HomeMy WebLinkAbout3614 ORDINANCE NO. 3 6 1 4 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR THE VACATION OF STREET RIGHT-OF-WAY, SITUATED ON A PORTION OF 49TH STREET N.E. FROM "G" STREET N.E. EASTERLY TO THE END OF THE EXISTING RIGHT-OF-WAY, AND SITUATED WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN. WHEREAS, the City Council of the City of Auburn, Washington, have passed the and adopted Resolution No. 1182, resolving that a public hearing shall be had for the purpose of determining whether or not the hereinafter described street right-of-way located on a portion of 49th Street N.E. from "G" Street N.E. easterly to the end of the existing right-of-way, within the corporate limits of the City of Auburn, shall be vacated, said portion to be vacated being herein- after legally described in Section 1 of this Ordinance; and WHEREAS, notice of public hearing to vacate the portion of a certain street right-of-way located on a portion of 49th Street N.E. from "G" Street N.E. easterly to the end of the existing right-of-way, within the corporate limits of the City of Auburn, in the time and manner provided by law, giving notice that the hearing on said Resolution No. 1182 was held on the 2nd day of March, 1981, at 8:00 P.M. in the Council Chambers of the Auburn City Hall, no objections thereto were filed with the City Clerk or presented to the City Council at said hearing; and WHEREAS, the City Council, having deemed that the petition for vacation was proper and that no vested rights would be affected by the same; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: r Section 1. That the following described portion of a certain street right-of-way situated on a portion of 49th. (S. 280th St.) lying in that portion of the second addition to White River Valley Home Tracts unrecorded in Section 31, Twp 22 N, R 5 East, W..M., described as follows: _ Commencing at the Northeast corner of the W.A. Cox Donation Land Claim No. 38 in said Section 31; thence S 00°07'40"E, along the East line of said Donation Land Claim No. 38, a distance of 898.20 feet to the South line of 49th St. N.E. (S. 280th St.) as established by deed to King County under recording No. 5869551 and the True Point of Beginning; thence S 88°51'30" W, along said South line of 49th St. N.E., a distance of 420.31 ft; thence N 00°07'40", a distance of 10.00 feet to the South line of said 49th St. N.E. as established by City of Auburn Vacation Ordinance No. 2627 and recorded under Auditor's File No. 7301120384; thence S 88°51'30" W, along said South line, a distance of 30.00 feet to the West line of "G" St. N.E. (90th Ave. S.) ex- tended Southerly; thence N 00007'07" W, along said West line Cl extended, a distance of 50.00 feet to the North line of said 49th. St. N.E.; thence N 88°51'30" E, along said North line, a distance of 450.31 feet to the East line of aforesaid Donation Land Claim No. 38; thence S 00°07'40" E, alonq said East line, a distance of 60.00 feet to the True Point of Beginning, situate in the City of Auburn, King County, Washington. be and the same is hereby vacated, and the property lying in said portion of a certain street right-of-way described hereinabove, shall be returned and belong to the abutting property owners, of said portion of a certain street right-of-way located on a portion of 49th Street N.E. from "G" Street N.E. easterly to the end of the existing right-of-way, lying within the corporate limits of the City of Auburn. Section 2. That an easement be retained for public utility purposes over the north 20 feet of that portion of 49th Street N.E. to be vacated as legally described in Section 1. Said easement shall be over and across, upon and underneath. the aforesaid north 20 feet for ingress and egress and for the purpose of laying, maintaining and installing public utilities. Section 3. Upon the passage, approval and publication of this Ordinance, the City Clerk shall cause a certified copy of this Ordinance to be recorded in the office of the King County Auditor. ------------------- Ordinance No. 3614 Page Two 3-10-81 Section 4. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law.
