher degree of impact, i.e., traffic, noise or incompatible land uses between two sites, or for those proposals that necessitate a higher level of public scrutiny. Mr. Andersen reviewed the packet's Conditional and Administrative Uses Table with the group, receiving their input of an administrative, conditional or outright use for each zone (attached). Planning and Legal staff provided definitions and clarifications in response to the group's questions. Staff noted that Auburn City Code 18.64.040, Administrative and Conditional Use Permits, Findings of Fact, gives guidance to the Hearing Examiner and staff when reviewing applications. Staff was not recommending any changes to ACC18.64.040, other than quantifying 18.64.040.A, Findings of fact. Staff will work with the City's Legal Department on this. Chair Norman asked the group to this section at a later time and provide any feedback directly to staff. Chapter 18.32 - M1 Liqht Industrial District Chapter 18.33 - Environmental Park District Chapter 18.56 - Siqns ' The Committee and Commission agreed to meet on August 25, 2009 between 5:30 p.m. and 7:15 p.m. to discuss Chapter 18.32 - M1 Light Industrial District, Chapter 18.33 - Environmental Park (EP) and District Chapter 18.56 - Signs. A Public Hearing will follow at 7:30 p.m. for the Planning Commission to receive comments on Chapter 18.56 - Signs. A Public Hearing will be held by the Planning Commission on September 9, 2009 to receive comments regarding Chapter 18.32 - M-1 Light Industrial District, Chapter 18.33 - Environmental Park (EP) District, Chapter 18.64 - Administrative and Conditional Uses and Chapter 18.46 (Temporary Uses). III. ADJOURNMENT There being no further business to come before the Planning and Community Development Committee, Chair Norman adjourned the meeting at 8:11 p.m. APPROVED THISDAY OF AUGUST 2009. & Lynn or , Chair nee S.
