AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR THE VACATION OF STREET RIGHT-OF-WAY, SITUATED ON A PORTION OF 17TH STREET S.W. INCLUDED IN THE AUBURN 400 PROPERTY, AND SITUATED WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN, WASHINGTON. 4FC;1RDF?` iFll': sr. !?? 16 10 49 M c? .tl 0 00 WHEREAS, the City Council of the City of Auburn, Washington, have passed and adopted Resolution No. 1197, resolving that a public hearing shall be had for the purpose of determining whether or not the hereinafter described street right-of-way located on a portion of 17th Street Southwest included in the Auburn 400 property, within the corporate limits of the City of Auburn, shall be vacated, said portion to be vacated being hereinafter legally described in Section 1 of this Ordinance; and WHEREAS, notice of public hearing to vacate the portion of a certain street right-of-way located on a portion of 17th Street Southwest included in the Auburn 400 property, within the corporate limits of the City of Auburn, in the time and manner provided by law, giving notice that the hearing on said Resolution No. 1197 was held on'the 20th day of April, 1981, at 8:00 P.M., at which time the public hearing was conducted and closed, referring the matter to the Public Works Department for study and review thereon; and WHEREAS, at the regular City Council meeting held May 4, 1931, no objections thereto were filed with the City Clerk or presented to the City Council regarding the public hearing; and WHEREAS, the City Council, on flay 4, 1981, having deemed that the petition for vacation was proper and that no vested rights would be affected by the same; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That the following described portion of a certain street right-of-way situated on a portion of 17th Street Southwest included in the Auburn 400 property, within the corporate limits of the City of Auburn, Washington, 1/2 and more particularly described as follows: -------------------- Ordinance No. 3636 Page One 5-12-81 r That portion of the NW 1/4 of Section 24, T 21 N, R 4 EWM, City of Auburn, County of King, State of Washington, more particularly described as follows: Commencing at the west quarter corner of sd Sec 24; c'7 d V O Thence N 89°18'51" E, 2189.59 ft alg the S line of sd NW 1/4, being coincident with the centerline of 12th. Ave. N. (AKA Boyd Road), to the westerly margin of the Seattle-Tacoma Interurban Railway right-of-way (AKA the Puget Sound Electric Railway right-of-way) and the TPOB; t ?O CC) 1 4 Thence N 23°44'28" E,_32.95 ft alg sd Westerly margin to the Northerly margin of sd 12th Avenue North; Thence S 89°18'51" W, 482.83 ft alg sd Northerly margin to a pt of curvature; Thence southwesterly 14.58 ft alg the arc of a non-tangent curve to the right, having a radius of 440.00 ft, the radius pt of which bears N 33°26'59" W, through a central angle of 01°53'52" to a pt of reverse curvature; Thence southwesterly 26.66 ft along the arc of a tangent curve to the left, having a radius of 25.00 ft, through a central angle of 61°06'00" to the South line of sd NW 1/4; Thence N 89°18'51" E, 493.75 ft alg sd south line to the TPOB. Containing 0.34 acres, more or less. NOTE: The boundary in this legal description was derived from that Record of Survey as recorded in Vol 20, pg 70 of Surveys, Recording No. 8001319010, records of King County, WA. be and the same is hereby vacated, and the property lying in said portion of a certain street right-of-way described hereinabove, shall be returned and belong to the abutting property owners, of said portion of a certain street right-or-way located on a portion of 17th Street Southwest included in the Auburn 400 property, lying within the corporate limits of the City of Auburn. Section 2. The City of Auburn shall retain an easement over, underneath, upon and across the entire vacated street for ingress and egress for the purpose of laying, maintaining and installing all public utilities. Section 3. This street vacation shall become effective upon the recording of the Auburn 400 subdivision. -------------------- Ordinance No. 3636 Page Two 5-12-81 . , . . . s:. , .. Section 4. Upon the passage, approval and publication of this Ordinance, the City Clerk shall cause a certified copy of this Ordinance to be recorded in the office of the King County Auditor. Section 5. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication; as provided by law. INCLUDED IN THE AUBURN 400 PROPERTY, AND SITUATED WITHIN THE CORPORATE I.D=S OF THE CITY OF AUBURN, WASHINGTON. I certify that said Ordinance No. 3636 was duly passed by the Council and approved by the Mayor of the said City of Auburn, on the 18th day of May A.D., 19 81.
