A RESOLUTION OF THE CIN COUNGL OF THE CITV OF
AUBURN, WASHIN6TON, AUTHORIZING THE MAVOR AND CITV
CLERK TO EXECUTE AN AGREEMENT BETWEEN THE CITY OF
AUBURN AND W. H. HUGHES HOMES, ING FOR A PAVBACK
AGREEMENT FOR UTILITV EXTENSIONS
WHEREAS, W. H. Hughes Homes, Inc. is the owner of pmpehy in the City of
Auburn which W. H. Hughes Homes, Inc. is tleveloping; antl
WHEREA$ in connec[ion with the tlevelopment of property by W. H. Hughes
Homes, Inc., il is necessary that utilities be pmvitled to the propehy, which the
developer Is willing to tlo in exchange for a payback agreemenl whereby the tleveloper
may be able to recoup a portion of the ms5 of brining the u[ilities to the property when
olher pmpetlies take advantage of antl connecl ro lhose utilities; antl
WHERFAS, [his matter was initially considered by the City Council in connection
with its pmposed ResoWtion No. 4119, in September of 2007 antl
WHEREAS, W. H. HUGHES HOMES, INC. has recalcvlated its repaymenl
amounts to more favorably reflect the costs to and benefits for other propehies in the
viciniTy in connection with the Payback agreement; antl
WHEREAS, it is in the public interest for the parties ro en[er into an agreement
for a payback agreement as described above and as set forth more patliculatly in the
attachment hereto.
NOW, THEREFORE, THE CITV COl1NGL OF THE CITV OF AUBURN, KING
COUNTY, WASHINGTON, HEREBV RESOLVES as follows'.

Section 1. The Mayor ot the City of Aubum and the Aubum City Qerk are
hereby authorized to execu[e an Agreement between the Ciy of Auburn antl W. H.
Hughes Homes, Inc. for a payback agreement, which agreement shall be in substantial
conformity with the Agreement a copy of which is attachetl hereto, marked as Exhibit
"A" and incorporated herein by Ihis reference.
Section 2. The Mayor is hereby authorized to implement such atlministrative
procetlures as may be necessary lo carry, out the direc[ives of ihis legislalion.
Sec4on 3. This resolWion shall be in full (orce and effect upon passage antl
signahres hereon.
