Home My WebLink About3621 ORDINANCE NO. 3 6 2 1 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING, FOR THE ANNEXATION TO THE CITY OF AUBURN OF A CONTIGUOUS AREA OF LAND LYING ON THE WEST SIDE OF AUBURN WAY NORTH IN THE 4700 BLOCK, 14HICH LAND IS DESCRIBED IN A PETITION DULY FILED WITH THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON. WHEREAS, the City Council of the City of Auburn was notified by owners of property having more than ten percent in value of the assessed valuation within the proposed area to be annexed, that they desired to circulate a petition to commence annexation proceedings to the City of Auburn; and WHEREAS, the City Council of the City of Auburn subsequently authorized the circulation of the petition within the proposed area to be annexed; and WHEREAS, the petition for annexation of the property hereinafter described was duly filed with the City Council of the City of Auburn on the 3rd day of November, 1980, which petition was signed by the owners of more than 75% in value of all of the property lying within the limits of the proposed area to be annexed according to the assessed valuation for general taxation of the property for which an annexation is petitioned, said petition setting forth the legal description of the property to be annexed and being accompanied by a plat.outlining the boundaries of said area sought to be annexed; and WHEREAS, the City Council of the City of Auburn fixed'a date for public hearing to be held at 8:00 P.M. in the Council Chambers of the Auburn City Hall on November 17, 1980, setting forth notice of said public hearing for annexation to be published in the official City newspaper of the City of Auburn in one issue of said newspaper, and providing for the posting in three public places within the area proposed for annexation of copies of said notice of public hearing; and WHEREAS, notice of public hearing of said petition of annexation to the City of Auburn has been duly published in the official newspaper of the City of Auburn in one regular issue of said newspaper, and the said notice of public hearing having been posted in three public places within the area proposed for --------------------- Ordinance No. 3621 Page one 4-1-81 annexation by the City Clerk of the City of Auburn, and said public hearing being held at 8:00 P.M. in the Council Chambers of the Auburn City Hall on November 17, 1980, and the City Council of the City of Auburn having determined that said annexation is in the best interest and welfare of the City of Auburn, did accept and approve the petition above described and directed the filing of a notice of its intention to annex the hereinafter described property with the Boundary Review Board as required by Section 9 of Chapter 189 of the Laws of the State of Washington for the year 1967; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY'OF AUBURN, WASHINGTON, AS FOLLOWS: Section 1. That the petition for annexation of the property hereinafter described in Section 6 of this Ordinance has been duly and properly filed with the City Council of the City of Auburn, and complies with all requirements of law. Section 2. That by regular motion adopted and passed by the City Council on the 3rd day of November, 1980, it was ordered that a public hearing be had on said petition for annexation at 8:00 P,M., in the Council Chambers of the Auburn City Hall on November 17, 1980, providing for the proper notice to be published and posted according to law. Section 3. That proper notice of public hearing was duly published in the official newspaper of the. City of Auburn, and was duly posted in three public places within the area proposed for annexation hereinafter described, and that a public hearing was held at 8:00 P.M. in the Council Chambers of the Auburn City Hall on the 17th day of November, 1980. Section 4. That at the conclusion of the public'hearing in the City Hall Council Chambers of the City of Auburn on the 17th day of November, 1980, the City Council did approve the petition for annexation and directed the filing of a notice of its intention to annex the hereinafter described property with the Boundary Review Board as required in Section 9 of Chapter 189 of the State of Washington Laws for the year 1967. -------------------- Ordinance No. 3621 Page Two 4-1-81 r Section 5. That notice of intention to annex was filed with the Boundary Review Board effective January 21, 1981, and the Boundary Review Board received no request for review and did not itself choose to invoke jurisdiction; therefore, inasmuch as the sixty day period subsequent to filing provided for in RCW 36.93.100 has elapsed, the Notice of Intention was deemed approved as of March 22, 1981 and the Boundary Review Board forwarded their findings to the City Council of the City of Auburn. Section 6. That the property lying contiguous on the west side of Auburn Way North in the 4700 block, hereinafter described be and the same is hereby annexed to the City of Auburn, said property being more particularly described as follows: Beginning at the intersection of the northwest corner of Lot 2 of King County Short Plat #976060 with the east line of 85th Ave. So.; thence northerly along the east line of 85tn Ave. So., 225.20 ft; thence easterly 287 feet to the Auburn City Limits as established by Ordinance #2511 which is the true point of beginning of this description; thence northwesterly along so City Limits 26 ft; thence southwesterly to a pt lying 60 ft west of the true point of beginning; thence westerly to a pt on the east line of 85th Ave. So lying 287 ft west of the true point of beginning and 225.20 ft north of said intersection of the north- west corner of Lot 2 of said short plat and the east line of 85th Ave. So; thence south.along the east line of 85th Ave. So. 225.20 ft to the northwest corner of Lot 2 of said short plat; thence east along the north.line of said Lot 2 200 ft to the northeast corner thereof; thence southerly along the east line of said Lot 2 54.12 ft to the southeast corner thereof; thence easterly along the south line of Lot 1 of so short plat to said City Limits; thence north and northwesterly along sd City Limits to the true point of beginning. (Also known as portions of Tracts 23, 24, 25, 26 & 30 of Second Addition to White River Malley Home Tracts, an Unrecorded Plat). Together with the following described property; the east half of the south half of the following described tract: Beginning at the intersection of the south line of W.A. Cox DLC with the west line of Section 31, Twp 22 N, R 5 East, W.M., in King County, Washington; running thence south 8904' east 426.57 ft; thence north.2°3'30" east 837.08 ft to a pt which is the true point of beginning of this description; running thence south 89°4' east 554.24 ft to the west boundary line of the County Road; thence north 36°50' west 136.90 ft; thence north 89°4' west 465.2 ft; thence south 213'30" west 107.04 ft to the true point of beginning. Except that portion lying east of said City Limits of Auburn. Section 7. That the effective date of the annexation of the above described property to the City of Auburn shall be the effective date of the passage of this Ordinance providing for such annexation. -------------------- Ordinance No. 3621 Page Three 4-1-81 r Section 8. That in accordance with the terms of the petition for annexation of the above described property, the area to be annexed shall assume the indebtedness of the City of Auburn existing at.the.effective date of the passage of this Ordinance. Section 9. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law.
