HomeMy WebLinkAbout3622 1 ORDINANCE NO.3 6 2 2 AN ORDINANCE OF THE CITY OF AUBURN, KING COUNTY, WASHINGTON, RELATING TO AND PROVIDING FOR THE COMMENCEMENT OF AN ACTION TO QUIET TITLE TO THAT PORTION OF 40TH STREET N. F.., SITUATED ON THAT PORTION OF LAND LYING UPON THE HARVEY H. JONES DONA- TION LAND CLAIM NO. 39, AND SITUATED WITHIN THE CITY LIMITS OF THE CITY OF AUBURN, STATE OF WASHINGTON. WHEREAS, on September 15, 1980, the City of Auburn approved Ordinance No. 3551, said Ordinance providing for the quieting of title to certain property situated within the City of Auburn, and for the commencement of public condemnation proceedings, as well as the employment of Harpold, Hanis, Combs & Fiori to commence such actions as are necessary to quiet title to the land described in Ordinance No. 3551; and WHEREAS, the City Council has been advised by the City Attorney that the legal description of said land was partially incorrect and therefore requires formal amendment; THE CITY COUNCIL OF THE CITY OF AUBURN, KING COUNTY, WASHINGTON, DOES ORDAIN AS FOLLOWS: Section 1. That all of the provisions of Ordinance No. 3551, be and remain in full force and effect with the exception of Section 1 of Ordinance No. 3551, which shall be and hereby is amended as follows: That title to the following described land located in the County of King, State of Washington, and more particularly described as follows: The South 34 feet of the North 1,387 feet of the East 722.4 feet of. the Harvey H. Jones Donation Claim No. 39(16), Section 6, Township 21 North, Range 5 East W.M., as recorded under King County Auditor's File No. 4702522, less those portions deeded under King County Auditor's File No. - 7908270541, Ordinance No. 3622 Page 1 should be quieted in the name of the City of Auburn, as the City has continuously, exclusively, openly, adversely, notoriously, occupied, improved and main- tained said land since March 17, 1959, and that in order to quiet title thereof by the City of Auburn, the law firm of Harpold, Hanis & Fiori are hereby authorized to commence quiet title proceedings upon said land. Section 2. That this Ordinance shall take effect and be in full force five (5) days from and after its passage, approval and publication, as provided by law. McConnehey, the duly appointed, qualified City Clerk of the City of Auburn, a Municipal Corporation and Code City, situate in the County of King, State of Washington, do hereby certify that the fore- going is a full, true and correct copy of ordinance No. 3622 of the ordinances of the City of Auburn, entitled "AN ORDINANCE OF THE CITY OF AUBURN, KING COUNTY, WASHINGTON, RELATING TO AND PROVIDING FOR THE COMMENCEMENT OF AN ACTION TO QUIET TITLE TO THAT PORTION OF 40TH STREET N.E., SITUATED ON THAT PORTION OF LAND LYING UPON THE HARVEY H. JONES DONATION LAND CLAIM NO. 39, AND SITUATED WITHIN THE CITY LIMITS OF THE CITY OF AUBURN, STATE OF WASHINGTON." I certify that said Ordinance No. 3622 was duly passed by the Council and approved by the Mayor of the said City of Auburn, on the 6th day of April A.D., 19 81.
